POLICY: At the beginning of scheduled Town Board meetings, the attending public is encouraged to
briefly address the Town Board relating to agenda resolutions prior to their enactment; the public will also be
given time at the conclusion of the regularly scheduled business agenda to address the Board on any given
topic.
ONLINE ACCESS: The Tentative Agenda is generally available the Friday before the meeting. The video of
the meeting is usually available to watch live during the meeting. Minutes with adopted resolutions are
available 1-2 days after the meeting. A full copy of the minutes, agenda and meeting video can be viewed by
going to the official Town of Southold website:
www.southoldtownny.gov <http://www.southoldtownny.gov> and following either of the following:
(1) Move pointer over “Government” on the Town website home page. You will find the title “Town
Supervisor/Town Board”. Under this title you will see “Southold Town Board Meetings and Agendas”. or
(2) Go to “How Do I”, in the right upper corner of the Town website home page, Choose “Access”, then
“Southold Town Board Meetings and Agendas.
Go to the date of the meeting and click on "Minutes Packet" this is the full copy of the resolutions. (Scroll to
bottom of page for KEY to symbols). You can view the live video of the meeting by clicking on the camera
symbol. All of this information is available 24/7.

Due to the expiration of the New York State Governor’s Executive Orders regarding the COVID-19 pandemic
in-person access to the Public will now be permitted. The meeting will still be accessible via Zoom and
streamed live on the Town’s website. The meeting can be viewed live by going to the Town’s website at
www.southoldtownny.gov <http://www.southtownny.gov> home page. Click on the “Government” tab, once
the drop down menu appears, under “Town Supervisor/Town Board”, click on “Southold Town Board Minutes
and Agendas” which takes the user to the Town of Southold Meeting Portal page. Once on the Meeting Portal
page, click on the date of the meeting you wish to view and then click on “Video”. A recording of the meeting
will also air on Channel 22 and will be posted on the Town’s website
Instructions and link to attend the meeting will be available on the Town’s website or by calling the Town
Clerk’s office at (631)765-1800. A telephone number will also be provided to allow members of the public to
attend via telephone.

Pursuant to the requirements of the Executive Order of the Governor of the State of New York, a transcript will
be prepared of the public hearing, and a copy shall be filed with the Town Clerk and placed upon the Town's
website.

Intermunicipal Agreement with Suffolk County
WHEREAS, the Town Board of the Town of Southold is always desirous to improve the economy and quality
of life within Town of Southold; and
WHEREAS, through the Suffolk County Downtown Revitalization Program, the County of Suffolk participates
with local governments in the development, support and funding of projects located in Suffolk County that will
have an important and sustainable impact on downtowns and business districts; and
WHEREAS, as part of the application process in conformity with Suffolk County Resolution No. 808-1998,
the County of Suffolk requires a resolution of the Town Board showing local support for the proposed project;
and
WHEREAS, upon the County’s approval of the project, the Town of Southold would be required to enter into
an intermunicipal agreement with the County under Article 5-G of the General Municipal Law pursuant to
which the Town of Southold would be required to undertake and complete the project and the County would be
responsible for providing financing for all or part of the cost of the project; and
WHEREAS, the Town of Southold has a permit with New York State for use of the portion of the sidewalk
along Route 25 owned by the State; and
WHEREAS, in order to provide County financing for all or part of the project, the County of Suffolk must
obtain a leasehold, easement or other real property interest in the site of the project; and
WHEREAS, the Southold Historical Museum is desirous of proposing that the Town of Southold participate in
such program in connection with replacement of sidewalk and retaining wall along New York State Route 25,
aka Main Street in Southold and the Town and will be applying for $37,500 under the program;
WHEREAS, NOW, THEREFORE, BE IT RESOLVED, that the Town Board of the Town of Southold
hereby states its support of the Main Street sidewalk and retaining wall replacement project proposed by the
Southold Historical Museum pursuant to the Suffolk County Downtown Revitalization Program through the
Town of Southold; and be it further
RESOLVED that the Town Board of the Town of Southold hereby declares itself lead agency for the purposes
of SEQRA review for the subject change of Code; and be it further
RESOLVED that the Town Board of the Town of Southold hereby finds that the project proposed is classified
as a Type II Actions pursuant to SEQRA Rules and Regulations, and is not subject to further review under
SEQRA; and be it further
RESOLVED, that the Town of Southold shall take all necessary action to obtain the required easement, lease,
permit or other real property interest in the site of the project from the State of New York; and be it further
RESOLVED, that the Town Board of the Town of Southold authorizes Supervisor Scott Russell to sign any
and all necessary documents, including but not limited to the required easement/lease documents and an
intermunicipal agreement, subject to review and approval of the Town Attorney, to participate in the above

