Clerk in quadruplicate, accompanied by wrltter* permission from the owner af the property if l~ot

B. Pilot Plan must be drawn to scale on the reverse .-ida of this application showing the location
of property, the names and locations of owners of adjoining prope,ies, and a detailed description
of proposed prelect. (Note: C~,pies of the Pilot Plan may be mode by o copy machine and attached
1o the Permit Application.)
C. No operation shall be initiated by the applicant until all permits that are required ore issued.
D. A detailed statement of the rehabilitation and proposed condition of the premises after the'
work i.' completed must be given, Including a survey if required.
E. If permit is being sought for a more sizeable excaval'ion than the construction of a private
$inple dock or jetty, then this application must be accompanied by a survey and topographical mop
certified by a registered land survey or Professional Engineer. The horizonta) control of survey
shall be based upon an approval local coordinate syStem. 'l'he vertical control for elevation and sound.

On ~otion made by Trustee Cochran seconded by Trustee Bredemeyer
it was
RESOLVED to APPROVE the application of Robert H. Rothman to
maintenance dredge a boat basin to remove silt and sand that
accumulated from normal tidal action and excessive action from
the recent storm in Jockey Creek, Southold. Spoil is to be
trucked to approved upland site.

LAND USE COMPANY FOR GEORGE SWEENY -
In the matter of the application for Land Use Company on behalf
of George Sweeny to maintenance dredge an existing boat slip to
provide 3' of depth at MLW and to install a 25' section of
timber bulkhead with two 3' returns to prevent further siltation
of an existing boat slip in Haywater Cove, Cutchogue. Trustee
Bredemeyer stated that the site had been inspected on May 23, 1984
and questions were raised with the possibility of constructing
a timber bulkhead and filling behind it and to extend the dock
out into the water to give the required depth for the docking of
a boat and as such feel if unnecessary as proposed. Trustee Smith
continued and explained that with the bulkhead, digging in front,
and filling behind that the trustees see it as separate operations.
On motion made by Trustee Bredemeyer seconded by Trustee Cochran
it was
RESOLVED to separate the applications Deny the application to
construct the bulkhead and approve the maintenance dredging with
the provision that nothing deeper than 2' below MLW all fill to
be trucked to approved upland site and replanting of the marsh
fringe on the north side of the slip.

RESOLVED to recommend to the Town Board to separate the applications

a deck and float 15' x 15' with a ramp to connect to an existing
float and the installation of a 20' x 6' float, project is'located
on the west side of a canal off Jockey Creek and on the east side
of Wells Ave. Southold, with the provision that a permit will not
be issued until the applicant submits a wetland application.

NOTICE OF NO SIGNIFICANT EFFECT ON THE ENVIRONMENT
Dated: September 11, 1984
Pursuant to Article 8 of the Environmental Conservation Law
State Environmental Quality Review and 6NYCRR Part 617, Section
617.10 and Chapter 44 of the Code of the Town of Southold, notice
is hereby given that the Southold Town Board, as lead agency for
the action described below, has determined that the project, which
is unlisted will not have a significant effect on the environment.
DESCRIPTION OF ACTION
Application of George Sweeny for a Wetland Permit to maintenance dredge an
existing boat slip to provide 2 ft. of depth at MLW, at the end of Mason Drive,
on Haywater Cove, Cutchogue, New York.
The project has been determined not to have a significant effect
on the environment for the following reasons:
An environmental assessment has been submitted which indicated
that no significant adverse effect to the environment are likely to
occur should the project be implemented as planned.
Because there has been a response from the Board of Southold
Town Trustees and Southold Town Conservation Advisory Council indicating
that this project would not have a significant effect to the environment.
Because there has been no response in the allotted time from the
New York State Department of Environmental Conservation and the South01d
Town Building Department, it is assumed that there are no objections nor
comments from those agencies.

A detailed description and plans of the applicant's activity are inclosed
to assist in your review.
The decision whether to issue a permit .will be based on an evaluation of
the probable impact including cumulative impacts of the activity on the
public interest. That decision will reflect the national concern for both
protection and utilization of important resources. The benefit which
reasonably may be expected to accrue from the activity must be balanced
against its reasonably foreseeable detriments. Ail factors which may be
relevant to the activity will be considered including the cumulative
effects thereof; among those are conservation, economics, aesthetics,
general environmental concerns, wetlands, cultural values, fish and
wildlife values, flood hazards, flood plain values, land use, navigation,
shoreline erosion and accretion, recreation, water supply and conservation,
water quality, energy needs, safety, food production and, in general, the
needs and welfare of the people.

AND MAILEO TO REACH THIS OFFICE BEFORE THE EXPIRATION DATE OF THIS NOTICE,

public notic.: expires, that a public hearing be held to collect information
necessary to consider this application. Requests for public hearings shall
state, with particularity, the reasons why a public hearing should be held.
.It should be noted that information submitted by mail is considered just as
carefully in the permit decision process and bears the same weight as that
furnished at a public hearing.

Pursuant to Section 7 of the Endangered Species Act (16 U.S.C. 1531) and
based upon a review of the latest published version of the threatened and
endangered species listing, a preliminary determination is that the
activity under consideration will not affect those species listed or their
critical habitat.
Based upon a review of the latest published version of the National
Register of Historic Places, there are no known sites eligible for or
included in the Register within the permit area. Presently unknown
archeological, scientific, prehistorical or historical data may be lost by
work accomplished under the required permit.
Reviews of activities pursuant to Section 404 of the Clean Water Act will
include application of the guidelines promulgated by the Administrator,
U.S. Environmental Protection Agency, under authority of Section 404(b) of
the Clean Water Act and the applicant will obtain a water quality
certificate or waiver from the appropriate state agency in accordance with
Section 401 of the Clean Water Act prior to a permit decision.
Pursuant to Section 307(c) of the Coastal Zone Management Acg of 1972 as
amended (16 U.S.C. 1456(c)), for activities under consideration that are
located within the coastal zone of a state which has a federally approved
coastal zone management program, the applicant has certified in the permit
application that the activity complies with and will be conducted in a
manner that is consistent with the approved state coastal zone management
program. By this p~blic notice, we are requesting the state's concurrence
with, objection to, or waiver of the applicant's certification. No permit
decision will be mede until one of these actions occur. For activities
within the coastal zone of New York State, the applicant's certification
and accompanying information is available from, and any comments on, should

DESCRIPTION OF WORK
The applicant, George Sweeny, has requested Department of the Army
authorization to maintenance dredge with upland disposal in Haywater Cove,
Little Peconic Bay at Cutchogue, Town of Southold, Suffolk County, New York.
The proposed work would entail the dredging of an existing 25 foot by
35 foot boat basin to provide three feet of depth at mean low water.
The dredging would provide a 2 on 1 slope beginning approximately four
feet waterward of the edge of the marsh in the entire project area.
Approximately 100 cubic yards of sand would be removed utilizing a crane
with clam shell and disposed of approximately 400 feet landward of the boat
slip on the applicant's upland property on the north side of his house.
In addition, the applicant proposes to plant ~partina alterniflora plantings
between the lines of mean low and mean high water in the area surrounding
the existing fixed pier. The purpose of the pFopos~d work is to provide
~deqate depth for mooring and.shoreline stabilization, respectively.
