The validity of this permit is or may be subject to the approval of other governmental or municipal
authorities. The Town accepts no responsibility in applying for or obtaining such approval. In the
' event that such approval is necessary, the holder of this permit shall not commence operations here-
under until such approval has been obtained in writing. The failure to obtain such other approval when
required shall subject this permit to immediate revocation by the Trustees upon receipt by the
Trustees. of written notice from such other governmental or municipal authorities of its refusal or
disapproval.

The applicant does by the acceptance of this permit, assume all responsibility for operations under-
taken pursuant to this permit, and shall take all precautions for the prevention of injuries to persons
and property resulting from such operations. By such acceptance, the applicant also agrees to indemni-
fy and save harmless the Town, and its officers, agents and employees from any and all claims arising
from operations under this permit and any and all acts or omissions of applicant, his agent and
employees.
The applicant and the owner and occupants of the premises upon which the operations authorized by
this permit are being conducted, do, by the acceptance of this permit, give consent to the Town, and
its officers and employees to enter upon the premises where such operations are being conducted to
make such inspections as the Town may deem necessary to insure that such operations are being con-
ducted in conformity with this permit.
This operation will not substantially: A. Adversely affect the wetlands of the town.
B. Cause damage from erosion, turbidity or siltation.
C. Cause saltwater intrusion into the fresh water resources of the town.
D. Adversely affect fish, shellfish or other beneficial marine organisms, aquatic wildlife and vege-
tation or the natural habitat thereof.
E. Increase the danger of flood and storm-tide damage.
F. Adversely affect navigation on tidal waters or the tidal flow of the tidal waters of the town.
G. Change the course of any channel or the natural movement or flow of any waters.
H. Weaken or undermine the lateral support of other lands in the vicinity.
I. Otherwise adversely affect the health, safety a[}d general welfare of the people of the town.

The following action was taken by the Conservation Advisory
Council at a regular meeting held Tuesday, October 23, 1984.
RESOLVED to recommend to the Southold Town Trustees approval of
the wetland application #224 submitted by Mrs. June Hussey to re-
place 100 feet of existing bulkhead. East Creek, Cutchogue.
RESOLVED to recommend to the Southold Town Trustees approval
of the wetland application #225 submitted by Stanley Chase to
install dock and ramp and float. Mattituck.
RESOLVED to recommend to the Southold Town Trustees approval
of the wetland application #226 submitted by Stanley Chase to
install dock, ramp and float secured by two spiles. Mattituck.
RESOLVED to recommend to the Southold Town Trustees approval
of the wetland application #227 to install dock, ramp and float
secured by two spiles. Dock to be elevated 3' over tidal wetlands.
Mattituck Creek, Mattiuck.
RESOLVED to recommend to the Southold Town Trustees approval
of the wetland application #228 submitted by En-Consultants, Inc.
on behalf of Strong's Marine Center to construct retaining wall
and backfill. ~pproval is recommended on the condition that all
dredging done be at least 6 feet from existing spartina grass.
RESOLVED to recommend to the Southold Town Trustees approval
of the wetland application #229 submitted by Carlo DeGaudenzi to
construct bulkhead and install floating dock, ramp and maintenance
dredge. Ole Jule Lane, Mattituck.
RESOLVED to recommend to the Southold Town Trustees approval
of the wetland application #230 submitted by Latham Sand and Gravel
Inc, for Bess Pulitzer to repair bulkhead. Conditional approval
given providing any excavated areas where there is spartina grass
the grass must be replaced.
RESOLVED to recommend to the Southold Town Trustees approval
of the wetland application #231 submitted by Eh-Consultants for
Stephen Shilowitz to replace existing bulkhead, dredge existing
upland to 10' below MLW with spoil to be placed on adjacent upland.
Install new bulkheading and floats. End of Sixth Street, Greenport.
RESOLVED to recommend to the Southold Town Trustees approval
of the wetland application ~232 submitted by Eh-Consultants, Inc.
for Ludwig Becker-Hunt to construct timber dock consisting of fixed
elevated catwalk, ramp and float. Construct timber retaining wall
and returns. Jockey Creek, Southold.
RESOLVED to recommend to the Southold Town Trustees approval
of the wetland application #233 submitted by Tosca Holding and
Realty Corporation to build groin. Huckleberry Hill, East Marion.
RESOLVED to recommend to the Southotd Town Trustees approval
of the wetland application #234 submitted by Charles H. Thomas to
install a dock, Gardiners Bay, East Marion.
RESOLVED to recommend to the Southold Town Trustees approval
of the wetland application #235 submitted by John S. Tessier to
maintenance dredge providing they do not deposit the spoil on
the east side, must be put on the west bank. Inlet to Spring Pond
from Orient Harbor, East Marion.
RESOLVED to recommend to the Southold Town Trustees approval
of the wetland application #236 submitted by Port of Egypt Ent., Inc.
C & L Realty, Incorporated to maintenance dredge along waterfront
at Port of Egypt Marine and C & L Realty (formerly Southold Fishing
Station). Greenport.
RESOLVED to recommend to the Southold Town Trustees approval
of the wetland application #237 submitted by En~Consultants, Inc.
for John Newman to replace timber bulkhead and backfill. Remove
and replace pilings. Remove existing bulkhead and build new bulk-
head. Dredge basin. Install hinged ramp and floats. Install
rip-rap along deteriorated bulkhead. Sailor's Needle, Mattituck.

TRUSTEE BREDEMEYER: Notice is hereby given that public hearings will
be held by the Board of Town Trustees of the Town of Southold, at
the Southold Town Hall, Main Road, Southold, New York, on Wednesday,
December 26, 1984 on the following applications for permits under
the provisions of the Wetland Ordinance of the Town of Southold, to
commence at 8:00 P.M.
In the matter of the application of Charles H. Thomas to construct
a dock structure on property located at 306 Trumans Path, East
Marion.
TRUSTEE SMITH: Is there any one in the audience that has anything
to say on this application? This is your time to speak for or against
this application.
MR. CHARLES THOMAS: Yes, if I may, I'm Charles Thomas. I just want
to correct the address a little bit. It's Trumans Path, 306 is
my box number, not that it doesn't get to me.
TRUSTEE SMITH: Thank you. Is there any one else who wishes to be
heard? (No response.) I move that we close this hearing.
TRUSTEE KUJAWSKI: I'll second that.

NOTICE OF NO SIGNIFICANT EFFECT ON THE ENVIRONMENT
Dated: November 27, 1984
Pursuant to Article 8 of the Environmental Conservation Law
State Environmental Quality Review and 6NYCRR Part 617, Section
'617.10 and Chapter 44 of the Code of the Town of $outhold, notice
is hereby given that the Southold Town Trustees, as lead agency
for the action described below, has determined that the project,
which is unlisted will not have a significant effect on the
environment.
DESCRIPTION OF ACTION
Application of Charles H. Thomas to install a dock on property
located at 306 Trumans Path, East Marion, New York.
The project has been determined not to have a significant
effect on the environment for the following reasons:
An environmental assessment has been submitted whioh indicated
that no significant adverse effect to the environment are likely to
occur should the project be implemented as planned.
Because there has been a response from the Southold Town
Conservation Advisory Council indicating that this project would
not have a significant effect to the environment.
Because there has been no response in the alloted time from the
New York State Department of Environmental Conservation and the
Southold Town Building Department, it is assumed that there are no
objections nor comments from those agencies.