A Local Law entitled, “A Local Law Authorizing the Town Board and Public Bodies of the Town to
Participate in Meetings via Video conference”;
BE IT ENACTED by the Town Board of the Town of Southold as follows:
Section 1. Legislative Intent
It is the intent of this local law to give the town board and its public bodies, as that term is defined
in Public Officers Law § 102, the authority to participate in meetings via video conference in a
manner consistent with the town’s video conferencing policy and the authority granted in Public
Officers Law § 103-a.
Section 2. Authority
This local law is adopted pursuant to Public Officers Law § 103-a which expressly authorizes the
town board to adopt a local law giving the town board and its public bodies the authority to
participate in meetings via video conference from locations not accessible to the public so long as
a quorum of the board/body participates from locations where the public may be physically
present and other conditions are met.
Section 3. Video conferencing for Public Meetings
The Town Board of the Town of Southold hereby authorizes members of the town board and all
members of the town’s public bodies to participate in meetings using video conferencing
Technology in a manner consistent with Public Officers Law § 103-a and the town’s video
conferencing policy adopted by the town board.
Section 4. Severability.
If any clause, sentence, paragraph, subdivision, or part of this Local Law or the application
thereof to any person, firm or corporation, or circumstance, shall be adjusted by any court of
competent jurisdiction to be invalid or unconstitutional, such order or judgment shall not affect,
impair, or invalidate the remainder thereof, but shall be confined in its operation to the clause,
sentence, paragraph, subdivision, or part of this Local Law or in its application to the person,
individual, firm or corporation or circumstance, directly involved in the controversy in which such
judgment or order shall be rendered.
Section 5. Effective date.
This local law shall take effect immediately upon filing with the Secretary of State.

which time all interested persons were given an opportunity to be heard, now therefor be it
RESOLVED that the Town Board of the Town of Southold hereby ENACTS the proposed Local Law entitled,
“A Local Law in relation to Amendments to Chapters 280-13, 280-17, 280-38, 280-41, 280-45, 280-48,
280-58 & 280-62, each entitled Use Regulations” reads as follows:
LOCAL LAW NO. 2021

