After investigation and inspection the Board finds that
the applicant requests permission to divide property and build
two one family homes. The Board~findS'the property involVed
is lot numbered 12 and lot numbered 14 in Greenport'Driving
Park, a filed map,'however,'the filed map was not adopted and made
part of the Southold Town Building Zone Ordinance, when said Ordn-
ance was enacted. For all intent and purposes under zoning, lot
12 and lot 14 are considered to be one lot, and only one dwelling
may be erected thereon. By dividing the property and creating two
lots there would be more than fifty per cent reduction of the
frontage and area or,the lot~ as required under the zone, Ordinance.
Regardless of the fact, the immediate area is built up with 50 foot
· rontage, lots, the, Board can prevent the creation of more 50 foot
frontage lots, and thus prevent the over crowding of land.
The Board finds that strict application of the Ordinance will
not produce practical difficulties or unnecessary hardship; the
hardship created is not unique and would be shared by all properties
alike in the immediate vicinity of this property and in the same
use district; and the variance does not observe the spirit of the
Ordinance and will change the character of the district.
THEREFORE, IT WAS RESOLVED: Ruscon C~truction Co., Inc., 69
Further Lane, Riverhead, New York, be DENIED permission to divide
property with insufficient frontage and area and use for single
family construction, on property located on the north side Brown
Street, Greenport, New York, lots number 12 and 14 in Greenport
Driving park.

1. STRICT APPLICATION OF THE ORDINANCE would produce practicaldifficuities or unneces-
sary HARDSHIP because J This is an old filed map property where most of the
area is built up on ~0 ft lots.. There is public water for all lots in
the area~ so there will be no problem with the neighbors.
It would not be practical to require a 100 ft lot to be used
in this area of small individual lots.
2. The hardship created is UNIQUE and is not shared by all properties alike in the immediate
vicinity of this property and in this use district because: This 'lot (12~r~br combimed)
the largest lot in this area in one ownership which has not been
built upon~ :
3. The Variance would observe the spirit of the Ordinance and WOULD NOT CHANGE THE
CHARACTER OF THE DISTRICT because: The proposed new dwellings will meet

and as one family dwellings will cause no harm to the area.

a. This application must be completely filled in by typewriter or in ink and submitted in duplicate to the Building
Inspector.
b. Plot p]an showing location of Jot and of buildings on premises, relationship to adjoin ng prem ses or public streets or
areas, and giving a detailed description of layout of.property must be drawn on the diagram which is part of this application.
c. The work covered by this application may not be commenced before issuence of Building Permit.
d. Upon approval of this application, the Building Inspector will issue a Building Permit to the applicant. Such permit
shall be kept on the premises available for inspection throughout the progress of the work.
e. No building sh.alJ be occupied or used in whole or in part for any purpose, whatever until a Certificate of Occupancy
shall have been granted by the Building Inspector.
