The following action was taken by the Southold Town Board of Trustees at their Regular
Meeting held on Wed., June 20, 2012:
WHEREAS, SUSAN FARRELL & EDWARD D. FUSCO applied to the Southold Town
Trustees for a Transfer of Wetland Permit #289 from Diana Tendler to Susan Farrell &
Edward D. Fusco, as issued on April 24, 1986, and an Amendment to Wetland Permit
#289 under the provisions of Chapter 275 of the Southold Town Code, the Wetland
Ordinance of the Town of Southold, application dated May 4, 2012, and,
WHEREAS, said application was referred to the Southold Town Conservation Advisory
Council and to the Local Waterfront Revitalization Program Coordinator for their findings
and recommendations, and,
WHEREAS, the LWRP Coordinator recommended that the proposed application be
found Inconsistent with the Local Waterfront Revitalization Program policy standards,
specifically with Policies 5 - Protect and Improve Water Quality in the Town of Southold,
and Policy 6 - Protect and restore the quality and function of the Town of Southold
ecosystem, and,
WHEREAS, the Board of Trustees has furthered Policies 5 and 6 of the Local
Waterfront Revitalization Program to the greatest extent practical through the imposition
of the following Best Management Practice requirement: the installation of a 10' wide
non-turf buffer along the landward side of the bulkhead, and,
WHEREAS, the structure complies with the standards set forth in Chapter 275 of the
Southold Town Code, and,
WHEREAS, the Board has determined that the project as proposed will not affect the
health, safety and general welfare of the people of the town,
NOW THEREFORE BE IT,
RESOLVED, that for the mitigating factors and based upon the Best Management
Practice requirements imposed above, the Board of Trustees deems the action to be
Consistent with the Local Waterfront Revitalization Program pursuant to Chapter 268-5
of the Southold Town Code, and,
BE IT FURTHER,
RESOLVED, that the Southold Town Board of Trustees APPROVES the Transfer of
Wetland Permit #289 from Diana Tendler to Susan Farrell and Edward D. Fusco, as
issued on April 24, 1986, and,
BE IT FURTHER,
RESOLVED, that the Southold Town Board of Trustees APPROVES the Amendment to
Wetland Permit #289 to include the as-built +/-50 sf. kayak shed along the landward
side of the bulkhead; remove two (2) fallen trees and backfill uprooted area against
landward side of bulkhead with clean sand +/-1 cf; remove +/~ four (4) hollowed out
trees; and remove brush, poison ivy and dead branches along east side of property,
with the Condition of a 10' wide non-turf buffer along the landward side of the bulkhead,
and as depicted on the site plan prepared by Costello Marine Contracting Corp. dated
June 29, 2012 and project plan dated May 2, 2012, stamped approved on July 3, 2012.

The following action was taken by the Board of Trustees at their
regular meeting held on April 24, 1986 regarding the wetland application
no. 345 on behalf of Diana Tendler.
Moved by Trustee Goubeaud seconded by Trustee Krupski
WHEREAS, John H. Geideman on behalf of Diana Tendler applied to the
Southold Town Trustees for a permit under the provisions of the Wetland
Ordinance of the Town of Southold, application dated January 22, 1986,
and
WHEREAS, said application was referred to the Southold Town Conservation
Advisory Council for their findings and reco~m~endations and
WHEREAS, a Public Hearing was held by the Town Trustees with respect
to said application on April 24, 1986 at which time all interested
persons were given an opportunity to be heard, and
WHEREAS, the Board members have personally viewed and are familiar with
the premises in question and the surrounding area; and
WHEREAS, the Board considered all testimony and documentation submitted
concerning this application; and it is noted for the record that there

Transfer of Wetland Permit #289 from Diana Tendler to Susan Farrell & Edward d. Fusco, as issued on
April 24, 1986, and to Amend Wetland Permit #289 to include the as-built +/- 50 sr. kayak shed along
landward side of bulkhead; remove two (2) fallen trees and backfill uprooted area against landward side
of bulkhead with clean sand +/- 1 cf.; remove +/- four (4) hollowed out trees; and remove brush, poison

