Trustees had a long discussion with neighbors living in
this area, over the location of your dock.
It is the opinion of the Board of Trustees that the
proper location for your dock will be in front of your
home. We are therefore, granting your permit for this
dock in accordance with that concept. The Cedar Beach
Association is in full agreement with the location there.
A permit has been sent to your contractor along with

This office received a complaint today. It was in
reference to the property that Maureen Sullivan wants to
use, to erect her dock on. The complaint was in regard
to the ownership of the property.
I, therefore, would appreciate your indicating on this
map, exactly where the dock will be placed. This will,
hopefully, make locating this structure much clearer, thus
resolving this complaint.
Please remit this map before December 7th. The Board
of Trustees will be meeting on the same evening. This will

INSTRUCTIONS FOR P[RMIT
A. This application is to be completely filled in by typewriter or ink and submitted to the Town
Clerk in quadruplicate, accompanied by writter' permission from the owner of the property if not
the same as the applicant.
B. Pilot Plan must be drown to scale on the reverse ~ide of this application showing the location
of property, the names and locations of owners of adjoining properties, and a detailed description
of proposed project. (Note: Capias of the Pilot Plan may be made by a copy machine and attached
to the Permit Application.)
C. No operation shall be initiated by the applicant until ali permits that ore required are issued.
D. A detailed statement of the rehobiJltctian and pro, posed condition of the premises after the'
work is completed must be given, inciuding a survey if required.
E. If permit is being sought for a more sizeable excavation Ihan the construction of a private
single dock or jetty, then this application must be cccampanled by a survey and topographical map
certified by a registered land survey or Professional Engineer. The horizontal control of survey
shall be based upon an approval local coordinate system. The vertical control for elevation and sound-
ings shall be based upon United States Coast and Geodetic Survey and/or United States Geological
Survey datum.
F. A statement must accompany the application describing any known prior operations conducted
on the premises in question and whether any prior licenses or permits have been issued to erect
structures or to dredge or deposit fill on said premises and whether any such permits or licenses
were ever revoked or suspended Dy a governmental agency.
G. A filing fee of $25.00 shall accompany the application. This filing fee includes one inspection.

H. The Town Board upon request o~ .~Lge applicant for a permit, may waive in whom or in part,
the provisions of Art/cie II, Sectio~'~-~', /subdivisions ¢/~ and ~rwhere it finds that nature of the

Subject: Application of Maureen Sullivan,Cedar Beach,
Southold
Gentlemen:
A few weeks back Maureen Sullivan applied to the
Southold Town Trustees for a permit to place a dock and
ramp in Cedar Beach Creek~ Southold.
At that time we checked the location and found it
to be no problem.
However, unknowingly to us, the location was changed
prior to the hearing. The new location presents a problem.
Unfortunately, since we did not know of the change, we
did not object at the hearing and the Trustees have grant-
ed a permit for the new location.( 3x15 ramp, 6x18 float)
It appears the new location will cause the dock and
any boat tied to it to block the channel. The width of
the inlet at this point is about fifty feet with a thirty
foot channel in the center. A fifteen foot ramp with a
six foot dock and a vessel with a six foot beam would
extend into the center of the channel and prohibit safe
navigation of the channel.
We have a vessel with a ten foot beam and would not
have access to the open sea under these conditions.
We are not trying to prevent Mrs Sullivan from having
a dock, however, possibly she could either move the dock
northward around the bend a little or tie her vessel right
up close to land so that the channel would remain open.
We are currently discussing this problem with her
engineer to attempt to arrive at a location suitable and
safe for all concerned.
However, we would like to go on record as opposing
any docks or floats that block channels or prevent safe
access to and from the open sea.
We would also like to formally request to be listed
as "interested parties" and be notified of all applications,
changes, hearings, etc., regarding this matter.

