The following policies from the Waterfront Revitalization Program are appropriate. Policy 2—Water Dependent Uses—This project is to reconstruct a fully functional boat docking facility for recreational boating at this waterfront site with a slight modification for a hinged ramp landing to the float. Policy 5—Use of Existing Developed Shorefront—This project will be primarily to restore a long-standing dock facility, clear of sensitive habitat or tidal wetlands and restore it to be safe and reliably usable condition and in compliance with environmental policies to enhance and protect habitats such as eelgrass, tidal wetlands vegetation with suitable design features. Policy 7—Significant Fish& Wildlife Habitat—Protection of significant fish and wildlife habitat has been considered in the development of this project layout. The existing pier begins at the shoreline and extends initially over the rocky shoreline. The existing height will be maintained and raised above intertidal and subtidal bottom sediments at the Mean Low Water line to diminish shading impacts. The intertidal zone is gravel, sand and occasionally moderately sized stone. There will be no change to the dimension, or amount of structure which might affect fish habitat and the height will be raised slightly so habitat and water quality should benefit. Policy 8—Protection&Preservation of Habitat—Protection and preservation of habitat has also been considered in this project and the dock structure is being kept to its existing configuration and will be restored consistent with standards of the industry and restrictions set forth in the Wetlands Law,No. 6, 2004 set forth by the Town of Southold, with no pressure treated decking: Policy 11 —Minimize Damage to Natural Resources - The pier reconstruction project will be conducted in such a way so as to minimize damage to natural resources as identified in Policy 7 above by alignment and elevation. There are no tidal wetlands in the intertidal zone at this dock site. There is no eelgrass. Policy 14—No Measurable Increase in Flooding This project consists of routine replacement of an open wood pile and timber pier that will in no way adversely affect water flow and circulation in the harbor or flooding potential of the area. Flood levels all around Fishers Island are dictated by water levels in Long Island Sound, Fishers Island Sound and Block Island Sound and this structure will have no adverse influence on those flood levels. Policy 15 —No Dredging=Dredging is not required in this project. The dock system will be retained in its current location and configuration to avoid any dredging requirements. The depth of greater than 4 feet, as generally recommended by the NYS DEC and US ACOE, has 9 been reached. The waters are unprotected, and so boats must be berthed stern to shore leaving the motor in the deep enough water to avoid bottom contact during low tide wavy conditions. The berthed boat will not ground out at low tide. Policy 19—Impact on Public Access—Public access will not be jeopardized or impeded as a result of this project. There is no public access usage of the public trust lands or waters at this site due to moderately size stones making passage dangerous for public trust lands at the dock site. The shallow subtidal waters do not present any opportunity or enticement for public access in the area, however, design features have been incorporated into this project which will enhance accessibility, thus, public access to the State's lands and waters will be not be adversely affected by the project. Policy 20—Public Trust Compatibility with Existing Adjoining Properties and Land Uses- Public Trust compatibility with existing adjoining properties and land uses have also been considered in this project. Adjacent and nearby properties have docking facilities similar to this one and this docking facility will not interfere with existing facilities, nor will it impact navigation. Policy 21 —Water Dependent Recreation-This project is consistent with water- dependent recreational opportunities policies set forth in this section. The dock system will continue to be used for boating and water recreation without adversely affecting waterfront access by the neighbors or navigation by the public at large. Policy 24—Scenic Resources, Impairment or Loss --This policy is designed to meet appropriate resource standards and to prevent impairment or loss of scenic resources. The reconstruction of the fixed wood pile and timber pier will not represent any new encroachment or structure which would create a loss of scenic resources. The rail and tie-off piles are not a significant aesthetic impact. Policy 25—Enhance Overall Scenic Quality -The existing dock structure will remain consistent with the scenic quality of the area that has existed for decades and will not adversely affect scenic resources as described in Policy 24 above. Shoreline dock facilities are a common feature along shores of West Harbor and all of New England. This dock does not, nor will it adversely impact the scenic quality of West Harbor;the structure is only visible to the boating public, adjacent residents, and opposing residents, and their numbers are minimal. Policy 44—Preserve and Protect Tidal Wetlands - The restoration of the pier will match the configuration of the long-standing dock facility at this site and should allow the growth of spartina alterniflora if other conditions prove suitable which to date they have not. SUMMARY This project will rebuild an existing, long-standing dock facility for recreational boating access for the Finan's home and property on Fishers Island. In summary, the restoration of the long-standing docking facility is consistent with current permitting policies of the State, Federal 10 and local governments. There will be no new adverse environmental impacts associated with this reconstruction project. In addition, by design, the new structure will be ecosystem friendly, and user friendly to the public, enabling improved waterfront access both from the waterside and along public trust lands of the State of New York and the Town of Southold. This project is consistent with regulations for this work at this location. No mitigative or compensatory measures are required. This routine dock replacement with the minor modification for a stair to the beach and a ramp landing platform that allows for the installation of a hinged ramp. This project complies