After investigation and inspection the Board finds that
the applicant requests permission to construct a private detached
garage in the front yard area; Also ~requested is approval of access.
The Board finds that the applicant is the owner of waterfront property.
The Board points out there are many areas in the Town of Southold,
where there is waterfront property, the garages are located in the
front yard area. The Board finds that the applicant will be backing
out of the garage onto a dead-end street. The Board does not
consider this a major traffic hazard.
As to the approval of access, the Board finds
road can he made passable to all emergency vehicles,
width of at least 15 feet.
The Board finds that s~rict appticationof the Ordinance
w~ll produce practi~al difficulties orunnecessary hardship;
the hardship created is unique and would notbe shared by all
properti_es alike in the immediate vicinity of this property
and in the same use district; and the variance does observe
the spirit of the Ordinance and will not change the character
of the district.

This permission is subject to the following conditions:
1. The proposed private detached garage shall be located
at least 35 feet from the front (road) property line.
2. The access road shall be subject to the final approval of
the Southold Town Building Inspector.

1. STRICT APPLICATION OF THE ORDINANCE would produce practicaldifficuities or unneces-
sary HARDSHIP because
the land falls off to the waterfront in such
a manner that the only practical location~ on this size lot,
for the proposed garage is in the ~legal front yard; the main
dwelling~O~$~ being situated in such a manner as to face
the bay and a magnificent view which should not be obstructed
by an accessory buildLug.
The existing~ now used, 15 ft, wide readbed originally
laid out on abandoned Fi~ed Map.
2. The hardship createdis UNIQUEand isnotshared by all properties alike in the immediate
vicinity ofthisproperty and in this use district because
the terrain is not the same~

c. · The work covered by this application may not be commenced before issuance of Building Permit.
d. Upon approval of this application, the Building Inspector will issue a Building Permit to the applicant. Such
permit shall be kept on the premises available, for inspection throughout the progress of the work.
e. No building shall be occupied or used in whole or in part for any purpose whatever until a Certificate of Occupancy
shall have been granted by the Building Inspector.
