After investigation and inspection the Board finds that
the applican~t~equests approval of a rightof way to be 50
feet wide. This right of way will serve a dwelling to be
built on property presently owned by the applicant. The
Board finds that the rightof way will be accessible to all
emergency vehicles. In general, the Board is in~ agreement
with the reasoning of the application.
The Board finds that strict application of the ordinance
will produce practical difficulties or unnecessary hardship;
the hardship created is unique and would not be shared by all
properties alike in t~e i~ediate vicinitY of this property
and in the same use district; and ~t~ wa~i~nce d~es observe the
spirit of the ordinance and will noL change the character of
the district.
There~re, it was RESOLVED Alfred E. and Al, ice J. Dart,
Bayview Road, Sou~hold~ New York, be granted approval, of ,
access on property located on the south end of willow Pond
Lane, Southold, New York,~ as aPPlied for, subject to the final
approval of the Southold Town Building Inspector.