with applicable standards of the New York State Coastal Management Act, and Consistency Determination has been received.NYS DEC Tidal Wetlands Regulations and Local Ordinance No. 6, 2004 and its approval is respectfully requested. This repair work is consistent with U.S. Army Nationwide Permit No. 3 guidelines and requirements. Respectfully submitted, DOCKO, INC. Photographs of the project site should be submitted. For projects in tidal areas, photographs of the waterway vicinity should be taken at low tide. Using a separate copy of your plan view, indicate the location and direction of each photograph as well as the date and time at which the photograph- was taken. Provide a sufficient number of photographs so as to provide a clear understanding of conditions on and proximate to your project site. Photos attached 4. Provide a copy of any environmental impact statement, or any other environmental report which was prepared for your project Document attached 5. Pr(. 41 thorough discussion of al f a..,--.:,s to your proposal. This discussion shouiar include, but not necessarily be united to, the no action alternative and alternative(s) resulting in less disturbance to waters of the United States. For filling projects in waters of the United States, including wetlands, your alternatives discussion should demonstrate that there are no practicable alternatives to your proposed filling and that your project meets with current mitigation policy (i.e-. avoidance, minimization and compensation). This project is to repair and re-build existing dock facilities consisting of a fixed wood pile and timber ramp landing and pier and retaining / replacing floating dock with a new ramp and replacing deteriorated float restraint piles as necessary. The configuration of these facilities has been unchanged for decades. DREDGING PROJECTS Answer the following if your project involves dredging. 1. Indicate the estimated volume of material to be dredged and the depth (below mean low water) to which dredging would occur. Would there be overdepth dredging? There is no dredging associated with this project. 2. You can apply for a ten-year permit for maintenance dredging. If you wish to apply for a ten-year permit, please provide the number of additional dredging events during the ten-year life. of the permit and the amount of material to be removed during future events. 3. Indicate of your drawings the dewatering area (if applicable) and disposal site for the dredged material (except landfill sites). Submit a sufficient number of photographs of the dewatering and disposal sites as applicable so as to provide a clear indication of existing conditions. For ten-year maintenance dredging permits, indicate the dewatering/disposal sites for future dredging events, if known. 4. Describe the method of dredging(i.e. clamshell, dragline, etc.) and the expected duration of dredging. 5. Indicate the physical nature of the material to be dredged (i.e. sand, silt, clay, etc.) and provide estimated percentages of the various constituents if available. For beach nourishment projects, grain size analysis data is required. 6. De:., a ie method of dredged mat* cur.tainment (i.e. hay bales, embankment, bulkhead, etc.) and whether return flow from the dewatering/disposal site would reenter any waterway. Also indicate if there would be any barge overflow. MOORING FACILITIES Answer the following if your project includes the construction or rehabilitation of recreational mooring facilities. 1. It is generally recommended that any fixed piers and walk ramps be limited to four feet in width, and that floats be-limited to eight feet in width and rest at least two feet above the waterway bottom at mean low water. Terminal floats at private, noncommercial facilities should be limited to 29 feet in length. If you do not believe your proposal can meet with these recommendations, please provide the reason(s). This project is to repair and re-build existing dock facilities consisting of a fixed wood pile and timber pier with a new ramp landing and ramp and retaining / replacing floating dock components as necessary and replacing old float restraint piles. 2. Using your plan view, show to scale the location(s), position(s) and size(s) (including length, beam and draft) of vessel(s) to be moored at the proposed facility, including those of transient verse/(s) if known. 3. For commercial mooring sites such as marinas, indicate the capacity of the facility and indicate on the plan view the location(s) of any proposed fueling and/or sewage pumpout facilities. If pumpout facilities are not planned, please discuss the rationale below and indicate the distance to the nearest available pumpout station. 4. Indicate on your plan view the distance to adjacent marine structures, if any are proximate and show the locations and dimensions of such structures. See attached application drawings 5. Dis: _ e need for wave protectioi, i .` proposed facility. Please be advised that iia permit is issued, you would be required to recognize that the mooring facility may be subject to wave action from wakes of passing vessels, whose operations would not be required to be modified. Issuance of a permit would not relieve you of ensuring the integrity of the authorized structure(s) and the United States would not be held responsible for damages to the structure(s) and vessel(s) moored thereto from wakes from passing vessels. There is no overwhelming need for wave protection at this site. The project site is located at the mouth of Pirate's Cove at the south end of West Harbor where the coastal features and shallow water substantially attenuates the waves generated by brisk north winds. BULKHEAD/NG/BANK STABILIZATION/FILLING ACTIVITIES Answer the following if your project includes construction of bulkheading (also - retaining walls and seawalls) with backfill, filling of waters/wetlands, or any other bank stabilization fills such as riprap, revetments, gabions, etc. 1. Indicate the total volume of fill (including backfill behind a structure such as a bulkhead) as well as the volume of fill to be placed into waters of the United States. The amount of fill in waters of the United States can be determined by calculating the amount of fill to be placed below the plane of spring high tide in tidal areas and below ordinary high water in non-tidal areas. There is no new bank stabilization work proposed in this project. The stone that lays scattered across the nearshore and shoreline bottom sediments beneath the pier landing will not be disturbed in this project. The seawall will be repaired as necessary, no seawall reconstruction is considered necessary at this time; any repair work is more routine maintenance. 