Box AK Greenport, New York 11944 Bear Mr. & Mrs. Toan: Reference is made to Application No. 86-499-L2 to construct 100 linear feet timber bulkhead with two 10 foot returns with 50 cubic yards of attendant backfill above the mean high water line in Hashamonaque Pond, Shelter Island Sound at Southold, Suffolk County, New York. Our review indicates that since the proposed work is located completely above the spring high water line and does not appear to include dredging or construction activities in or over any navigable waters of the United States, the placement of any dredged or fill material in any waters of the United States (including coastal or inland wetlands) or the accomplishment of any work affecting the course, location, condition or capacity of such areas, a Department of the Army permit, in accordance with 33 CFR 320-330, will not be required provided the proposed work is executed in accordance with the referenced material. Care should be taken so that any fill or construction materials, including debris, do not enter the waterway to become a drift or pollution hazard. You are to contact appropriate State and local government o-,:ficials to insure that the subject work is performed in compliance with their regulations. It is the policy of this company to minimize all equipment useage at any Job site. In thi~,particular cased access will be over the bluff on Mr. Teen's property. All materials will be brought to the site by truck. Mr. Cea=silo sl~ed that there is not adequate access to bring a barge to the site nor is it necessary. The proposed installation 10~ landward of MHW is to ensure protection of tho bluff ate maximized distance' from any grasses. Mr. Costello proposes to stabilize the bluff with hay bales during construction and the debris that has been placed on the bluff b~ Mr. Toan will be ~arted to the town dump by truck. Jean Marriner, C.A.C.: I am speaking for the C.A.C. and I feel that there is no erosion problem at this location. We have made a full inspection and we feel there is no need for installation of a bulkhead. Trustee Smith: Excuse me the application is for a retaining wall. A bulkhead is below the HWM. I would like to clarify that. Jean Marriner: Okay, if that is what it is called. Ours was worded bulkhead. To Install a 100' bulkhead, 10 ft. above the HWM. As there is no bulkheading immediately adjacent to this property, the Council feels that there is no need for this structure. Trustee Smith: John. John Costello, Costello Marine Contracting: I don't think that this will start a precedent. There are several items in Arshamomoque Pond that everyone is aware of. Siltation, where does it come from? I can tell you that 90% of it comes from road run off and eroding properties. It just happerns that most of this fairly protected harbor, even the hurricane did damage. This is all a cause of pollution. Nitrates, decaying material, he planted the shore with shrubs. They are going into the creek, some did. He is trying to make an attempt to halt it where it is, and leave that. When we backfill the bulkhead we put sand behind the bulkhead, not topsoil. It gives it better filteration system and drainage. The material will last longer if you cane keep the water away from it. Ail of this is contributing factors siltation, eroding leaves, road run off, I think every bulkhead, I have built alot of them. I like to see them above high water, keep them back as far as you can. YOu don't need the scouring effect. But you cant say that a man should volinteer to lose a piece at a time. It will grow back, the vegetation is there now, if you take the soil out from under it, it will still grow back. I think that you should allow retaining wails and bulkheads make sure that they are back from HW. Try to head the people in the right direction. Trustee Smith: Are there any other comments?
