Box 2124 Greenport, NY 11944 RE: Ethel & Arthur Toan SCTM %1000-52-2-22 Dear Mr. Costello, On December 14, 1994 the Southold Town Board of Trustees inspected the Toan property. The inspection revealed little if any erosion caused by tidal action. Also, we are reluctant to encourage any structure in Hashamomock Pond because of water quality improvements that the Trustees have in the works. The water quality has'improved because of Suffolk County. Department of Public Works action, and we believe that action by our board will, open additional areas to public shellfishing. Application #376 Dear Mr. Krupski: In 1986 we represented Mr. and Mrs. Toan in applying for a per, it to construct a bulkhead at their residence in Southold. The application was denied without prejudice because the Trustees were concerned that.the structure would undermine the lateral support of other lands in the vicinity. More than eight years have gone by and our clients continue to lose minor degrees of vegetation and soil. There appears to be no erosion to the northerly neighbor's property because of an existing toe-protecting concrete structure. The southerly neighbor is experiencing minor erosion, with the exception of one sr~a that was damaged more severely in the December 12, 1992 and March 13, 1993 storms. We would like to install a small lightly constructed retain- ing wall well above mean high water at the "toe" to assist in stabilizing this property. There have been other properties located to the north where major retaining structures have been repaired and/or installed. Because of their past experience, they are reluctant to resubmit a new application and undergo the entire time consuming permit process and costly associated fees again. We would, therefore, appreciate if the Trustees could inspect the area and A1 Krupski, November 15, Page 2 of 2 Jr., Southold Trustees 1994 advise whether a retaining wall (properly located and properly constructed) would be entertained for approval.
