Dear Mr. Bredemeyer,
1, 1990
Attached is a survey of the proposed subdivision,
Sundance Shores. On it, I have indicated the approximate
location of the upland area and the suggested location for
the osprey nesting pole recommended in my report dated
October 20, 1990.
The Trustees may want to require the osprey nesting
pole siting its location narratively as on the westerly
extent of the upland area situate northwest of the Long
Island Railroad Tracts and southeast of the LILCO Power
Lines.

Dear Mr. Bredemeyer:
We received a report from your environmental
consultant, however, it did not specify whether our
project was out of the wetlands and was acceptable.
After contacting him ourselves, a second report was
issued. I have received a copy of this report and
have no objections to his recommendations.
We have been waiting since May for approval of
a sketch plan. There were numerous delays between
the referrals to the Conservation Board and your
department and your environmental consultant. I know
this is not your fault, but we have been before the
Planning Board now for over a year and have not even
received sketch plan approval.
I have mortgages due on this property and must
have approval soon. Would it be possible to schedule
a special meetinq on this map?
Anything you can do will be greatly appreciated.

Sundanc Shores - Subdivisionii
Town of Southold
Situate at Arshamomaque
s/o Albertson Lane
w/o Main Road Rte. 25
n/o Long Island Railroad Tracts
Description: Subject parcel contains a variety of habitats
including an actively farmed field, oak woods~ early
successional fields, freshwater wetlands and tidal wetlands.
In general, the actively farmed fields which are planted
with a cover crop at this time are found extending
southwards from Albertson Lane to a series of berms which
are vegetated mostly with the common cane, phragmites. Also
adjacent to Albertson Lane, a freshwater wetland is found.
The freshwater wetland consists of a dug pond surrounded by
thick vegetation including the obligate wetland plant,
buttonbush. Oak woodlands are found in the eastern portion
of the property and adjacent to the Main Road and The Long
Island Railroad, the western portion of the property
adjacent to lands now or formally Yaxa and Cassidy, and also
within an area surrounded by tidal wetlands.
The actual abundance and diversity of flora found within the
freshwater wetlands of the dug pond is quite limited because
slopes surrounding the pond are steep. Pond levels are
maintained by overland runoff including road runoff from
Albertson Lane. The following plant species were identified
in the freshwater portion of the site:
Buttonbush
Northern arrowood
Common winterberry
Green brier
Cepha}anthus occidentalis
Viburnum dentatum
Ilex verticillatum
Smilax rotundifolia
The following plants were isdentified in the adjacent
area to the freshwater wetland:
Fiat-top goldenrod
Queeen Anne's lace
Ragweed
Red raspberry
Blackberry
Euthamia graminifolia
Daucus carota
Ambrosia artemesilfolia
Rubus idaeus
Rubus allegbeniensis
475 Rambler Road, Southold, NY 11971 (516) 765-4071
Tartarian honeysuckle
Common privet
Smooth sumac
New York fern
Groundsel bush
Lonicera tatarica
Ligustrum vulgare
Rhus glabra
Thelypteris noveboracensis
Baccharis halimnifolia
The following plants were identified in the oak woods
portions of the site located adjacent to the Long Islanc
Railroad and Route 25 and on the western prtion of the
parcel and in adjacent areas to tidal wetlands:
Red Oak
White Oak
Red Cedar
Flat-top goldenrod
Black locust
Northern bayberry
Red maple
Fox grape
Black cherry
Cane grass
Mamosa
Blackberry
Quercus rubra
Quercus alba
Juniperus virgininana
Euthamia graminifolia
Robinia preudo-acacia
Myrica pennsylvatica
Acer rubrum
Vitis lambrusca
Prunus serotina
Phragmites communis
exotic
Rhubus alleghensiensis
The tidal wetlands portion of the site is both
extensive and contains the classic successional vegetative
characteristics. Large stands of low marsh cordgrass are