2. Indicate the source(s) and type(s) of fill material. No new material will be placed. 3. Indicate the method of fill placement (i.e. by hand, bulldozer, crane, etc.). Would any temporary fills be required in waterways or wetlands to provide access for construction equipment? If so, please indicate the area of such waters and/or wetlands to be filled, and show on the plan and sectional views. There will be no fill placement in this project. .a, r The forec hquests basic information* most common types of projects requiring oepartment of the Army permits. NOAA Fisheries Greater Atlantic Regional Fisheries Office Essential Fish Habitat (EFH) Assessment & Fish and Wildlife Coordination Act (FWCA) Consultation Worksheet August 2021 rev. Authorities The Magnuson Stevens Fishery Conservation and.Management Act(MSA)requires federal agencies to consult with NOAA Fisheries on any action or proposed action authorized, funded, or undertaken by such agency that may adversely affect essential fish habitat(EFH) identified under the MSA. This process is guided by the requirements of our EFH regulation at 50 CFR 600.905,which mandates the preparation of EFH assessments and generally outlines each agency's obligations in the consultation process. The Fish and Wildlife Coordination Act(FWCA)requires that all federal agencies consult with NOAA Fisheries when proposed actions might result in modifications to a natural stream or body of water. The FWCA also requires that federal agencies consider the effects that these projects would have on fish and wildlife and must also provide for improvement of these resources.Under the FWCA,we work to protect, conserve and enhance species and habitats for a wide range of aquatic resources such as shellfish, diadromous species, and other commercially and recreationally important species that are not federally managed and do not have designated EFH. It is important to note that these consultations take place between NOAA Fisheries and federal action agencies. As a result, EFH assessments, including this worksheet, must be provided to us by the federal agency, not by permit applicants or consultants. Use of the Worksheet This worksheet can serve as an EFH assessment for Abbreviated EFH Consultations, and as a means to provide information on potential effects to other NOAA trust resources considered under the FWCA. An abbreviated consultation allows us to determine quickly whether, and to what degree, a federal action may adversely affect EFH.Abbreviated consultation procedures can be used when federal actions do not have the potential to cause substantial adverse effects on EFH and when adverse effects could be alleviated through minor modifications. The intent of the EFH worksheet is to provide a guide for determining the information needed to fully assess the effects of a proposed action on EFH. In addition, the worksheet may be used as a tool to assist you in developing a more comprehensive EFH assessment for larger projects that may have more substantial adverse effects to EFH.However, for large, complex projects that have the potential for significant adverse effects, an Expanded EFH Consultation may be warranted and the use of this worksheet alone is not appropriate as your EFH assessment. An adverse effect is any impact that reduces the quality and/or quantity of EFH. Adverse effects may include direct or indirect physical, chemical, or biological alterations of the waters or substrate and loss of, or injury to, benthic organisms, prey species and their habitat, and other ecosystem components. Adverse effects to EFH may result from actions occurring within EFH or outside of EFH and may include site-specific or habitat-wide impacts, including individual, cumulative, or synergistic, consequences of actions. i Consultation under the MSA is not required if there is no adverse effect on EFH or if no EFH has been designated in the project area. However, because the definition of"adverse effect" is very broad, most in-water work will result in some level of adverse effect requiring consultation with us, even if the impact is temporary or the overall result of the project is habitat restoration or enhancement. It is important to remember that an adverse effect determination is a trigger to consult with us. It does not mean that a project cannot proceed as proposed, or that project modifications are necessary. An adverse effect determination under the EFH provisions of the MSA simply means that the effects of the proposed action on EFH must be evaluated to determine if there are ways to avoid, minimize, or offset adverse effects. Additional details on EFH consultations, tools, and resources, including frequently asked questions can be found on our website. Instructions This worksheet should be used as your EFH assessment for Abbreviated EFH Consultations or as a guide to develop your EFH assessment. It is not appropriate to use this worksheet as your EFH assessment for large, complex projects, or those requiring an Expanded EFH Consultation. When completed fully and with sufficient information to clearly describe the activities proposed, habitats affected, and project impacts, as well as the measures taken to avoid, minimize or offset any unavoidable adverse effects, this worksheet provides us with required components of an EFH assessment including: 1. A description of the proposed action. 2. An analysis of the potential adverse effects on EFH and the federally managed species. 