Dear Mr. Kimack:
The Board of Town Trustees took the following action during its regular meeting held on
Wednesday, April 18, 2018 regarding the above matter:
WHEREAS, Michael Kimack on behalf of JOHN & KORI ESTRADA applied to the
Southold Town Trustees to request a Transfer of Wetland Permit #4096 from David B.
Tuthill to John and Kori Estrada, and for an Amendment to Wetland Permit #4096 under
the provisions of Chapter 275 of the Southold Town Code, the Wetland Ordinance of
the Town of Southold, application dated February 28, 2018, and,
WHEREAS, said application was referred to the Southold Town Conservation Advisory
Council and to the Local Waterfront Revitalization Program Coordinator for their findings
and recommendations, and,
WHEREAS, the LWRP Coordinator recommended that the proposed application be
found Inconsistent with the LWRP, and,
WHEREAS, the Board of Trustees has furthered Policies 6.3 and 9.3 of the Local
Waterfront Revitalization Program to the greatest extent possible through the imposition
of the following Best Management Practice requirements: that plans submitted indicate
that dock and boat will not exceed one-third rule, and
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said
application on April 18, 2018, at which time all interested persons were given an
opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar with the
premises in question and the surrounding area, and,

WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the structure complies with the standards set forth in Chapter 275 of the
Southold Town Code,
WHEREAS, the Board has determined that the project as proposed will not affect the
health, safety and general welfare of the people of the town,
NOW THEREFORE BE IT,
RESOLVED, that for the mitigating factors and based upon the Best Management
Practice requirement imposed above, the Board of Trustees deems the action to be
Consistent with the Local Waterfront Revitalization Program pursuant to Chapter 268-5
of the Southold Town Code, and,
BE IT FURTHER
RESOLVED, that the Southold Town Board of Trustees APPROVE the Transfer of
Wetland Permit#4096 from David B. Tuthill to John & Kori Estrada, as issued on
December 10, 1992 and Amended on June 1, 1993, and
RESOLVED, that the Board of Trustees APPROVE the Amendment to Wetland Permit
#4096 to construct a 4'x8' fixed dock extension using Thru-Flow decking and two (2) 8"
diameter dock pilings onto the seaward end of existing fixed dock for a new total length
of 58'; reconfigure existing floating dock to an "L" shape configuration; relocate the
existing two sets of floating dock securing two-batter pilings; and install one 8"-10" tie-off
piling approximately 15' to the west from the new floating dock location; and as depicted
on the revised site plan prepared by Michael A. Kimack, received on April 19, 2018, and
stamped approved on April 24, 2018.
Inspections are required at a fee of $50.00 per inspection. (See attached schedule.)

Trustee permit has been recorded with the Suffolk County Clerk's Office as a notice covenant

The Southold Town Board of Trustees adopted the following Resolution at a meeting
held on Wednesday, April 5, 2018:
DESCRIPTION OF ACTION: Michael Kimack on behalf of JOHN & KORI ESTRADA

Estrada as issued on December 10, 1992, and Amended on June 1, 1993; and for an
Amendment to Wetland Permit #4096 to construct a 4'x8' fixed dock extension using

S.E.Q.R.A. POSITIVE DECLARATION OF ENVIRONMENTAL SIGNIFICANCE:
WHEREAS, the Southold Town Board of Trustees found that the application of JOHN &
KORI ESTRADA is to be classified as an Unlisted Action Positive Decision pursuant to
SEQRA Rules and Regulations. A Long Environmental Assessment Form and a field
and it is hereby determined that the proposed dock will have a significant effect on the
environment.
WHEREAS, the Southold Town Board of Trustees are familiar with this project having
visited the site on March 14, 2018 and having considered plans for this proposed dock
at their March 19, 2018 work session, and;
WHEREAS, in reviewing the project plans dated October 5, 1992, revised March 19,
2018, and the Nathan T. Corwin survey dated January 17, 2008, it has been determined
by the Board of Trustees that potentially significant environmental concerns have been
noted herein:
• Navigation: The proposed dock does not meet the standards as set forth in
Chapter 275-11 C(2)(a) "docks shall be designed, constructed, and located so as
to reduce a dock's potential adverse impacts to navigation, public safety, and
waterway congestion." The proposed dock and configuration including the beam
of a docked vessel potentially creates navigation issues for the neighboring
docks and the public. In addition Chapter 275-11 C(2)(b)[2] "within creeks and
narrow waterways, no dock length shall exceed 1/3 the total width of the
waterbody. Determination of the length of the dock must include the dimensions
of the vessel." The proposed dock and survey do not show a vessel nor the
distance across the waterway as required.
• Scope: The dock as it is presently configured is comparable to docks on
neighboring properties.
• Scope in relation to riparian rights of shellfishers: The plan provides for a
standard piling design that will permit access beneath the decking for small
vessels at low tide and those seeking shellfish and crustacea on foot during
season.
• Environmental upkeep: The dock design projects a usual lifespan of 30 years
with limited pile replacement so as to minimize disturbance of the bottom.
THEREFORE, on account of the foregoing, the Southold Town Board of Trustees
Approve and Authorize the preparation of a Notice of Positive Declaration pursuant to
SEQRA for the aforementioned project.

The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the
Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy
Standards. Based upon the information provided on the LWRP Consistency Assessment Form
submitted to this department, as well as the records available to me, it is my recommendation
that the proposed action is INCONSISTENT with the denoted following Policy Standards and
therefore is INCONSISTENT with the LWRP.
1. Policy 6. Protect and restore the quality and function of the Town of Southold
ecosystems.
Policy 6.3 Protect and restore tidal and freshwater wetlands.
A. Comply with statutory and regulatory requirements of the Southold Town Board of
Trustees laws and regulations for all Andros Patent and other lands under their
jurisdiction
1. Comply with Trustee regulations and recommendations as set forth in
Trustee permit conditions.
The applicant must demonstrate that the following dock standards pursuant to §
275-11. Construction and operation standards have been met:

(d) Review and approval of dock applications. Before issuing a permit for a dock structure,
the Trustees shall consider whether the dock will have any of the following harmful
effects:
[1] Whether the dock will impair navigation or be located in areas of high vessel traffic
or vessel congestion;
Chapter 275 requires that the determination of the length of the dock must include
the dimensions of the vessel as proposed. The dimensions of a vessel were
provided on a Google Earth photo with the current dock configuration.
The applicant has not correctly demonstrated that the dock meets the 1/3 rule and
is consistent with "pier" line of the water body. A Google Earth map was provided
but does not show the total proposed dock length in relation to the distance of the
other side of the waterbody or pier line.
A discussion on the potential impacts (if any) to navigation of all vessels have not
been provided. It is recommended the navigation channel in relation to the
proposed dock is assessed.
[2] Whether the dock will unduly interfere with the public use of waterways for
swimming, boating, fishing, shellfishing, waterskiing and other water-dependant
activities;
The application does not discuss the potential impediments/impacts regarding
public use.
(11] Whether the cumulative impacts of a residential and commercial dock will change
the waterway or the environment and whether alternate design, construction, and
location of the dock will minimize cumulative impacts; and
The application does not discuss cumulative impacts to the waterway or
environment.
9.3 Preserve the public interest in and use of lands and waters held in public trust by the state
and the Town of Southold.
The applicant currently enjoys access to public waters via an existing dock
structure.
Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in
preparing its written determination regarding the consistency of the proposed action