found along the water-s edge extending inland in some cases
several hundred feet. Its upland limits are sharply defined
by the occurrence of slat meadow grass. Adjacent to the
stands of salt meadow grass forming its upland limits are
groundsel bush and phragmites which dominate the vegetative
covertype. The following plants were identified in the
tidal wetlands found on site:
Low marsh cordgrass
Salt meadow grass
Spike grass
Groundsel bush
Cane grass
Spartina alternifolia
Spartina patens
Distichis spicata
Baccharis halimifolia
Phragmites communis
An effort was made to determine the presence of the
northern harrier, osprey and bald eagle all of which were
regarded as potentially present by the applicant's
consultant, Dr. Robert Johnson. None of the above mentioned
species were found on site. In addition, no osprey nor
northern harrier nests were found on site.
475 Rambler Road, Southold, NY 11971 (516) 765-4071
Recommendations
1- The overall development concept for this project
appears to be sound because the greatest intensity of
development is placed on the farmland portion of the site.
The farmland is considered the least sensitive habitat found
on site.
2- The freshwater wetland as indicated on the survey
appears to be accurately represented in terms of its size
and shape. Flags have been placed in the field depicting
the wetlands boundary. However, the size of the pond is
essentially the size of the wetlands because of the steep
slopes rising from the pond's shoreline and the abrupt
change in vegetative covertype.
3- While the freshwater wetlands is not considered
overly sensitive, it appears to contain permanent standing
water and thus should be protected. It is therefore not
advisable to utilize the pond as a drainage area for the
proposed road.
4- I find the tidal wetlands line as depicted on the
survey prepared by Roderick Vantuyl as amended April 12,
1990 to be adequate for the purposes of subdivision design
and recommend that the Southold Board of Trustees accept
said line.
5- I recommend that building envelopes showing a
minimum of 75 feet between the envelope and wetlands line be
placed on the survey prepared by Roderick Van Tuyl as
amended April 12, 1990 for lots 9, 10, 11, 12, 13, 17 and
18.
6- I recommend that a building envelop showing a
minimum of 50 feet between said envelop and the freshwater
wetland be placed on the survey prepared by Roderick Van
Tuyl as amended April 12, 1990 for lot #1.
7- It is recognized that lots 15, 16, 17, and 18 have
been zoned for Light Industrial. Thus, the eventual
development of these lots will likely require site plan
approval from the Planning Board. In the eventual
processing of these site plans, special attention should be
paid to potential runoff impacts to the wetlands because of
a mosquito ditch which is located on or near the parcel
475 Rambler Road, Southold, NY 11971 (516) 765-4071
boundary to the Long Island Railroad. Any pollutants that
are washed into this ditch will likely be directly
discharged into the wetlands and surface waters of
Arshamomaque Pond. The mosquito ditch extends onto or close
to Lot 18. It is recommended that the use of berms on Lot
#18 be considered in the eventual site plan review as a
means of insuring on site control of stormwater runoff.
8- Given the size of the tidal wetlands and the
biological productivity of Arshamonaque Pond, the presence
of the osprey is regarded as potential. Since the osprey is
known to accept artificially constructed raised platforms
inwhich to build their nests, the Southold Board of Trustees
may consider to have a platform erected as a means of
providing nesting habitat for the osprey. Should the
Trustees require or make such a recommendation, it is
advisable that the nesting platform be erected on the
western portion of the small upland island which is
surounded by tidal wetlands and located on the southwestern
portion of the site approximately 300 feet northwest of the
Long Island Railroad.