BE IT ENACTED by the Town Board of the Town of Southold as follows:
I. Purpose.
It has been determined by the Town Board that there is a continuing need for affordable rental units
within the Town of Southold. It has further been determined that the development of such units must be
properly regulated in order to maintain community character and manage growth in accordance with the
Southold Town Comprehensive Plan. Accordingly, amendments to Chapter 280 are warranted.
II. Chapter 280 of the Code of the Town of Southold is hereby amended as follows:
Article III Agricultural-Conservation (A-C) District and Low-Density Residential R-80, R-120, R-200
and R-400 Districts
280-13 Use Regulations.
In A-C, R-80, R-120, R-200 and R-400 Districts, no building or premises shall be used and no building or part
of a building shall be erected or altered which is arranged, intended or designed to be used, in whole or in part,
for any uses except the following:
B. Uses permitted by special exception by the Board of Appeals. The following uses are permitted as a special
exception by the Board of Appeals as hereinafter provided and subject to site plan approval by the
Planning Board, provided that not more than one use shall be allowed for each 40,000 square feet of lot
area:
(17) Conversion of existing space to affordable residential housing. \[Added 12-5-2017 by L.L. No. 20-
2017\]
(a) Tenants shall be reserved to moderate-income individuals and families who do
not have any ownership interest in any other residence or vacant lot. Tenants must
work or reside in the Town of Southold at the time they take possession. The
eligible applicants must be registered in the Town of Southold Housing Registry,
administered by the Government Liaison Officer prior to the commencement of
any tenancy.
(b) Converted space shall be limited to a maximum of six moderate-income residential rental units.
(c) As a condition of the granting of a special exception by the Zoning Board of Appeals, property
owners must convert said applied-for space to residential use within six months, rent the units at
a rate at or below the maximum allowable monthly rent for affordable housing units, and
maintain the excepted residential units as affordable residential housing for a minimum period of
eight years from the date of granting.
(d) All converted affordable residential housing shall be subject to all Town and county building code
and septic specifications.
(e) All converted affordable residential housing must have at least one parking space per unit.
(f) The premises must be located within a designated hamlet locus (HALO) zone.

280-17 Use regulations.
In an R-40 District, no building or premises shall be used and no building or part of a building shall be erected
or altered which is arranged, intended or designed to be used, in whole or in part, for any uses except the
following:
B. Uses permitted by special exception of the Board of Appeals. The following uses are permitted as a special
exception by the Board of Appeals, as hereinafter provided, and subject to site plan approval by the
Planning Board:
(3) Conversion of existing space to affordable residential housing.
(a) Tenants shall be reserved to moderate-income individuals and families who do not have any
ownership interest in any other residence or vacant lot. Tenants must work or reside in the Town
of Southold at the time they take possession. The eligible applicants must be registered in the
Town of Southold Housing Registry, administered by the Government Liaison Officer prior to
the commencement of any tenancy.
(b) Converted space shall be limited to a maximum of six moderate-income
residential rental units.
(c) As a condition of the granting of a special exception by the Zoning Board of Appeals, property
owners must convert said applied-for space to residential use within six months, rent the units at
a rate at or below the maximum allowable monthly rent for affordable housing units, and
maintain the excepted residential units as affordable residential housing for a minimum period of
eight years from the date of granting.
(d) All converted affordable residential housing shall be subject to all Town and county building code
and septic specifications.
(e) All converted affordable residential housing must have at least one parking space per unit.
(f) The premises must be located within a designated hamlet locus (HALO) zone.
Article VIII Residential Office (RO) District
280-38 Use Regulations.
In the Residential Office (RO) District, no building or premises shall be used and no building or part of a
building shall be erected or altered which is arranged, intended or designed to be used, in whole or in part, for
any uses except the following:
B. Uses permitted by special exception by the Board of Appeals. The following uses are permitted as a special
exception by the Board of Appeals as hereinafter provided and, except for Subsection B(6), are subject to
site plan approval by the Planning Board, provided that not more than one use shall be allowed for each
40,000 square feet of lot area:
(6) Conversion of existing space to affordable residential housing.
(a) Tenants shall be reserved to moderate-income individuals and families who do not have any
ownership interest in any other residence or vacant lot. Tenants must work or reside in the Town of
Southold at the time they take possession. The eligible applicants must be registered in the Town of
Southold Housing Registry, administered by the Government Liaison Officer prior to the
commencement of any tenancy.
(b) Converted space shall be limited to a maximum of six moderate-income residential rental units.
(c) As a condition of the granting of a special exception by the Zoning Board of Appeals, property
owners must convert said applied-for space to residential use within six months, rent the units at a
rate at or below the maximum allowable monthly rent for affordable housing units, and maintain
the excepted residential units as affordable residential housing for a minimum period of eight years
from the date of granting.
(d) All converted affordable residential housing shall be subject to all Town and county building
code and septic specifications.
(e) All converted affordable residential housing must have at least one parking space per unit.
(6) Conversion of an existing building to apartments, subject to the following conditions:
(a) Expansion of the building may be permitted as part of the conversion to
apartments;
(b) The number of apartments shall be limited to a maximum of six apartments;
(c) The existing building to be converted must be located on a parcel within a
designated Hamlet Locus (HALO) Zone or Hamlet Center;
(d) The apartments shall be offered for rent;
(e) The eligible applicants for tenancy must be registered in the Town of
Southold Housing Registry, administered by the Government Liaison
Officer, prior to the commencement of any tenancy;
(f) The apartment must be the primary residence of the signatory to the lease at
the time possession is taken and throughout the tenancy;
(g) The maximum rent charged may not exceed the maximum rent set forth in
section 280-30(D), in perpetuity;
(h) Property owners must apply for a building permit for the approved
construction within one year of the special exception approval;
(i) The apartment use may not be changed to another permitted use for a
minimum period of eight (8) years from the time the use receives a
certificate of occupancy;
(j) The subject parcel, the subject building, and the apartments must remain in
common ownership;
(k) Town of Southold rental permits must be obtained for each of the
apartments, and;
(l) The parcel must have at least one parking space per apartment;
Article IX Limited Business (LB) District
280-41 Use Regulations.
In the LB District, no building or premises shall be used and no building or part of a building shall be erected or
altered which is arranged, intended or designed to be used, in whole or in part, for any uses except the
following:
B. Uses permitted by special exception by the Board of Appeals. The following uses are permitted as a special
exception by the Board of Appeals as hereinafter provided and, except for Subsection B(5), are subject to
site plan approval by the Planning Board:
(5) Conversion of existing space to affordable residential housing.
(a) Tenants shall be reserved to moderate-income individuals and families who
do not have any ownership interest in any other residence or vacant lot.

