Dear Judy:
The Trustees made a site inspection for the 'work
proposed for Mr. Anthony Tamburrino, 85 Watersedge Way,
Bay Haven, Southold. The Trustees were in agreement
that the proposed bulkhead is actually a retaining wall
to be placed above the OHWM.
It was the opinion o£ the Board of Trustees that a
Wetland Permit was not necessary for this project.

Dear George:
I have been advised by Mr. Edward Hindermann of the Southold Town
Building Department that there are definitely wetlands on the above
captioned property.
However, he states that he is unable to make a determination as to
whether or not the proposed bulkhead will be on wetlands due to the
fact that the site plan as submitted contains no dimensions of setback
of this proposed construction from property lines.
In view of this fact, he suggests that it would be helpful if the
contractor were to stake the property showing the exact location of
proposed bulkhead and returns so that a determination may be made.

Dear Mrs. Terry:
Mr. Lessard has asked me to determine if a wetlands
permit is necessary for proposed bulkhead for the above.
I visited the site today. There is considerable
erosion to the upland area adjacent to beach. It would
appear that bulkhead is necessary to prevent further
erosion.
It is difficult to make a determination from site plan
submitted since there are no dimensions of set back of
this construction from property lines. In view of this it
would be helpful if the contractor were to stake the pro-
perty showing exact location of proposed bulkhead and returns
so that a determination may be made.

It has come to the attention of the Town that you a.-e
preparing to construct a groin and timber bulkhead on your
property on the south side of Watersedge Way, Southold.
Since the bulkhead will be upland of the high water
mark, you must apply to the Town Board for a Wetland
Permit. I am enclosing herewith the necessary forms which
must be accompanied by a $50.00 filing fee. The Town
permit must be issued prior to commencing construction.

We are writing on behalf of Mr. and Mrs. Tamburrino
in response to your letter to them dated January 6, 1984
in regard to a proposed groin and bulkhead at their property
in Bay Haven.
The bulkhead is going to be constructed well upland of ·
the high water mark on their own property and will not touch
any wetlands at all. They have also decided not to proceed
with the groin. Therefore, we take exception to the letter
from your office stating that the Tamburrino's will have to
secure a Wetland Permit. · ·
Enclosed for information is a copy of the proposed plans
and also a copy of your January letter.

to assist in your review.
The decision whether to issue a permit will be based on an evaluation of
the probable impact including cumulative impacts of the activity on the
public interest. That decision will reflect the national concern for both
protection and utilization of important resources. The benefit which
reasonably may be expected to accrue from the activity must be balanced
against its reasonably foreseeable detriments. All factors which may be
relevant to the activity will be considered including the cumulative
effects thereof; among those are conservation, economics, aesthetics,
general environmental concerns, wetlands, cultural val. ues, fish and
wildlife values, flood hazards, flood plain values, land use, navigation,
shoreline erosion and accretion, recreation, water supply and conservation,
water quality, energy needs, safety, food production amd, in general, the
needs and welfare of the people.
ALL COMMENTS REGARDING THE PERMIT APPLICATION MUST BE PREPARED IN WRITING
AND MAILED TO REACH THIS OFFICE BEFORE THE EXPIRATION DATE OF THIS NOTICE,
otherwise it will be presumed that there are no objections ;:o t~e activity.
Any person may request, in writing to the district engineer, before this
public notic.: uxpzres, that a public hearing be held to collect information
necessary to consider this application~ Requests for public: hearings shall
state, with particularity, the reasons why a public hearing should be held.
It should be noted that information submitted by mail is considered Just as
carefully in the permit decision process and bears the same weight as that
furnished at a public hearing.

Pursuant to Section ? of the Endangered Species Act (16 U,S.C, 1531) and
based upon a review of the latest published version of the threatened and
endangered species listing, a preliminary determination is that the
activity under consideration will not affect those species listed or their
critical habitat.
Based upon a review of the latest published version of the Hational
Register of Historic Places, there are no known sites eligible for or
included in the Register within the permit area. Presently unknown
archeological, scientific, prehistorical or historical data may be lost by
work accomplished under the required permit.
Reviews of activities pursuant to Section 404 of the Clean Water Act will
include application of the guidelines promulgated by the Administrator,
U.S. Environmental Protection Agency, under authority of Section 404(b) of
the Clean Water Act and the applicant will obtain a water quality
certificate or waiver from the appropriate state agency in accordance with
Section 401 of the Clean Water Act prior to a permit decision.
Pursuant to Section 307(c} of the Coastal Zone Management Act of 1972 as
amended (16 U.S.C. 1456(c)), for activities under consideration that are
located within the coastal zone of a state which has a federally approved
coastal zone management Program, the applicant has certified in the permit
application that the activity complies with and will be conducted in a
manner that is consistent with the approved state coastal zone management
program. By this pablic notice, we are requesting the state's concurrence
with, objection to, or waiver of the applicant's certification. No permit
decision will be made until one of the~e actions occur. For activities
within the coastal zone of New York State, the applicant's certification
and accompanying information is available from, and any comments on, should
be addressed to the New York State Department of Stats, Division of Local
Government and Community Services, Coastal Management Program, 162

DESCRIPTION OF WORK
The applicant, Mr. Anthony Tamburrino, has requested Department of the Army
authorization to construct a timber goin in Hog Neck Bay, Little Peconic
Bay at 85 Watersedge Way, Southold, Suffolk County, New York, to prevent
erosion of the upland property.
The proposal would entail the construction of a 50 linear foot timber groin
extending approximately 1 to 2 feet below mean low water.
It should be noted that the proposed bulkhead shown on the attached drawing
would be constructed above the mean high water line for which the Corps
of Engineers has no jurisdiction.

INSTRUCTIONS FOR PERMIT
A. This application is to be completely filled in by typewriter or ink and submitted to the Town
Clerk in quadruplicate, accompanied by written permission from the owner of the property if not
the some as the applicant.
B. Pilot Plan must be drawn to scale on the reverse side of this application showing the location
of property, the names and locations of owners of adjoining properties, and a detailed description
of proposed /~roject. (Note: Copies of the Pilot Plan may be made by a copy machine and attached
to the Permit Application.) ._- ~_.-
C. No operation shall be initiated by the applicant until all permits that are required are issued.
D. A detailed statement of the rehabilitation and proposed condition of the premises after the'
work is completed must be given, including a survey if required.
E. If permit is being sought for o more sizeable excavation than the construction of a private
single dock or jetty, then this application must be accompanied by a survey and topographical map
certified by a registered land survey or Professional Engineer. The horizontal control of survey
shall be based upon an approval local coordinate system. The vertical control for elevation and sound-
ings shall be based upon United States Coast and Geodetic Survey and/or United States Geological
Survey datum.
F. A statement must accompany the application describing any known prior operations conducted
on the premises in question and whether any prior licenses or permits have been issued to erect
structures or to dredge or deposit fill on said premises and whether any such permits or licenses
were ever revoked or suspended by a governmental agency.
G. A filing fee of $50.00 shall accompany the application. This filing fee includes one inspection,
there is a $5.00 fee for each additional inspection.
H, The Town Board upon request of f_he applicant for a permit, may waive in ~hoJe or in part,
the provisions of Article II, Section 97-21subdivisions(D) and(g) where it finds that nature of the
proposed operations ore such that the requirements of such provisions ore not necessary for a
proper consideration of o permit application.
Upon approval of this application the Town Clerk wfll issue a permit to the applicant. Such
