The following action was taken by the Southold Town Board of Trustees at their Regular
Meeting held on Wednesday, August 22, 2012:
WHEREAS, BERNARD M. TURCHIANO applied to the Southold Town Trustees for an
Amendment to Wetland Permit #1264 under the provisions of Chapter 275 of the
Southold Town Code, the Wetland Ordinance of the Town of Southold, application
dated July 30, 2012, and,
WHEREAS, said application was referred to the Southold Town Conservation Advisory
Council and to the Local Waterfront Revitalization Program Coordinator for their findings
and recommendations, and,
WHEREAS, the LWRP Coordinator recommended that the proposed application be
found Inconsistent with the LWRP, and specifically Inconsistent with the following
coastal policies: Policy 6 - Protect and restore the quality and function of the Town of
Southold ecosystem, Policy 6.3 - Protect and restore tidal and freshwater wetlands,
Policy 9.3 - Preserve the public interest in and use of lands and waters held in public
trust by the state and the Town of Southold, and,
WHEREAS, the Board members have personally viewed and are familiar with the
premises in question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,

WHEREAS, the structure, as applied for, does not comply with the standards set forth in
Chapter 275 of the Southold Town Code, 275-11 Construction and Operation Standards
C(2)(c)[1][b][i] Residential Docks: Floats are to be no larger than six feet wide and 20
feet long except on Fishes Island if the need is demonstrated; or of equal square
footage as determined by the Trustees, and C(2)(c)[1][c] Residential Docks: In
determining the permitted length ora proposed residential dock, the Trustees shall seek
to maintain lengths consistent with the other docks (i.e. pier line) in the waterway which
meet the requirements of this chapter, and,
WHEREAS, the board determined that there is currently sufficient water depth with
structure as it exists, and,
WHEREAS, the Board has determined that the structure, as applied for, will have a
detrimental effect upon the health, safety and general welfare of the people of the town,
and,
NOW THEREFORE BE IT,
RESOLVED, that for the foregoing reasons, and based upon the application's failure to
meet the standards contained in Chapter 275 of the Town Code, that the Board of
Trustees deems the proposed project to be Inconsistent with the Local Waterfront
Revitalization Program pursuant to Chapter 268-5 of the Southold Town Code, based
on the size and location of the proposed structure, and,
BE IT FURTHER,
RESOLVED, that the Southold Town Board of Trustees DENIES the application of
BERNARD M. TURCHIANO to Amend Wetland Permit #1264 to extend the fixed dock
an additional 30' into deeper water to allow approach and docking of boat to existing
floating dock at Iow tide, as applied for.
This is not a determination from any other agency.

Introduction:
This is not an objection to the dock extension but as neighbors, we have concerns of safety, code
violation and visual aesthetics of the proposal.
SafeW:
In August of 1992, during Hurricane Andrew, Mr. Turchiano's sailboat broke loose from his dock. We
prevented it from colliding into our boat and secured it. Presently attached to the Turchiano dock is a
recently bought sailboat, which is double the width of the original sail, and a 19' runabout. Extending
the dock out 30' into the water places the dock and therefore the boats attached, being more
exposed to the elements of greater wind speeds and water currents.
Code Violation:
According to the construction and operation standards 275-11, section C in water adjacent to
residential properties section (2) pertaining to docks [5] All docks, including any vessel tied to the
dock, shall have a minimum clearance of 15 feet of the seaward extension of any property line from
adjacent parcels.
The set back from the property line of 15' should include the boats attached to the dock. The recently
purchased Catamaran has a wide beam. If the Catamaran has a 15' beam the floatation is required to
be set back 30' from the seaward extension property line.
The diagram depicts the dock angled slightly toward the center of the property. Visually the dock
appears to be parallel to the property line. In either case, building the dock straight out 30' would not
set the structure and the attached boats 15 feet of the seaward extension of the property line.
Aesthetics:
Even though the 30' extension would make this dock aesthetically different from other docks on the
Creek we are most concerned with its functionality.
Summary:
We are not objecting to the dock extension but we have these concerns of safety, aesthetics and code
violation. We especially would like the Town code to be followed so that the added structure is set
back 30' from the seaward extension of the property line.

The Board issued a permit (TR-1264) for a 5' x 20' dock in 1977. It is unclear if the current dock
configuration complies with the permit (see Figure 1)
BERNARD M. TURCHiANO requests an Amendment to Wetland Permit #1264 to extend the fixed
dock an additional 30' into deeper water to allow approach and docking of boat to existing floating dock
at Iow tide. Located: 445 Bungalow Lane, Mattituck. SCTM# 123-3-6
The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of
Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards.
Based upon the information provided on the LWRP Consistency Assessment Form submitted to this
department, as well as the records available to me, it is my recommendation that the proposed action is
INCONSISTENT with the LWRP and listed policy standards provided below.
Policy 6. Protect and restore the quality and function of the Town of Southold ecosystem
6.3 Protect and restore tidal and freshwater wetlands.
A. Comply with statutory and regulatory requirements of the Southold Town Board of Trustees
laws and regulations for all Andros Patent and other lands under their jurisdiction
1. Comply with Trustee regulations and recommendations as set forth in Trustee permit
conditions
The applicant fails to prove that the action meets the following requirements § 275-11 Construction and
operation standards C. 2 (C) [c} of the Southold Town Code:
C. In water. The fo/lowing standards are required for all in-water operations adjacent to residential
properties.
(2) Docks.
(c) Regulations for the placement and configuration of docking facilities.

In determining the permitted length of a proposed residential dock, the
Trustees shall seek to maintain lengths consistent with the other
docks (i.e., pier line) in the waterway which meet the requirements
of this chapter.
The proposed dock structure would extend significantly past the existing dock line
(yellow line).

Preserve the public interest in and use of lands and waters held in public trust by the
state and the Town of Southold.
Limit grants,/eases, easements, permits or lesser interest in lands underwater in accordance
with an assessment of potential adverse impacts of the proposed use, structure, or facility on
public interest in public lands under water.
The dock structure will extend into public water and result in a net decrease in public acces~
to/on public underwater lands. The applicant enjoys access to public water via an existing dock.
The dock is consistent with the other dock structures in the vicinity. It is recommended that an
alternative moorinq option in a more appropriate location is considered to accommodate the
vessel.
Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its
written determination regarding the consistency of the proposed action.

All applicants for permits* including Town of Southold agencies, shall complete this CCAF for
proposed actions that are subject to the Town of Southold Waterfront Consistency Review Law. This
assessment is intended to supplement other information used by a Town of Southold agency in
making a determination of consistency. *Except minor exempt actions including Building Permits
and other ministerial permits not located within the Coastal Erosion Hazard Area.
Before answering the questions in Section C, the preparer of this form should review the exempt
· minor action list, policies and explanations of each policy contained in the Town of Southold Local
Waterfxont Revitalization Program. A proposed action will be evaluated as to its significant
beneficial and adverse effects upon the coastal area (which includes all of Southold Town).