Dear Mr. Banks,
Please be advised that wetlands on the above referenced
subdivision have been flagged. In all, 124 flags were
placed in the field. The freshwater pond and wetlands near
Albertson Lane is represented by eight flags (numbered 1
through 8). Flags 8 through 107 have been placed along the
larger tidal wetland edge. Flag number 8 is found on the
western edge of the property. Flags are more easily seen
looking from the tidal marsh areas landward. Lastly, flags
108 through 124 are found along an area of upland vegetation
which is surrounded by tidal wetlands.
Please inform the Southold Board of Trustees prior to
surveying the property. The environmental review shall be
prepared shortly.

Bruce Anderson

We have filed for a major subdivision under the name of Sundance

The p~ocess has been extremely slow and we are in a lot of
trouble if we don't get Planning Board approval soon because we
can't get necessary bank financing. This is a critical item. I
wonder if the Planning Board can move this along a little more

Hashamomuck Pond - Cassidy Lane
Routh 25 in Southold
Dear Mr. Banks:
I have visited the above property on several OCCasions during the
summer and fall of 1989 in regard to tidal wetland boundaries.
I arranged with Mr. Charles Hamilton of the N.Y.S.D.E.C. to use
the boundary as it appears on the tidal wetlands map of the area
rather than go to the expense of locating the upland-wetland
boundary I flagged using normal survey methods. We agreed to
keep all land modifications east of the western boundary of the
recently plowed potato field. We also agreed that a buffer area
of bare plowed field would be free from structures and would be
landscaped to be attractive to wildlife and to provide a partial
screen between the proposed development and the vegetated area
between the plowed field and Hashamomuck Pond.
This bare field is bounded on the south toward the L.I.R.R. R.O.W.
and Route 25 by old fields (abandoned for agriculture 5~ years ago)
and hardwood borders or hedgerows. These old fields support a
diverse and rich population of deer mice, moles, shrews, meadow
voles and cottontail rabbits. The wooded strips support deer mice
and grey squirrels. These small mammals are a food source for
various preditors including raptors (hawks and owls) that are rare,
endangered or of special concern.
The presence of the pond and its adjacent salt marshes and salt
marsh border community add to the wildlife value of the old fields
on this property and adjacent to it on the south. While there are
no freshwater wetlands or even temporary ponds on or near the
property and rare, endangered or species of special concern are
limited to birds, some of those birds will most probably use
the vegetated portion of the property.
There are no habitats suitable for the nesting of birds such as
the least tern or piping plover. However, least turns can be
expected to feed occasionally on Hashamomuck Pond. The main
interaction will involve raptors including short-eared owls,
red-tailed hawks, harriers (marsh hawks), ospreys, perhaps even
an occasional bald eagle and a number of other hawks and owls.
These birds will be attracted to the old fields, wetlands and
pond by the small mammal prey species present there and the
accessibility of those small mammals to feeding raptors.
This situation will change in time as various trees appear in
the old field and they become typical Long Island oak or oaK-
hickory forests. While your use of the bare potato field has
little or no impact on the adjacent old fields, tidal marshes
or pond, it would be very beneficial to the raptors that use
the latter area if these old fields were mowed every couple of
years. This would keep them as old field habitats and of some
use to raptors; particularly during their migrations. Too many
of these old fields are maturing into forests, even on public
lands, and as they disappear, so will all but the woodland hawks
and owls.
I don't know how much of the old field habitat you control, but
I would ask that you get together with the Town of Southold to
maintain as much of it as possible on this site. I would also
suggest that you place at least 2 osprey nesting platforms along
the wetland border along the west side of your property bordering
the pond. I can supply you with the specifications or you could
cooperate with the Nature Conservancy. This is a really good
osprey nesting site. Ospreys would be an interesting addition
to your development and enough of a buffer exists so that
development of the bare field would not impact even nesting
ospreys.
I believe you should submit the aerial photograph with this report
and your EAF to the town. It should be obvious from that photo-
graph that the plowed field is barren and of no use to wildlife
other than a few common seed-eating birds.
The presence of residential units on that bare field will not
significantly impact the wildlife on the adjacent wetlands and
old fields. The discontinuance of the use of herbicides and
insecticides and the use of so much ground water for irrigation
is a positive effect. The disturbance of farming right up to
- 2 -
the old field and wetland boundaries is probably similar to
disturbances related to the construction and occupation of
the proposed homes. The hawks and owls, including the endangered
and rare specie~ will continue to feed because there is a good
food supply.
I would conclude by asking you to consider trying to maintain the
adjacent old fields by occasional mowing and that you consider
building the osprey nesting platforms. If you restrict your
development to the bare field and plant a vegetative buffer along
its edge, I can foresee no significant impacts on wildlife except
for the mildly positive ones I mentioned.
Sincerely,
Robert W. Johnson, Ph.D.

Dear Mr. Harris:
Mr.
We have
Shores.
Banks and I own a tract of land just West of Greenport.
filed for a major subdivision under the name of Sundance
The p~ocess has been extremely slow and we are in a lot of
trouble if we don't get Planning Board approval soon because we
can't get necessary bank financing. This is a critical item. I
wonder if the Planning Board can move this along a little more
quickly. All I am asking for is fair treatment, not preferential
treatment.
Thank you.
Very truly yours,
RICHARD PELLICANE
