Dittmann, Secretary After investigation and inspection the Board finds that the appellant requests permission to retain an accessory building in the front yard area. More s~ecifically the accessory building in question is a private garage. The Board finds that the hardship involved in this case is a self imposed hardship. The appellant had an attached garage on the dwelling and he chose to incorporate this as part of the living space. It is the opinion of the Board that the appellant created the hardship and a self imposed hardship can not be constd~r~b~this Board as a legal hardship. The Board finds that strict application of the Ordinance will not produce practical ~lifficulties or unnecessary hardst~p; the hardship created is not unique and would be share~by all properties alike in the immediate vicinity of this property and in the same use district; and the variance does not observe the spirit of the Ordinance and will change the character of the district. Therefore, it was ~ESOLVED that Kyrillos Charatambides, 1550 Central Drive, Mattituck, New York, be ~w~ denied permission to retain an accessory building in the fornt yard area on property located and described as lotnumber 79 in Capt. Kidd Estates, Mattituck, New York, application to the Board of Appeals dated December 1, 1966. This accessory building must be removed from the premises within sixty (60) days from January 19, 1967. Dittmann, Secretary After~investigatio~ and~inspection the Board finds that the applicant requested a rehearing on appeal number 1006, in view of the fact certain facts in the original decision were incorrect. The Board finds that the applicant did not have an attached garage at the time he bought the property in question. The garage had already been incorporated into the living area of the dwelling by the previous owner. However, the applicant was aware of the fact there was no garage on the premises and the location of the present garage built by the present owner does not observe the spirit of the Ordinance. The applicant would be backing out onto a public highway and thus cre~ting a traffic hazard~ ~The .location of the present garage does not conform with the provisions of the zoning Ordinance. The ,Board finds that strict application of the Ordinance will ~otproduce practica1 difficulties or unnecessary hardship; the hardship cr~s.ted is not unique and would be shared by all properties alika in th~mmediate vicinit~ of this property and in the same use ~"trict; ~and the variance does not observe the spirit of the Ordinance ~nd will change the character of the district. Therefore, it was RESOLVED that Kyrillos Charalambides, 1550 Central Drive, Mattituck, New York, be denied permission to retain an accessory building in the front yard area on property located on the north side Central Drive, lot number 79 in Capt. Kidd Estates, Mattituck, New York. The original order of the Board of Appeals for the removal of the garage shall be carried out.
