And the approved plans for that dock indicated a water depth 30 inches on the outside of the approved float at mean lower low water. Additionally, the surveyor reported to me that when he staked out the proposed dock for the June inspection during low tide,he observed notably deeper water at the location of the proposed float than was indicated on the project plan. These findings led to the conclusion that some sort of error may have been made—to the applicant's detriment—on the soundings and/or plans that were originally submitted with our application. Thus,I met the surveyor at the site during a NOAA-predicted mean low tide event on July 20,2022,for the purpose of his recording additional soundings, which did turn out to be consistent with the data provided for the dock to the west. As a result, the length of the proposed catwalk can be reduced by 8 feet, which brings the overall seaward projection of the proposed dock in line with the"pier line" drawn between the two adjoining docks to the west and east, with 30 to 34 inches of water beneath the proposed float at mean low tide. I will drop off three(3)hard copies of the revised project plan and updated survey to your office tomorrow morning and present the revised proposal to the Trustees during field inspections. If you have any questions in the meantime, please let me know. Thanks, Rob Robert E. We believe that the dock does in fact comply with the intent of Section 275- 11(C)(2)(c)(1)(c),particularly if the adjacent dock to the southwest does not comply with the Trustees'current requirements for docks. However, having since reviewed the wetlands permit issued in 2016 for the adjacent dock to the southwest,I see that the neighbor's approved dock plan indicates significantly deeper water depths outside their float than those reflected on the applicant's proposed dock plan, Additionally, the surveyor reported to me that when he was staking out the applicant's dock during low tide,he observed deeper water at the location of the proposed float than what is shown on the applicant's plan. Therefore, before we potentially debate the merits of the presently proposed dock location,we would 1 like the opportunity to recanvass the water depths at mean low water to determine whether there may in fact be water depths sufficient to reduce the seaward extent of the proposed dock. We thus wish to postpone the public hearing scheduled for next week until the Board's next meeting on July 13th. Please confirm receipt of our request. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposal is INCONSISTENT with LWRP Policy 6.3 therefore, INCONSISTENT with the LWRP. Goose Creek is an NYSDEC Critical Environmental Area; the cumulative impacts of higher dock density on water quality, wildlife, submerged vegetation, recreation and commercial fisheries have not been addressed. In the event that the action is approved, an alternative to CCA treated pilings is recommended. The proposed dock would be situated at least 15 feet from the laterally extended property line;the dock and associated watercraft would extend seaward a distance well less than one-third the width of the more than 1,000-foot wide waterway;the seaward limit of the proposed dock would be consistent with the"pier line"of the neighboring docks;the catwalk will be constructed with untreated decking;and the proposed float would rest in a water depth of at least 30 inches below mean low tide, based on the hydrographic survey submitted herewith. And although it has been purposefully proposed where there is no wetland vegetation(consistent with'Best Management Practices"),the dock would not inhibit the potential future growth of intertidal marsh beneath it,as within the intertidal zone, the catwalk will be elevated at least 4 feet above grade and constructed with light-penetrating open-grate decking at least 15 feet seaward of the bulkhead. Protect and improve water quality and supply in the Town of Southold. See LWRP Section III - Policies Pages 16 through 21 for evaluation criteria ®Yes ❑ No ❑ Not Applicable To the extent that it is applicable, the project is consistent with Policy 5 because the proposed catwalk will be constructed with untreated decking, inlcuding light-penetrating,open-grate decking a minimum of 15 feet seaward of the existing bulkhead. And although it has been purposefully proposed where there is no wetland vegetation, consistent with'Best Management Practices,"the dock would not inhibit the potential future growth of intertidal marsh beneath it,as within the intertidal zone, the catwalk will be elevated at least 4 feet above grade and constructed with light-penetrating open-grate decking at least 15 feet seaward of the bulkhead. Thus, the project would not create a"fragmentation of ecological communities"along the developed shoreline;result in the physical loss, degradation,or functional loss of ecological components;or otherwise adversely impact the quality or function of the adjacent tidal wetlands or waters of Goose Creek.
