According to the information given, a copy of the. survey
submitted and an on-site inspection to construct an unheated 2
story solarium measuring 29'3 1/3" X 11'1 2/8", is out of the
Wetland Ordinance under Chapter 97 of the Town Code.
Please note that any aCtivity within the 75' of Wetland area
will require an application from this. office.

Dear Mr. & Mrs. Tsavaris:
The application for a waiver for which you seek permission for a
satellite dish, deck and burner is beyond the jurisdiction of
this Board for having been constructed prior to the effective
date of Coastal Erosion Hazard Ordinance in November, 1992 and
is more than 75' from Mean high water on Long Island Sound and
as such is beyond the jurisdiction of the Town Wetland Ordinance.

After an on site inspection the Southold Town Board of Trustees
find that the proposed pool is out of their jurisdiction,
therefore does not need a permit from this office.
However, the proposed fence is in our jurisdiction and is being
reviewed at this time.

RECOMMENDATION OF REQUESTS FOR LETTERS OF NON-JURISDICTION

Moved by Allan Connell, secOnded by Betty Wells, it was
RESOLVED to recommend to the Southoid Town Board of Trustees DENIAL of the'
request for a letter of Non-Jurisdiction of SUSAN TSAVARIS 30-2-53 to construct a 15'
x 30' inground pool beyond the 75' setback from high water line on Long Island Sound.
Denial is recommended because, although the location of the pool itself is not
within Trustees' jurisdiction, the required fence would be within Trustees' jurisdiction
according to information supplied by the applicant. Due to the fence's proposed location
a Wetland Application should be required and the application should show the Coastal
Zone Hazard line.

RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH
PROVISIONS of the request to amend the permit of BARBARA CIEPLINSKI 89-3-9 & plo
8_ to relocate structure slightly northward and reoriented to reach a 3' depth in
accordance with NYS DEC requirements.
As stated in the CAC's original recommendation concerning .this application, approval
is recommended provided the project does not block the navigation of the neighbors. The
Trustees' may wish to have the Bay Constable make a determination as to the fullest limit
possible without causing obstruction.

licensed survey of the as-built structure.
It is my/our understanding that we are to maintain this
structure with materials designed to endure 30 years and or
equivalent to the original approved structure and that for any
maintenance which involves more than 5% in length of this
structure we are to give prior written notice to the
administrator, waiting for their approval in all but true
emergency situation's which would seriously endanger life,
property and important coastal natural resource features such as
bluffs or wetlands. We further~understand that failure to
maintain the structure could result in a requirement to post a
bond and or have the repairs ordered as a lien against the
property upon a finding by the Trustees that said lack of
maintenance would risk life, property or important natural
resources features including protected, rare or threatened
animals and plants.
