By resolution of the Board it was determined that (a) Strict al~plication of the Ordinance (would) (wonid not) produce practical difficultie~ or unnecessary hardship because SEE REVERSE (b) The 'hardship created (is) (is not) unique and iwould) (would not) be Shared by all prOPerties alike in the immediate vicinity of this property and in the same use district because SEE REVERSE (c) The variance (does) (does not) observe the eph-it of the Ordinance and (would) (~would not) change the character of the district because SEE REVERSE and therefore, it was further determined that the requested variar~ce ( ) be granted ( ) be denied and that the previous decisions of the Building Inspector ( ) be confirmed ( ) be reversed. Dittmann, Secretary After investigation and inspection the Board finds that the applicant requests permission to retain a pole sign with insufficient setback from the property line. This sign does not overhang the property line and is not hazardous to traffic, and it would serve no purpose to move this sign further south on the property. The Board is in agreement with the reasoning of the application. The Board finds-that the pubtie eohvenience and welfare and justlce.will be served and the legally established or permitted use~of neighborhood property and adjoining use districts will no~ be permanently or substantially injured and the spirit of the Ordinance will be'observed. Therefore, it was RESOLVED that Chevron Oil Company, 1200 State Street, Perth Amboy, New Jersey, a/c Cherry's Service Station, Main Road, Southold, New York, be granted permission to retain a poie ~ign with insufficient setback from the property line on pzoperty located on the Main Road and Bayview Road, Southold, New York. This permission is granted subject to the following conditions: 1. The sign shall be subject to all subsequent Changes in the Southold Town Zoning Ordinance as it applies to signs. 2. The sign shall be granted for one year, renewable annually upon written application tothe Board of Appeals. The present location of the existing Chevron identification sign was established prior to the adoption of the 0rdinauce and causes neither hazard nor nuisance. Relocation of the sign would be of no benefit to the Tow-nor to the public in this particular case~ but would create an unnecessary hardship. Calloszo Dear Sir~ Xn response to your telephone call this morning REs Violations given to cheveron gasoline stations in the Town of Southold at ~ain Road & ~ayview Road~ SoutholdtAlso~ Love Lane & Pike St~ Nattituek~ Please be advised that under section 1002~ Article X of the building zone ordinance a five year period was given to make all #non- conformingm signs comply with the ordinance requirements OR be approved as a special exception by the Board of Appeals. One thing or another has held t~s enforcement up until present time. Enclosed are copies of the notices sent out by this office & copy of the April 1~ letter. At the Southold station~ the po~e~ign does not have a ~ft clearance from all property lines as required~ it was set on an existing base installed prior to the ordinance~ also the operator has a second ground sign (converted from a prior existing sign)~ this may be relocated on a front wall of the building - in line with other signs on front wall~ also a "smoked eel'se sigr~anging on guy wire from utility pole, this may be relocated in show windo~ if he wishes. At the ~Mttituok station, the pole sign overhangs the property line and must be relocated at least ~ ft in from all property lines. There are several tire~ ~attery and other produot signs on building which are not part of the permitted wall sign~ these must be removed or relocated to become part of the permitted sign.