3. The federal agency's conclusions regarding the effects of the action on EFH. 4. Proposed mitigation, if applicable. When completing this worksheet and submitting information to us, it is important to ensure that sufficient information is provided to clearly describe the proposed project and the activities proposed. At a minimum, this should include the public notice(if applicable) or project application and project plans showing: • location map of the project site with area of impact. • existing and proposed conditions. • all in-water work and the location of all proposed structures and/or fill. • all waters of the U.S. on the project site with mean low water(MI.,W), mean high water (MEW), high tide line(HTL), and water depths clearly marked. • Habitat Areas of Particular Concern(HAPCs). • sensitive habitats mapped, including special aquatic sites(submerged aquatic vegetation, saltmarsh, mudflats, riffles and pools, coral reefs, and sanctuaries and refuges), hard bottom or natural rocky habitat areas, and shellfish beds. • site photographs, if available. Your analysis of effects should focus on impacts that reduce the quality and/or quantity of the habitat or result in conversion to a different habitat type for all life stages of species with designated EFH within the action area. Simply stating that fish will move away or that the project ii will only affect a small percentage of the overall population is not a sufficient analysis of the effects of an action on EFH.Also, since the intent of the EFH consultation is to evaluate the direct, indirect, individual and cumulative effects of a particular federal action on EFH and to identify options to avoid, minimize or offset the adverse effects of that action, is it not appropriate to conclude that an impact is minimal just because the area affected is a small percentage of the total area of EFH designated. The focus of the, consultation is to reduce impacts resulting from the activities evaluated in the assessment. Similarly, a large area of distribution or range of the fish species is also not appropriate rationale for concluding the impacts of a particular project are minimal. Use the information on the our EFH consultation website and NOAA's EFH Mapper to complete this worksheet. The mapper is a useful tool for viewing the spatial distribution of designated EFH and HAPCs. Because summer flounder HAPC (defined as: " all native species of macroalgae, seagrasses, and freshwater and tidal macrophytes in any size bed, as well as loose aggregations, within adult and juvenile summer flounder EFH")does not have region-wide mapping, local sources and on-site surveys may be needed to identify submerged aquatic vegetation beds within the project area. The full designations for each species may be viewed as PDF links provided for each species within the Mapper, or via our website links to the New England Fishery Management Councils Omnibus Habitat Amendment 2 (Omnibus EFH Amendment),the Mid-Atlantic Fishery Management Councils FMPs (MAMFC -Fish Habitat),or the Highly Migratory Species website.Additional information on species specific life histories can be found in the EFH source documents accessible through the Habitat and Ecosystem Services Division website. This information can be useful in evaluating the effects of a proposed action.Habitat and Ecosystem Services Division(HESD)staff have also developed a technical memorandum Impacts to Marine Fisheries Habitat from Non-fishing Activities in the Northeastern United States, NOAA Technical Memorandum NMFS-NE-209 to assist in evaluating the effects of non-fishing activities on EFH. If you have questions, please contact the HESD staff member in your area to assist you. Federal agencies or their non-federal designated lead agency should email the completed worksheet and necessary attachments to the HESD New England(ME,NH, MA, CT, RI) or Mid-Atlantic (NY, NJ, PA,DE, MD,VA)Branch Chief and the regional biologist listed on the Contact Regional Office Staff section on our EFH consultation website and listed below. We will provide our EFH conservation recommendations under the MSA,and recommendations under the FWCA, as appropriate, within 30 days of receipt of a complete EFH assessment for an abbreviated consultation. Please ensure that the EFH worksheet is completed in full and includes detail to minimize delays in completing the consultation. If we are unable to assess potential impacts based on the information provided,we may request additional information necessary to assess the effects of the proposed action on our trust resources before we can begin a consultation. If the worksheet is not completely filled out, it may be returned to you for completion. The EFH consultation and our response clock does not begin until we have sufficient information upon which to consult. If this worksheet is not used, you should include all the information required to complete this worksheet in your EFH assessment. The level of detail that you provide should be commensurate with the magnitude of impacts associated with the proposed project. You may need to prepare a more detailed EFH assessment for more substantial or complex projects to fully characterize the effects of the project and the avoidance and minimization of impacts to EFH. The format of the EFH worksheet may not be sufficient to incorporate the extent of detail required for large-scale projects, and a separate EFH assessment may be required. iii i "06 Regardless of the format, you should include an analysis as outlined in this worksheet for an expanded EFH assessment, along with any additional necessary information including: • the results of on-site inspections to evaluate habitat and site-specific effects. • the views of recognized experts on habitat or the species that may be affected. • a review of pertinent literature and related information. • an analysis of alternatives that could avoid or minimize adverse effects on EFH. For these larger scale projects, interagency coordination meetings should be scheduled to discuss the contents of the EFH consultation and the site-specific information that may be needed in order to initiate the consultation. Please contact our Greater Atlantic Regional Fisheries Office,Protected Resources Division regarding potential impacts to marine mammals or threatened and endangered species and the appropriate consultation procedures. Effects of Climate Change Effects of climate change should be included in the EFH assessment if the effects of climate change may amplify or exacerbate the adverse effects of the proposed action on EFH.Use the Intergovernmental Panel on Climate Change (IPCC)Representative Concentration Pathways(RCP) 8.5/high greenhouse gas emission scenario(IPCC 2014), at a minimum, to evaluate the future effects of climate change on the proposed projections. For sea level rise effects, use the intermediate-high and extreme scenario projections as defined in Sweet et al. (201.7).For more information on climate change effects to species and habitats relative to NMFS trust resources, see Guidance for Integrating Climate Change Information in Greater Atlantic Region Habitat Conservation Division Consultation Processes. 