(E.S.T.), Upon application of Charles Mills, a/c The Idle Hour, Village Lane, Orient, New York, for a ~special exception in accordance with the Zoning Ordinance, Article IV, Section 408, Subsection (b), for permission to retain an on premises sign. Locatinn of property: ~est side Village Lane, OrJ~ nt, New York, bounded north by T.W. Young, east by Village Lane, south by Paul Wasilew~ki, west ~by H.C..Tabor. 2. VARIANCE. By resolution of the Board it was determined that (a) Strict application of the Ordinance (would) (would' not) ~roduce practical difficulties or unnecessary hardshig SEE R.EVERSE (b) The hardship crea%ed (is) (is nob unique and (would) (would not) b~ shared by all properties alike in the immediate vicinity of this property and in the same use distric~ because SEE REVERSE (c) The variance (does) (does not) observe the spirit of the Ordinance and (would) (~vould not) change the character of the district because SEE REVERSE and therefore, it was further determined that the requested variance ( ) be granted ( ) be denied and that the previous decisions of the Building Inspector ( ) be confirmed ( ) be reversed. PORM ZB4 Barbara C. ~D Or APPEALS Dittmann, Secre~ ry After investigation and inspection the Board finds that the applicant requests permission to retain a hanging sign. The Board grants permission ~r a hanging sign in lieu of a ground sign. A ground sign would be undesirable at this location because of the reduced front yard area and traffic going in and out of the post office adjoining this property would create a traffic hazard. A ~ondition of granting permission for a sign structure to remain is that the applicant advertise his own business and not the "coca cola" business. The Board finds that the public convenience and welfare and justice will be served and th~ legally established or permitted us~ of neighborhood property and adjoining use districts wil~ not be permanently or substantially injured and the spirit of the Ordinance wil~ ~e observed. Therefore, it was RESOLVED tha~ Charles Mills/ a/c The Idle Hour, Village Lane, Or.lent, New York, be granted permission to re%ain an on premises hanghg sign, subject to the following conditions: ~ 1. The applicant shall advertise his own business and not the "Coca Cola" business, and the applicant shall comply with this condition within 60 days. 2. The sign shall be granted for one year, renewable annually upon written applicatinn to the Board of Appeals.~ ? 3. The sign shall be subject to all subsequent changes in the Southold Town Building Zone Ordinance as it applies to signs. ~O~',VN-:,~F SIOU,TI~O~D, NEW ~P~LIC~T~ON !~0~ S~:ECIAL EXCEPTION TO, T:H~ Z,ONIi~G BOAttD OF APPE~L.S, S~OUTPIOLO,, N.