The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of
Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards.
Based upon the information provided on the LWRP Consistency Assessment Form submitted to this
department, as well as the records available to me, it is my recommendation that the proposed action is
INCONSISTENT with the Policy Standards and therefore is INCONSISTENT with the LWRP
The dimensions of the kayak shed are unclear. A setback has not been identified.
The plan lacks a vegetative buffer. If the action is approved to further Policy 5: Protect and
Improve Water Quality in the Town of Southold and Policy 6; Protect and Restore the Quality
and Function of the Town of Southold Ecosystem it is recommended that a landscaped buffer
(15') is required landward from the bulkhead.
LANDSCAPED BUFFER -- A land area of a certain length and width which is planted with
indigenous, drought-tolerant vegetation similar to that found within the immediate proximity of
the parcel. Vegetation shall be installed in sufficient densities to achieve 95% ground cover
within two years of installation. Survival of planted vegetation shall be 90% for a period of three
years. Maintenance activities within the buffer are limited to remowng vegetation which is
hazardous to life and property, trimming tree limbs up to a height of 15 feet to maintain
viewsheds, replanting of vegetation and establishing a four-foot-wide access path constructed of
pervious material for access to the water body. [Added 12-15-2009 by L.L. No. 15-2009]
Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its
written determination regarding the consistency of the proposed action.

proposed actions that are subject to the Town of Southold Wafarfront Consistency Review Law. This

Fusco's name. I am also requesting to modify this permit to allow the removal of eight trees and
brush located behind the existing bulkhead then backfill the area. The current owners would also
like to legalize an "as built" kayak shed.
Please note the existing fence on top of the bulkhead will be removed.
I have enclosed a copy of permit #289, a layout of the existing kayak shed, a tree removal

The validity of this permit is or may be subject to the approval of other' governmental or municipal
authorities. The Town accepts no responsibility in applying for or obtaining such approval. In the
event that such approval is necessary, the holder of this permit shall not commence operations here-
under until such approval has been obtained in writing. The failure to obtain such other approval when
required shall subject this permit to immediate revocation by the TrL~stees upon receipt by the
Trustees- of written notice from such other governmental or municipal authorities of its refusal or
disapproval.
The applicant does by the acceptance of this permit, assume all responsibility for operations under-
taken pursuant to this permit, and shall take all precautions for the prevention of injuries to persons
and property resulting from such operations. By such acceptance, the applicant also agrees to indemni-
fy and save harmless the Town, and its officers, agents and employees from any and all claims arising
from operations under this permit and any and all acts or omissions of applicant, his agent and
employees.
The applicant and the owner and occupants of the premises upon which the operations authorized by
mis permit are being conducted, do, by the acceptance of this permit, give consent to the Town, and
its o[fiuu~s a.-~d employees to enter upon the premises where such opurations are being conducted to
make such inspections as the Town may deem necessary to insure that such operations are being con-
ducted in conformity with this permit.
This operation will not substantially:
A. Adversely affect the wetlands of the town.
B. Cause damage from erosion, turbidity or siltation. -
C. Cause saltwater intrusion into the fresh water resources of the town.
D. Adversely affect fish, shellfish or other beneficial marine organisms, aquatic wildlife and ve~te-
tation or the natural habitat thereof.
E. Increase the danger of flood and storm-tide damage.
F. Adversely affect navigation on tidal waters or the tidal flow of the tidal waters of the town.
G. Change the course of any channel or the natural movement or flow of any waters.
H. Weaken or undermine the lateral support of other lands in the vicinity.
I. Otherwise adversely affect the health, safety and general welfare of the people of the town.

Dear Mr. Geideman:
The following action was taken by the Board of Trustees at their
regular meeting held on April 24, 1986 regarding the wetland application
no. 345 on behalf of Diana Tendler.
Moved by Trustee Goubeaud seconded by Trustee Krupski
WHEREAS, John H. Geideman on behalf of Diana Tendler applied to the
Southold Town Trustees for a permit under the provisions of the Wetland
Ordinance of the Town of Southold, application dated January 22, 1986,
and
WHEREAS, said application was referred to the Southold Town Conservation
Advisory Council for their findings and recommendations and
WHEREAS, a Public Hearing was held by the Town Trustees with respect
to said application on April 24, 1986 at which time all interested
persons were given an opportunity to be heard, and
WHEREAS, the Board members have personally viewed and are familiar with
the premises in question and the surrounding area; and
WHEREAS, the Board considered all testimony and documentation submitted
concerning this application; and it is noted for the record that there
has been no public opposition; and
WHEREAS, the Board has determined that the project as proposed will
not affect the health, safety, and general welfare of the people of
the Town,
NOW, THEREFORE, BE IT
RESOLVED, that John H. Geideman on behalf of Diana Tendler be and hereby
is qranted permission to remove the existinq bulkhead and replace in
kind in place a 102 lin. ft. bulkhead on property located on the North
side of Pipes Cove at the foot of Ninth Street, Greenport, with the
provision that no fill is placed behind the bulkhead as stated by the
aqent. This permit is qranted under the provisions of the Wetland
Ordinance of the Town of Southold. This permit will .~x~ire on April
24, 1987 if work has not commenced by same. There are two inspections
required and the Trustees are to be notified upon completion of tha
work.

There is a $5.00 Wetland Inspection fee which is due and payable,
upon remittance, your permit will be forwarded by mail.
