TERMS and CONDITIONS

part of the consideration for the issuance of the Permit does understand and prescribe to the fol-
lowing:
1. That the said Board of Trustees and the Town of Southold are released from any and
all damages, or clalm~ for damages, of suits ar/sing directly or indirectly as a result of any oper-
ation performed pursuant to lifts permit, and {he said Petml~tee will, at his or her own expense,
defend any and al/ such suits initiated by third parties, and the said Permittee assumes full liability
with respect thereto, ~to the complete exclusion of the Board of Trustees of the Town of. Southold

ia the location of the work herein authorized, or if, in the opinion of the Board of Trustees, the
work shall cause unreasonable obstmcnon to free navigation, the said Permittee will be requited,
upon due notice, to remove or alter this work or project herein stated without expemes to the Town

Dear Mr. Bowman:
The following action was taken by the Board of Town Trustees during
its regular meeting held on March 22 1990 regarding the above
matter: '
WHEREAS, Land Use Company IN BEHALF OF Frank Vermaelen, Jr. applied
to the Southold Town Trustees for a permit under the provisions of
the Wetland Ordinance of the Town of $outhold application dated
January 29, 1990 and, '
WHEREAS said application was referred to the Southold Town
Conservation Advisory Council for their findings and recommendations
and, ,
WHEREAS, a public hearing was held by the Town Trustees with respect
to said application on March 22, 1990 at which time all interested
persons were given an opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar
with the premises in question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation
submitted concerning this application, and,
WHEREAS, the Board has determined that the project as proposed will
not affect the health, safety and general welfare of the people of
the town,
NOW, THEREFORE BE IT
RESOLVED THAT Land Use Company IN BEHALF OF Frank Vermaelen, Jr.
BE AND HEREBY IS GRANTED PERMISSION UNDER THE WETLAND ORDINANCE TO:
To construct a single family dwelling and sanitary system on a 40,000
s.f.lot. Dwelling to be located 125' landward of tidal wetland;
sanitary system to be set back 212' from said line. Approximately
200 c.y. of fill will be placed within building area and stabilized
with vegetation cover. Approximately 100 yards of fill will be
necessary to construct pervious driveway. Additionally, a 50'
buffer will be maintained.
The following conditions must also be met: Marsh creation 1000 s.f.,
which will include indigenous wetland species; Haybales as per
survey; two (2) 18" culverts of PVC of concrete under driveway; a
new plan showing the created marsh and 50' buffer landward of the
created marsh.
This permit will expire two years from the date it is signed if work
has not commenced by said date. Fees must be paid, if applicable,
and permit issued within six months of the date of this
notification. Two inspections are required and the Trustees are to
be notified upon completion of said project.
Please return to the Building Department for a determination on the
need for any other permits which may be required~for this project.
An additional inspection will be necessary upon completion of the
wetlands creation. At that time a $35.00 inspection fee will be
required.

Wetland Application No. 1-15-90-144-3-40.2 submitted by the Land Use Company
on behalf of;~!E;.~a~i~._:M.e~ma~len; j.~, to construct a single family dwelling and sanitary
system on a 40,000 s.f. lot located on the west side of Bay Avenue. Dwelling
to be located 125' landward of the tidal wetland boundary while sanitary system
will be set back 212' from said line. House construction will require approx.
200 c.y. of fill to be placed within building area and stabilized with vegetation
cover. It will be necessary for access to cross a narrow area of formerly connected
tidal wetlands, approx. 110 s.f. of wetland area will be impacted by the placement
of 100 c.y. of fill necessary to construct a pervious driveway.
The CAC suggests the applicant goes to the ZBA for the driveway on the south
sid.e of lot. By doing so, the driveway can function without destroying the wetlands.

Wade has been withdrawn according to Southold Town Trustee President Jay
Bredemeyer. ,
RESOLVED to recommend to the Southold Town Trustees APPROVAL WITH STIPULATIONS
Wetland Application No. 1-12-90-76-3-24 submitted by Wayne Monson to construct
a single, private, dock, ramp and platform adjacent to existing bulkhead and
dredge 80 c.y.
The CAC approves with the stipulation that the construction does not impede
future dock, floats, etc for any neighbors directly across the creek nor impede
navigation in the creek.

Application No. 1-14-90-117-5-46 of Larry Tuthill was tabled to await further

RESOLVED to recommend to the Southold Town Trustees APPROVAL WITH STIPULATION
of Wetland Application No 1-17-90-139-2-33 submitted by J. H. Geideman for
Leander Glover to construct a 25' x 4' dock, a 3' x 10' ramp and tow 6' x 20'
floats. The CAC approves provided the catwalk is elevated the standard 4' above
grade of marsh.