§ 280-45 Use regulations.
In the HB District, no building or premises shall be used and no building or part of a building shall be erected or
altered which is arranged, intended or designed to be used, in whole or in part, for any uses except the
following:
B. Uses permitted by special exception by the Board of Appeals. The following uses are permitted as a special
exception by the Board of Appeals as hereinafter provided, except Subsection B (10), which may be
permitted as a special exception by the Planning Board, and all such special exception uses except
Subsection B(11) shall be subject to site plan approval by the Planning Board: \[Amended 6-20-2006 by

§ 280-48 Use Regulations.
B. Uses permitted by special exception by the Zoning Board of Appeals. The following uses
are permitted as a special exception by the Board of Appeals as hereinafter provided,
except Subsection B(17), which may be permitted as a special exception by the Planning
Board, and all such special exception uses except Subsection B(18) shall be subject to
site plan approval by the Planning Board.

(a) Tenants shall be reserved to moderate-income individuals and families who do not have any
ownership interest in any other residence or vacant lot. Tenants must work or reside in the Town

In the LIO District, no building or premises shall be used and no building or part of a building shall be erected
or altered which is arranged, intended or designed to be used, in whole or in part, for any purpose except the
following:
B. Uses permitted by special exception of the Board of Appeals. The following uses are
permitted as a special exception by the Board of Appeals as hereinafter provided, except
Subsection B(10), which may be permitted as a special exception by the Planning Board,
and all such special exception uses except Subsection B(11) shall be subject to site plan

III. SEVERABILITY
If any clause, sentence, paragraph, section, or part of this Local Law shall be adjudged by any court of
competent jurisdiction to be invalid, the judgment shall not affect the validity of this law as a whole or any part
thereof other than the part so decided to be unconstitutional or invalid.
IV. EFFECTIVE DATE
This Local Law shall take effect immediately upon filing with the Secretary of State as provided by law.
