,SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property
under consideration in this application and determines that this review falls under the
Type II category of the State's List of Actions, without further steps under SEQRA.
SUEFOLK QOUNTY ADMINISTRATIVE C DE: This application was referred as
required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the
Suffolk County Department of Planning issued a reply dated March 11, 2008 stating
that this application is considered a matter for local determination as there appears to
be no significant countywide or inter-community impact.
LWRP DE RMINAT ON: It is noted that the Town Trustees on December 12, 2007
issued Determination of Consistency as noted under Amended Permit #6391 dated
December 12, 2007. This determination also furthers Policy 6 of the Local Waterfront
Revitalization Program, in that a drywell shall be installed to provide for pool backwash
and a line of staked hay bales shall be in place during all construction activities.
PROPER FACTS SCRIPTIO� The applicants' property consists of 40,153
square feet to a tie line along the mean high water, dimensions of 200 feet along Calves
Neck Road and 195.06 feet along the easterly side lot line. The property is improved
with a two-story, single-family dwelling.
BASIS OF APPL ATION: Request for a Variance under Section 280-15, based on the
Building Inspector's January 22, 2008 Notice of Disapproval concerning the proposed
location of a swimming pool at the side of deck with hot tub addition and partly in the
code-permitted rear yard.

ADDITIONAL INFO, II TI The Building Inspector issued a permit for the deck
and hot tub addition on 10/19/06 (B.P. #32439).
FINDINGS OF FACT
The Zoning Board of Appeals held a public hearing on this application on March 27,
2008 at which time written and oral evidence were presented. Based upon all
testimony, documentation, personal inspection of the property, and other evidence, the
Zoning Board finds the following facts to be true and relevant:
AREA A IAN ", RELIEF R: DFSTF : The relief that is being requested concerns
a proposed 18' x 36' in-ground accessory swimming pool, partly located in a side yard
next to a new deck addition, instead of entirely to the rear of the entire principal
dwelling construction. The pool is proposed near center between property lines shown
on the October 12, 2007 site survey prepared by Peconic Surveyors, P.C.
REASONS, FOR BOARD CTI : On the basis of testimony presented, materials
submitted and personal inspections, the Board makes the following findings:
1. Town Law 267-b 3 b . Grant of the variance will not produce an undesirable
change in the character of the neighborhood or a detriment to nearby properties.
because the in-ground pool, although along the side of the deck addition, will also be at
the rear of the house, which does not create any visual disturbance within the
neighborhood.
2. Town Law 67• b 2 The benefit sought by the applicant cannot be achieved
by some method, feasible for the applicant to pursue, other than an area variance. The
placement proposed would provide no impact and is the least of any nonconforming
location on the premises.
3. Town Law 267~b(3)(b)(3). The variance requested in this application is not
substantial and at least two-thirds of the accessory pool is located in the code-required
rear yard, while one third of the pool will be in a nonconforming location as the code-
designated side yard (along a side of the deck addition.
4. Town. Law 267-b 3 . The difficulty has been self created. The addition was
built prior to the pool construction.
5. Town Law 2 7-b 3 b ., There has been no evidence to suggest that a variance in
this residential community will have an adverse impact on the physical or
environmental conditions in the neighborhood. In addition, the applicants submitted

information to show they have obtained a wetland permit from the applicable
environmental agencies.
Grant of the relief requested is the minimum action necessary and adequate to enable
the applicant to enjoy an in-ground pool, while preserving and protecting the character
of the neighborhood and the health, safety and welfare of the community.
Rl OL ;� TON F THE BOARD: In considering all of the above factors and applying
the balancing test under New York Town Law 267-13, motion was offered by Member
Weisman, seconded by Member Simon, and duly carried, to
GRANT the variance as applied for, as shown on the site survey prepared
October 12, 2007 by Peconic Surveyors, P.C.
Any deviation from the variance given such as extensions, or demolitions which
are not shown on the applicant's diagrams or survey site maps, are not
authorized under this application when involving nonconformities under the
zoning code. This action does not authorize or condone any current or future use,
setback or other feature of the subject property that may violate the Zoning Code,
other than such uses, setbacks and other features as are expressly addressed in
this action.
The Board reserves the right to substitute a similar design that is de minimis in
nature for an alteration that does not increase the degree of nonconformity.

Based on the information you have submitted, the Department of Environmental Conservation
(DEC) has determined that the property landward of the 20 foot elevation contour, as shown
on the survey prepared by Peconic Surveyors, P.C. dated October 16, 1987 last revised on
July 7, 2006, is beyond Article 25 (Tidal Wetlands Act)jurisdiction.
Therefore, in accordance with the current Tidal Wetlands Regulations (6NYCRR Part 661) no
permit is required.
Be advised, however, that no construction, sedimentation, or disturbance of any kind
may take place seaward of the tidal wetlands jurisdictional boundary, as indicated
above, without a permit. It is your responsibility to ensure that all precautions are taken to
prevent any sedimentation or other alteration or disturbance to the ground surface or
vegetation within Tidal Wetlands jurisdiction which may result from your project. Such
precautions may include maintaining adequate work area between the tidal wetland
jurisdictional boundary and your project (i.e. a 15' to 20' wide construction area) or erecting a
temporary fence, barrier, or hale bay berm.
Please note that this letter does not relieve you of the responsibility of obtaining any necessary
permits or approvals from other agencies or local municipalities.

Dear Dr. Notaro;
We are in receipt of your correspondence dated April 29, 2022 requesting a de minimus approval for the
proposed installation of an accessory in-ground swimming pool. The decision of the Zoning Board of
Appeals, dated April 10, 2008, granted variance relief for the location of the pool located partly in the
side yard, as opposed to a fully conforming rear yard location.
Pursuant to the Town's Board of Trustees' approval of August 18, 2021, the proposed pool will be
shifted approximately 5 feet further landward from the property tie line fronting Town Creek, but will
still be considered partly in the side yard as depicted on a site plan prepared by Frank Notaro, Architect,
last revised August 17, 2021.
Since the aforementioned accessory in-ground swimming pool will be located more landward, further
away from the waterway, with no effect to lot coverage, and the amended improvements uphold the
intent of ZBA Appeal No. 6136, I have determined that your request is de minimus in nature.
Please be advised that all conditions and regulations required by the State and Town for the installation of
swimming pools will still apply. Contact us if you have any further questions or concerns. I will instruct
the office to send a copy of this letter to the Building Department.

home at 625 Calves Neck Rd, Southold. We had obtained permits to build a pool
in 2008, which was not completed. Now the Trustees require it to be moved
closer to the house, so we are requesting this determination so we can proceed
with the pool installation.