The Board of Directors of the Cedar Beach Park
Association has approved the request of our member,
Maureen Sullivan to construct a ramp and float in Fair-
haven Inlet at Cedar Beach.
The ramp and float must be c~tiguous to the North
side of the association roadway known as Inlet Way, and
be located close enough to the high water mark so as not
to impede marine navigation in Fairhaven Inlet at mean
low tide. The dimensions of the float should be approxi-
mately 5' x 10'

This application has been approved with the provision that a letter f~
from the Property Owners Association, giving permission to do the
work is submitted.
Also, no permit will be issued until the fees are paid. If
work starts before the permit is issued, then you are in violation.
3. If your application is approved above, a Permit Fee is now due, and
should be made payable to the order of the Board of Southold Town
Trustees. This fee is computed below according to the Schedule of
Rates as set forth in the Instruction Sheet (Form I/1). This fee must
be paid within 90 days or reapplJcation and additional fee will be

NOTICE OF NO SIGNIFICANT EFFECT ON THE ENVIRONMENT

Pursuant to Article 8 of the Environmental Conservation Law
State Environmental Quality Review and 6NYCRR Part 617, Section
617.10 and Chapter 44 of the Code of the Town of Southold~ notice
is hereby given that the Southold Town Board~ as lead agency for
the action described below~ has determined that the project, which
is unlisted will not have a significant effect on the environment.
DESCRIPTION OF ACTION
Application of The Land Use Company on behalf of Maureen Sullivan
for a wetland permit. Permission is requested to construct ramp~ float~
and two (2) spiles on Cedar Beach Inlet on property located at end of
Inlet Way~ Cedar Beach~ Southold~ New York.
The project has been determined not to have a significant effect
on the environment for the following reasons:
An environmental assessment has been submitted which indicated
that no significant adverse effect to the environment are l£kely to
occur should the project be implemented as planned.
Because there has been a response from the Board of Southold
Town Trustees and Southold Town Conservation Advisory Council indicating
that this project would not have a significant effect to the environment.
Because there has been no response in the allotted time from the
New York State Department of Environmental ConserVation and the Southold
Town Building Department~ it is assumed that there are no objections nor
comments from those agencies.

Dear Mr. Stoutenberg and Members of the Board of Trustees:
We have learned that Maureen Sullivan has applied for permission
to build a ramp on Inlet Way and a floating dock in Fairhaven
Inlet.
The enclosed sketch sent by the Army Corps of Engineers shows that
Mrs. Sullivan received permission from the "owners", The Cedar Beach
Association. The Cedar Beach Association does not own Inlet Way.
It cannot grant such permission. It is a membership of homeowners
who cooperate in the maintenance of their common roadways. This is
the purpose for which the group was formed.
When Map 90 was drawn in 1927, Inlet Way was drawn across the
northern boundaries of lots 95, 94, and 93 to create and ingress
and egress for lot 92, the easternmost lot. In 1940, Williams
purchased lot 92 and the eastern half of 93. In 1941, he purchased
the western half of 93 with lots 94 and 95. With these lots now one
parcel, Williams built his house on part of 92, 93 and the farthest
corner of Inlet Way. They also constructed the gate to demarcate
their private way.
We have copies of deeds that detail the function and title to
Inlet Way.
Inlet Way does have importance to any owner of this parcel because
it provides the only access to the property. Erosion over the years has
forced the driveway around that portion of Inlet Way that has fallen
into the creek.
We cannot permit the construction of a permanent structure on Inlet
Way because it will obstruct our legally intended drive. It may even
be necessary in the future to reinforce that northern boundary to
prevent further deterioration of Inlet Way by natural erosion and
increased boating activity.
There are also safety and liability problems that could result.
We cannot take that responsibility.
The access to Fairhaven Inlet is east of the northern boundary of
Inlet Way above lot 95, and south of Olga Lee's property. Our neighbors
have moored their boats in the creek for many years. We have permitted
them to throw mushroom anchors and to plant stakes above the high water
line to secure their boats. There are seven boats there now.
Mrs. Sullivan is a new neighbor and I am sure she was simply mis-
informed as to the function and power of The Cedar Beach Association.
She is of course welcome to tie her boat along the creek too.