PROJECT DESCRIPTION
Applicant proposes to construct a single family dwelling and
sanitary system on a 40,000 s.f. lot located on the west side of
Bay Avenue. Dwelling will be located 125' landward of the tidal
wetland boundary while'sanitary system will be set back 212' from
said line. House construction will require approximately 200
c.yds, of fill to be placed within building area and stabilized
with vegetation cover. It is necessary for access to cross a
narrow area of formerly connected tidal wetlands. Approximately
1000 s.f. of wetland area will be impacted by the placement of
100 c.yds, of fill necessary to construct a pervious driveway.
Please note that an 8" culvert pipe will be placed beneath
driveway to ensure continued functioning of adjacent wetland
area. Additionally, a 50' undisturbed vegetative buffer will be
maintained along "the entire wetland edge. If required by Town
Trustees, applicant is willing to recreate 1000 s.f. of
additional wetland area within lot boundaries.

Appendix A SEQR
State Environmental Quality Review
FULL ENVIRONMENTAL ASSESSMENT FORM
Purpose: The full EAF is designed to help applicants and agencies determine, in an orderJy manner. Whether a project
or action may be significant. The question of whether an action may be significant is not always easy to answer. Frequent-
ly, there are aspects of a proiect that are subjective or unmeasureable. It is also understood that those who determine
significance may have little or no formal knowledge of the environment or may be technically e.xpert in environmental
analysis. In addition, many who have knowledge in one particular area may not be aware of the broader concerns affecting
the question of significance.
The full EAF is intended to provide a method whereby applicants and agencies can be assured that the determination
process has been orderly, comprehensive in nature, yet flexible to allow introduction of information to fit a project or action.
Full EAF Components: The full EAF is comprised of three parts:
Part 1: Provides obiective data and information about a given project and its site. By identifying basic project
data, it assists a reviewer in the analysis that takes place in Parts 2 an~[ 3.
Part 2: Focuses on identifying the range of possible impacts that may occur from a project or action. It provides
guidance as to whether an impact is likely to be considered small to moderate or whether it is a potentially-
large impact. The form also identifies whether an impact can be mitigated or reduced.
Part 3: If any impact in Part 2 is identified as potentially-large, then Part 3 is used to evaluate whether or not the
impact is actually important.

10 That if future operations by the State of New York require an al-
teration in the position of the structure or work herein authorized, or
if, in'the opinion of the Department of Environmental Conservation
it shall cause unreasonable obstruction to the free navigation of said
waters or flood flows or endanger the health, safety or welfare of
the people of the State, or cause loss or destruction of the natural
resources of the State, the owner may be ordered by the Department to
remove or alter the structural work, obstructions, or hazards caused 15.
thereby without expense to the State, and if, upon the expiration or
revocation of this permit, the structure, fill, excavation, or other ~6.
modification of the watercourse hereby authorized shall not be com-
pleted, the owners, shall, without expense to the State, and to such

13. All necessary precautions shall be taken to preclude contamination
of any wetland or waterway by su~ended solids, sediments, fuels,

other environmentally deleterious materials associated with the
project.
Any material dredged in the prosecution of.the work herein permi£~e~i
shall be removed evenly, without leaving large refuse piles, ridges across
the bed of a waterway or floodplain or deep holes that may have a
tendency to cause damage to navigable channels or to the banks o~
a waterway.
There shall be no unreasonable interference with navigation by the work
herein authorized.
If upon the expiration or revocation of this permit, the proiect hereby
authorized has not been completed, the applicant shall, ~,i~hout expense
to the State, and to such extent and in such time and manner as The
Department of Environmental Conservation may require, remove all or
any portion of the uncompleted structure or fill and restore the site
to its former condition. No claim shall be made against the State of
New York on account of any such removal or alteration.
If. granted under Article 36, this permit does not signify m any way
that the project will be free from flooding.
If granted under 6 NYCRR Part 608, the NYS Department of Environ-
mental Conservation hereby certifies that the subject project will not

SPECIAL CONDITIONS
Ail fill for driveway must be clean sand from an upland source. Upon completion of
the driveway, all slopes must be stabilized with natural vegetation.
Prior to the start of construction of the driveway, a row of staked haybales and
snow fencemust be placed on each side of the area to be disturbed along the entire
length of the driveway. This barrier to erosion and disturbance must be
maintained until construction is comPlete and all disturbed areas have been
stabilized.
All culverts must be isntalled at an elevation suff{cient to maintain the
hydrological connection between the two wetland areas.
A 50 foot wide buffer of'undisturbed natural vegetation must be maintained between
the wetland ana the dwelling as shown on the approved plan. The only permitted
activities in this area are the proposed driveway and wetland creation.
Prior to the start of the wetland creation, a row of staked haybales and snow fence
must be installed between the existing wetland and the wetland to be created. This
barrier to disturbance and erosion must be maintained until new plantings have
grown adequately to stabilize soil. No disturbance of existing tidal wetland shall
occur while new area ~s being created.
Ail excavated material from tRe created wetland area must be removed to an upland
site located a minimum of 50 linear feet from the tidal wetland.
Creation of the new tidal wetland area must be completed within one year of the
start of driveway construction.
Plantings in the newly created tidal wetland must be maintained for a minimum of
2 years and an 80% survival rate.