1. Could species or habitats be adversely affected by the proposed action due to projected changes in the climate? If es, please describe how: No 2. Is the expected lifespan of the action greater than 10 ears?If yes, please describe project lifespan: The proposed dock structures should have a 20 to 30 year structural lifespan based on long term observed performance of CCA tested timber. 3. Is climate change currently affecting vulnerable species or habitats, and would the effects of a proposed action be am lifted by climate change? If yes, please describe how: Climate change impacts on fish are unknown with relation to the project and this site. The dock siting has avoided sensitive plant species. 4.Do the results of the assessment indicate the effects of the action on habitats and species will be amplified by climate change? If yes, please describe how: Unknown but doubtful. 5. Can adaptive management strategies(AMS)be integrated into the action to avoid or minimize adverse effects of the 13rovosed action as a result of climate? If yes, please describe how: No 8 i I I 10. Federal Agency Determination Federal Action Agency's EFH determination (select one) ❑ There is no adverse effect on EFH or EFH is not designated at the project site. EFH Consultation is not required. This is a FWCA only request. The adverse effect on EFH is not substantial. This means that the adverse effects are no more than minimal, temporary, or can be alleviated with minor project modifications or ❑ conservation recommendations. This is a request for an abbreviated EFH consultation. The adverse effect on EFH is substantial. This is a request for an expanded EFH consultation. We will provide more detailed information, including an alternatives analysis and NEPA documents, if applicable. 7 An adverse effect is any impact that reduces the quality and/or quantity of EFH.Adverse effects may include direct or indirect physical, chemical,or biological alterations of the waters or substrate and loss of,or injury to,benthic organisms, prey species and their habitat, and other ecosystem components.Adverse effects to EFH may result from actions occurring within EFH or outside of EFH and may include site-specific or habitat-wide impacts, including individual, cumulative,or synergistic consequences of actions. 11. Fish and Wildlife Coordination Act Under the FWCA, federal agencies are required to consult with us if actions that the authorize, fund, or undertake will result in modifications to a natural stream or body of water. Federal agencies are required to consider the effects these modifications may have on fish and wildlife resources, as well as provide for the improvement of those resources.Under this authority,we consider the effects of actions on NOAA-trust resources, such as anadromous fish, shellfish, crustaceans, or their habitats, that are not managed under a federal fisheries management plan. Some examples of other NOAA-trust resources are listed below. Some of these species, including diadromous fishes, serve as prey for a number of federally-managed species and are therefore considered a component of EFH pursuant to the MSA. We will be considering the effects of your project on these species and their habitats as part of the EFH/FWCA consultation process and may make recommendations to avoid, minimize or offset and adverse effects concurrently with our EFH conservation recommendations. FINAN PROPERTY DOCK RECONSTRUCTION/MODIFICATION WEST HARBOR/FISHER'S ISLAND SOUND FISHER'S ISLAND, NEW YORK NARRATIVE STATEMENT & SUPPLEMENTAL INFORMATION March 2022 GENERAL The Finans own parcel 1000-010-7-14 off Hedge Street located along the south shore of West Harbor on Fisher's Island. The site is generally a modified bluff with a seawall containing and retaining the sloped sandy gravel soils, vegetated with grass, brush, landscaping ground cover and trees. The frontage off the property is approximately 54 feet along West Harbor, abutted by the property to the east and to the west. The waterfront consists of a partially rock- covered beach with sparse, sporadic, individual tidal wetland plants at the base of the seawall in the vicinity of the longstanding and previously authorized wood pile and timber pier. It is the Finan's desire to reconstruct the existing longstanding fixed pier dock system using driven wood piles. The pier will have an end elevation of 6 feet above Mean Low Water (MLW), except for the lower north end boarding platform, with the main pier to shore sloping upward to an elevation of 8 feet above Mean Low Water and crossing over the boulder-strewn intertidal zone above the bottom sediments then level to shore terminating on the seawall with a level section of about 10 feet in length at the shore end. This increase in pier elevation wall allows the passage of the public on the rocky beach below, a rare event. Attached are application drawings prepared for this project showing this configuration and pertinent details. The project description is as follows: Reconstruct 114±LF of pile supported pier of which 97±LF is 5-ft wide and 17±LF is 8-ft wide, including new rails, cross bracing and water and electric utilities and a davit. Relocate an 8-ft x 20±LF float and restraint piles lfft southeast construct a new 6-ft wide x 7±LF pile supported ramp landing with rails and install a new hinged float access ramp, install 4-ft wide pile supported beach access stairs with rails and grate treads. Waterward of the apparent high water line. This supplemental narrative has been prepared in accordance with the requirements of Town of Southold, Ordinance No. 6, 2004, as well as the Local Waterfront Redevelopment Plan related to docks and shorefront improvements. In addition, various coastal policies under the New York State Coastal Management Act are addressed herein for review by the New York State Department of State Section 661 of the NYS DEC Regulation pertaining to work in or adjacent to Tidal Wetlands is also addressed in this narrative. 