Pursuant to the provisions of Chapter 615 of the Laws of
the State of New York, 1893; and Chapter 404 of the Laws of the
State of New York 1952; and the Southold Town Ordinance en-
titled "REGULATING AND THE PLACING OF OBSTRUCTIONS
IN AND ON TOWN WATERS AND PUBLIC LANDS and the
REMOVAL OF SAND, GRAVEL OR OTHER MATERIALS FROM

lowing:
1. That the said Board of Trustees and the Town of Southold am released ft~n any and
all damages, or ~l~i,m fo~ d~,~g~, of suits arising direcdy or indirectly as a result of any o1~r-
ation perfomaed pm'snant to this permit~ and the said Petmittee wilh at his oe bet own expens~
defend any and all such suits initiated by third pa~ and the said Pennitme assumes full ~
with respect thereto, ~o the complete exdnsion of the Boerd of Trustees of the Town o/,%~-thold
2. That this Permit is valid for a period of ] 2 mos. wh;eh is comldex~d to be the
estimated time required to complete the work involved, but should circumstances werrang request
for an extension may be made to the Board at a later date.
~. That this Permit should be retained indefinitely, or as long as the said Pemtittee wishes
to maintain the structure or project involved, to provide evidence to anyone concerned that auth-
orization was originally obtained.
4. That .the work involved will be subject to the inspection and approval of the Board or
its agents, and non-compliance with the provisions of the originating application, may be ,'~,,~e foe
revocation of this Pexmit by resolution of the said Board.
5. That there will be no unreasonable interference with navigedon as a result of the work
herein authorized.
6. That there shall be no interference with the right of the public to pass and repass along
the beach between high and low water marks.
7. That if furore operations of the Town of Southold requi~e the ~moval and/or alterations
in the location of the work herein authorized, or if, in the opinion of the Board of T~ the
work shall cause unreasonable obstruction to free navigation, the said Permittee will be requieed~
upon due notice, to remove or alter this work or project herein stated without expenses to the Towtl
of Sonthold.
8. That the said Board will be notified by the Permit'tee ot the completion of the work auth-
orized.
9. That the Permlttee will obtain ali other permits and consents that may be required sup-
plementai to this permit which may be subject to revoke upon failure to obtain same.

You should have this application approved and returned to you
within a week.

3.The purpose of this application: Redriving or replacing
openwork dock or openwork pier piling, and mooring piles,
removal of damaged piling, repair, resetting or replacement of
floating docks, ramps, or decking, all necessitated by ice and
storm damage resulting during 1989-1990 winter.
SPECIAL CONDITIONS
1. No dredging or filling is permitted.
2. Repairs to existing structures shall be limited to
replacement of timbers without change in design or dimension.
3. No repair or replacement of bulkheads is permitted under this
permit.
4. No freshwater of tidal wetlands are to be disturbed under any
circumstances.
5. A yellow permit sign provided by this office shall be
displayed on the project at all times while under replacement.
6. Original permit numbers (3"high) must be displayed on project.
7. Groins and bulkheads are subject to inspection prior to
issuance of permit.

Please be advised that the following action was taken.
by the Board of Town Trustees at a regular meeting held on
September 25, 1985:
RESOLVED that the Town Trustees of the Town of Southold
hereby grant a waiver on the need of a wetland permit for
Dr. and Mrs. Donald Luchsinger for the construction of an
addition to an existing residence and a deck on property
referenced above, subject to the following provisions:
1. Roof run off shall be discharged into dry wells.
2. Care should be taken so as to preclude the entry of
any construction material into adjacent waters.
3. Immediately following construction, all areas of
exposed soil shall be properly protected with suitable
erosion control devices and/or vegetated to prevent
entry of eroded soil into nearby waters.

A WAIVER BE GIVEN THE FOLLOWING RESOLUTION SHOULD BE OFFERED:
RESOLVED that the Town Trustees of the Town of Southold
