Dear Mr. Kujawski: The following action was taken by the Bp.ard of Trustees during their regular meeting held on May 29./ 1986 regarding the above captioned matter. Moved by Trustee Goubeaud seconded by Trustee Krupski ~HEREAS, Frank A. Kujawski, Jr. c/o A. Reilly & Sons, Contractor on behalf of Gerald and Betty Wells applied to the Southold Town Trustees for relief of the Wetland Ordinance, Chapter 97, Article II, Section 97-22 for the construction of a swimraing pool and to grade and plant, and WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area; and WHEREAS, the Board has considered all the documentation submitted concerning this request; and ~HEREAS, the Board has made the following findings of fact: 1. By this request appellant requests a waiver of the ~etland Ordinance, Chapter 97, Article II, Section 97-22 to construct a swimming pool and to regrade and plant, and 2. The property in question is identified on a Map of Property surveyed for Gerald S. & Betty J. Wells at Cutchogue, New York and more particularly identified on the Suffolk County Tax Map as: 1000-138-5. In view of the foregoing information ~ NOW, THEREFORE, BE IT RESOLVED that Frank A. Kujawski, Jr. c/o A. Reilly & Sons, Contractor on behalf of Gerald and Betty Wells be and hereby are granted a WAIVER of the Wetland Ordinance for the construction of a pool and to grade and plant on property located on Monsetl Lane, Cutchogue -2- subject to the following provisions: 1. During excavation the fill must be ~ontained so that it does not wash into the creek or Wetland area. There shall be no discharge frOm the ~6ol into the Wetlands or creek. During construction the Wetland fringe shall.~be suitably lined with hay bales to prevent construction ~aterial from entering into the Wetland area. Immediately following construction, all areas of exposed soil shall be properly protected with suitable erosion control devices and/or vegetated to prevent entry of soil into the nearby waters. Wells Monse!l Lane Cutchogue, New York 11935 Dear Mr. Wells: The following action was taken by the Board of Trustees at a regular meeting held on March 27~ 1986.regarding your request for a waiver of the Wetland Ordinance for the construction of a deck on your Property in Cutchogue. Resolved that the Board of Trustees be and hereby grant a waiver of the ~etland Ordinance to Mr. Gerald S. Wells~ Monsell Lane, Cutchogue for the construction of a deck to his existing residence. February 25,1986 Town of Southold Board of Trustees Town Hall Southold New York 11971 Dear Members: I would like to request a variance for construction of a deck, which would be attached to my present home but within 75 feet of wetlands. There will be no disturbance to the wetlands since the proposed deck is to be built over out existing patio that is the same distance from the wetlands. Very~ruly y~¥s, Gh~rald S. Wells, M°nsell Lane (Norwold) Cutchogue, NY 11935 FOR DETERMINATION: POSSIBLE RESOLUTION Requested by: Frank Kujawski, Jr. on behalf of Betty & Gerald Wells Monsell Lane, Cutchogue. Pool ConstructiOn Please review the attached information submitted to this office. The Board will have to make an inspection prior to a determination to be made. If the Board determines that a Waiver of the Ordinance will be granted perhaps the following could be stipulated: o During excavation the fill must be contained so that it does not wash into the wetland area or creek. There shall be no discharge from the pool into the wetlands or creek. During construction the wetland fringe shall be suitably lined with hay bales to prevent construction material from entering the wetland area. Immediately following construction, all areas of exposed soil shall be properly protected with suitable erosion control devices and/or vegetated to prevent entry of eroded soil into the nearby waters. CORRESPONDENCE NO. 7 - Request for waiver. Please review the attached information as requested by Gerald S. Wells, to construct a deck, which would be attached to his residence, but within 75' from wetlands. If the Board wishes to waiver the following may be offered: RESOLVED that the Southold Town Trustees Waiver the need of a Wetland Permit for Gerald S. Wells for the Construction of a deck, attached to the existing residence and above the existing patio on property located on Monsell Lane, Cutchogue. If this is not favorable to the Board, please advise and I will notify to submit a full wetland application. 3-. ~E LL.S