1 IPRW DESCRIPTION OF WORK As mentioned in the introductory paragraph, this project is to reconstruct the existing fixed wood pile and timber pier and create a new ramp and landing with a new hinged ramp to the existing float as depicted in the attached application drawings and described in the application documents. All work will be done in accordance with existing guidelines set forth in the Town of Southold ordinance No. 6, 2004. This is a continuance of a longstanding existing authorized structure (previous owner Barbara Hoch)which is an accessory to the residential use of the property and the use of the structure for recreational boating access is lawful and in compliance with the Coastal Zone Management Act of the State. It is envisioned that this pier reconstruction will be conducted utilizing the following general construction methodology, sequence and material standards addressing Section 275-11 of Southold Law 6. • The marine contractor will arrive by barge with a deck-mounted crane and push boat and at least one work boat. The existing pier facilities will be disassembled, piles extracted and then rebuilt as a new structure with the debris removed from the site and disposed of in accordance with applicable laws, codes, and ordinances. • New piles will be driven at approximately 10-foot intervals as necessary and it appears that all should be replaced. These piles will be driven by double-acting air hammer to a bearing resistance of approximately 30 tons. This generally results in about 12 to 15 feet of embedment of the pile in the bearing stratum. Pier support piles must be Class B, pressure treated Southern Yellow Pine or Geenheart, 12-inch nominal diameter measured 3 feet from the butt. These piles will be flush with the deck or extend above the deck to support a new rail. The stand-alone tie-off piles will also be 12-inch Class B pressure treated Southern Yellow Pine or Greenheart. • After the replacement piles are installed, new split caps consisting of pressure treated Southern Pine timbers ranging from 3 x 10 to 4 x 12 nominal dimension, will be bolted to the piles transversely.New stringers will be then laid on the split caps parallel to the length of the pier. In all likelihood, stringers will be 3 x 10 pressure-treated Southern Pine. Framing elevations will be set to support the decking at the elevation above MLW as shown in the drawings. • The outer stringer on each side will be bolted or spiked, at any rate attached to the pile to secure the deck against uplift forces that this pier might be exposed to. Stair stringers will be attached to the deck framing. • After the stringers have been connected to the piles and split caps, the decking will be replaced. In accordance with Town of Southold's Ordinance No. 6, 2004, new decking will not be pressure-treated Southern Yellow Pine, but rather oak, fir, cedar, etc. or some type of composite material with the textured side mounted up. The synthetic decking can be either gray, brown or natural in color. Decking, will in any case, be attached to the stringers utilizing stainless steel flathead square-drive wood screws about 3 inches long and will be set with a 1/8"to 1/4" gap between members. In all likelihood, the decking will be wood landward of the eelgrass. 2 w s • The alignment of the pier will match the existing structure throughout its length running over the non-vegetated bottom sediments that currently exist in the intertidal zone. The new stair to the shore will parallel the wall. • The new piles or new rail posts will extend to 42 inches above the deck surface and have horizontal rail members mounted to them to support vertical balusters at the owner's option, with 3 3/4" inch clear between balusters. A horizontal handrail will be installed on the top of the rail system. Cable rails may be an option. • Electrical service will run out on the pier in the space between the stringers so that trickle chargers on the boat(s) may be powered during tie-ups. Power may be solar. In addition, the water will be installed to allow boats to be rinsed off after usage. A power post or box with an internal light will be mounted to the end of the pier with receptacles to provide power to the boats from extension cords. The power post will also have a coiling arm for storage of the hose between uses. Because the dock may be used during the hours of darkness, low-intensity lights will be mounted on staggered piles or dock rail posts to illuminate the walking surface. This system will be manually, and/or radio controlled so that the lights will only be on when necessary for safety of the users. REQUIREMENTS OF SECTION 97-25 OF THE WETLANDS LAW The permittee acknowledges that the validity of this permit is subject to the approval of other governmental or municipal authorities. The permittee does, by the acceptance of this permit, assume all responsibility for operations undertaken pursuant to this permit, and shall take all precautions for the prevention of injuries to persons and property resulting from such operations. The permittee will notify the Town in writing one week prior to initiation of any and all operations. The permittee will notify the Trustees in writing upon completion of operations such that the site can be inspected for issuance for a certificate of completion. The permittee will notify the Trustees in writing upon completion of operations such that the site can be inspected for issuance for a certificate of compliance. In response to Sub-section 2a and the General Rules for Standards of Residential and Commercial Docks, Section 279-11, the following additional information is offered. 1. Permits for the work are being applied for through the Town, U.S. ACOE,NYS DEC and a coastal zone consistency determination by the NYS DOS. 3 2. The new piles to be installed will be of sturdy, durable and stable materials; in all likelihood, CCA pressure-treated Class B Southern Yellow Pine or Greenheart piles with new framing of the same materials. These members will be a minimum of 3 x 8's and 3 x 10's with two 3/4"bolt per connection. The pier does not present any adverse modification of the shoreline and the elevation is such that in high flood tides the pier head structure will be inundated. The structure's SYP timber materials represent the standard of the industry being specifically grown for this type of usage and are capable of withstanding full immersion. With the connections described above, this structure will be able to survive repeated inundations and even direct waves at high tide elevations with a structural life of approximately 20 years. 3. It is respectfully requested that the use of CCA pressure-treated piles and timbers be approved for this project, except for the decking. 