part of the consideration for the issuance of the Permit does understand nad pte~tibe to the fol-
lowing:
I. That the said Board of Trustees and the Town of Southold ate released from any and
all damages, or tlnlm, for ,I.mnges, of st~ts arisin~ directly or inditestly as a re~lt of any oput-
atlon performed pursuant to this lw. rmlt, and the said Permictee w/ii, ~t h/~ oz her own expun~
defend any and all such suits initiated by third parties, and the said Perm~t~ee assumes full liability
with respect thereto, to the complete exclusion of the Board of Tmstces of the Town of Sonthold
2. That this Permit is valid for a Pudod of 1 2 mos. wh!,-h is conslde_~l to be the
e~fimated time required to complete the work involved, but shonld circumstances warrant, reClUest
for an extension may be made to the Bottrd at a later date.
3. That this Permit should be remlnecl indefinitely, or as long as the said Permittee wishes
to maintain the structure or project ~nvolv~d, to provide evidence to anyone concerned that anth-
orisation was originally obtained.
4. That the work involved will be subject to the inspection and approval of the Bon~ ot
its agents, and non-complhnce with the prov~sinns of the ot~in~tlng appllcation~ may be ~,,~e for
revo~a~on of this Pennlt by resolution of the said Board.
5. That there will be no unreasonable interference with navigation as a remit of the work
herein authorized.
6. That there shall be no interference w/th the fight of the public to Pus~ and repas~ alon~
the beach between high and low water marks.
7. That ff future operations of the Town of Southold require the removal and/or alterations
in the location of the work herein authorized, or ii, in the opinion of the Board of Tn~tee~ the
work shall cause unreasonable obsmzcuon to free navigation, the said Permittee will be requi~ed,
upon due notice, to remove or alter this work or project herein stated without expumes to the Town
o~ Southold.
8. That the said Board will be nodfied by the Permit'tee ot the completion of the work auth-
orized.
9. That the Permittee will obtain all other permits and coment~ chat may he required sup-
plemental to this permit which may be subject to revoke upon failure to ohesin same.

RESOLVED that the To~n Trustees of the Town of Southold ·
.hereby grant a.waiver on the need of a .wetland permit for
Dr. and Mrs. Donald Luchsinger for the construction o.f an
addition to a.n' existing residence and a deck on property
referenced above, subject to'the following provisions:
t. Roof run off shall be discharged into dry wells.
2. Care should be taken so as:to preclude the entry of
any construction material into adjacent waters.
3. Immediately following construction, all areas of
exposed soil shal. l. be properly protected with suitable
erosion control der. ices and/or 'vegetated to prevent
entry of eroded soil into-nearby waters.