4. The rebuilt pier will not be decked with CCA pressure-treated Southern Pine. This pier/walkway provides a safe walking surface for access to the berthed boat(s). 5. The 15-foot property line clearance specified in this paragraph can be met. The existing facilities are being rebuilt"in place" and they are clear of structures on adjacent properties. 6. Upon receipt of the permit for this project, appropriate permit numbers will be affixed to the most seaward face of the pier for identification from the water. 7. There are no permanent structures located above the pier decking, nor are any planned at this time, other than the power post and railing. 8. The existing pier is built right to shore. There is little room to walk under the existing pier at low tide, however, the new pier will provide 5 feet of clearance between the inter-tidal shoreline sediments and the deck stringers. Foot traffic is not and will not be impeded in this area because of the pier's profile at the shore allowing a beach walker to traverse the beach, below the existing pier. Pedestrian access is non-existent because of the isolated shorefront characteristics of this and adjacent properties. 9. The shoreline stone forms a risky, almost impassible transition from the shallow subtidal sediments to the upland. The adjacent properties along this part of West Harbor are privately owned, similarly configured, and so there is little usable public access, but, nonetheless provided for. TOWN OF SOUTHOLD LOCAL WATERFRONT REVITALIZATION PROGRAM This site is subject to the Town of Southold's LWRP and is consistent with each as follows: (a)Policy 1: Foster the area pattern of development 4 The dock at this site has existed for more than 30 years. The purpose of this project is to reconstruct the wood pile and timber structure in the exact footprint of the historic facility. There are some minor modifications to the structure, primarily raising the deck height to a uniform elevation above the elevation of mean low water, in order to restore public access to Public Trust Lands of the State and Town but also in deference to current design standards for promoting growth of the eelgrass if other site characteristics are or become favorable. This project preserves open space and makes beneficial use of a coastal location while not changing any development impacts. (b) Policy 2: Preserve historic resources There are no known historic resources at this site, and in view of the size and shape of the parcel, as well as proximity to the road, it is unlikely that the parcel or this particular site would have any significant occupancy or usage history. (c) Policy 3: Visual quality to be maintained The proposed dock reconstruction process will create a neat and trim structure complete with appointments, including rails of the"see-through" stainless-steel cable type, which will add to the attractiveness of the structure while still providing a safe, operable walk way. The new pier will be slightly more visible because of its increased elevation, dictated by standards and criteria of the NOAA National Marine Fisheries Service operating under the purview of the US Army Corps of Engineers. This project consistent with the visual quality requirements of Policy No. 3. (d) Policy 4: Minimize Damage from flood and erosion The proposed dock will be built to customary tough standards required for open exposures such as this in West Harbor. This will include use of 12-inch Class B Southern Yellow Pine Piles or Greenheart piles, driven to a tip depth of 10 to 15 feet into the bearing strata. The timber components will be, likewise, heavy duty pressure-treated southern pine pieces fastened to the piles with double 3/4-inch galvanized steel bolts. These standards have been developed over the years as being suitable for the exposures on the north shore of Fishers Island. This project is consistent with Policy 4. (e) Policy 5: Preserve local water supplies This policy is aimed at preserving a fresh water supply in the Town of Southold. The proposed dock construction is located within marine waters of West Harbor and is not within the hydraulic profile of any known freshwater draw points of existing wells on local properties. In addition, reference is made to the study conducted by the NYS DEC 20 years ago (2000) which stated that pressure-treated piles and lumber were an acceptable, and most suitable construction material for these nearshore marine waters. Water quality of the Town of Southold will not be depleted or adversely affected chemically by construction of this dock facility using pressure-treated Southern Yellow Pine piles and timbers. 5 WW (f) Policy 6: Protect and Restore Town ecosystem The waters around Fishers Island, including West Harbor, are recognized as being significant part of the Town's ecosystem primarily in their ability to support localized, and in some cases vast, elongated meadows of eelgrass. This site approaches but does not touch upon a part of the West Harbor eelgrass ecosystem. The fact that the dock has existed for three decades and has accommodated boating usage during that lifespan, and the fact that no eelgrass growth has been documented beneath and around the dock is significant, it is a clear indication that a natural balance has been struck with this facility at this site. The proposed replacement dock structure will comply with current NOAA NMFS design standards in that the pier walkway elevation will be raised. Otherwise, the dock facility is an open wood timber pile pier which clearly allows for unencumbered water flow and circulation, consistent with preservation policies for maintaining the ecosystem. Its north-south orientation allows for sunlight to reach the water column and shallow subtidal sediments from the east in the morning and west in the afternoon, shoreline tree shading notwithstanding. (g) Policy 7 Protection of Air Quality This project will not adversely affect or impact air quality for the Town of Southold. (h) Policy 8 Solid waste issues This project will not impose any type of environmental degradation related to solid waste or hazardous substances and waste products. All residual and scrap lumber from the pier construction project will be properly disposed of in accordance with laws and regulations of the States of New York and Connecticut. (2) Public Coast Policies (A) Policy 9: Public Access This project not only provides for public access along public trust lands of the State and Town but improves such access over the conditions which have existed at the site for the last several decades. The public will still be able to boat around this facility as well as walk beneath the pier, without encumbrance, on the existing rocky beach. Public access will be improved along this stretch of beach front in West Harbor because of these dock reconstruction design standards. (3) Working Coast Policies This site is not located along a stretch of shorefront designated as, or to be in the future, a working coast, although it is a heavily developed, modified bluff parcel. The following is a summary of critical factors for approval by the Trustees: • Navigation: the proposed dock facility reconstruction meets standards and does not extend beyond the existing pier or beyond 1/3 of the width of West Harbor and the 6 entrance to Pirate's Cove, the water body. The depths for the dock terminus are within Town Trustees,New York State Department of Environmental Conservation and United States Army Corps of Engineers guidelines and there is not recognized Federal/New York State/Town navigation channel in the immediate vicinity of the proposed structure. • Scope: The proposed dock is comparable to docks on neighboring properties in an area where docks historically have been are used for commercial and recreational purposes. • Scope in relation to the riparian rights of shell fishers: The plan allows a standard fixed pier design adequately elevated so that it will not impede access for those seeking shellfish and crustacea in season. • Scope in relation to viewshed: The seaward end of the proposed dock will not extend beyond adjacent existing dock. As such, the perspective will not be discernibly different from the existing view. The stairs and ramp landings are well inboard from the pier head. • Environmental preservation: The dock project design raises the deck profile at the land end has a typical useful lifespan of 30 years with limited pile replacement so as to minimize disturbance of the bottom. • The original dock at this site appears to have preexisted at the adoption of the current Town regulations regarding dock configuration, size and materials. • The mailing address of adjacent property owners, which are shown on sheet 1 of the drawings. US ARMY PERMITTING This project is covered under Nationwide Permit#3 of the U.S. Army Corps of Engineers being a reconstruction of an existing, longstanding dock facility in its current location and footprint with no further encroachment into public trust waters of the State. Raising the main landing walkway is consistent with NMFS policies established in 2016 and listed below. Concerns of the Fishers Island Seagrass Management Committee are also covered below, however, there is no eelgrass at this site or in the channel where construction barge access comes from. • The elevation/cross section drawing must clearly show the height of the proposed structure above the plane of mean high water and wetland grade, as measured from the bottom of the stringers, for the full length of the structure and they do. The National Marine Fisheries Service requires a minimum height of 4.5 above Mean High Water feet in order to avoid adverse effects to Essential Fish Habitat and that clearance is provided for deck framing yielding a dock elevation of 8 feet and that is the deck elevation specified except at the pier head for boarding access. • The total number, type and diameter of piles to be installed, the installation method, and the time of year the piles would be installed. There will be approximately 40 piles 7 installed, all Class B pressure treated Southern Yellow Pine or Greenheart, 12-inch diameter, pneumatically driven piles in early fall. • The staging area to be used for work vessels will be alongside the pier. The frequency and timing of transit over the eelgrass beds will be once a day and will be conducted at high tides. The NMFS requires work vessels to be moored outside of eelgrass beds and access to and from the work site will occur only during high tide but in this case there are no eelgrass beds or growth areas alongside the pier so the criteria is met. NYS DEC TIDAL WETLANDS REGULATIONS—SECTIONS 661.5 AND 661.9 This project represents the reconstruction of existing dock facility at the southerly quadrant of West Harbor. The dock facilities to be rebuilt include a pier and new hinged ramp landing over the intertidal zone. There are no areas of tidal wetlands fringe vegetation. Piers for recreational boating at residential properties on the waterfront are considered to be generally compatible use in an adjacent area(AA)with a permit being required under Section 661.5 (b) (1), 15 and 24. This pier, landing and floating dock facility was repaired in the 1990's. Routine maintenance and replacement of lost or storm damaged decking has been on an"as needed" basis. Under Section 661.9, the standards for issuance of permits of NYS DEC regulations and Section 275-9 of the Town of Southold Local Law No. 6,the following are considered to be pertinent considerations. • The policies are created to preserve and protect tidal wetlands and prevent their despoliation and destruction. Regulated activities will not have an undo or significant adverse impact on the present or potential value of the affected tidal wetlands. It should be noted that this project is the reconstruction of a long-standing dock facility. No tidal wetlands exist in the foot print of the pier along the edge of the shoreline with rocky bottom sediments in the intertidal zone. Certain restrictive characteristics of the existing facility will be improved by this project, primarily the height of the pier which will allow more sunlight to reach the water column to allow tidal wetlands vegetation and SAV to grow if other conditions are suitable. This pier reconstruction project is compatible with public health and welfare policies of the State. • The project complies with development restrictions contained in Section 661.6 as this work is routine maintenance repair and re-construction of an existing long-standing dock facility and the structure is compatible with zoning and the long-standing use of the site. • This project will not have an undo or adverse impact on the present or potential ecological value of nearby tidal wetlands vegetation. 8 617.26 Appendix B Short Environmental Assessment Form Instructions for Completing Part I-Project Information.
