Distribution - Construction Suffolk county Water Authority 4050 Sunrise Highway Oakdale, NY 11769 RE: Brushes Creek SCTM #1000-127-8-10,11,12 Dear Mr. Burns: The following action was taken by the Southold Town Board of Trustees at their regular meeting of Thursday, February 25, 1993: Whereas the Suffolk County Water Authority made an application to the Southold Trustees to cross Brushes Creek with water service to our associates, the people of Southold on October 22, 1992. Whereas along with said application was tendered a fee in the amount of $250 dollars. Whereas the Trustees acknowledge the Suffolk County Water Authority as a purveyor of water in Southold Town. Whereas the Trustees are empowered by the NYS laws of 1893 to regulate the Town Waters. Whereas the waters of the Town may eventually flow through the equipment of the Suffolk County Water Authority benefitting our associates, the inhabitants of Southold Town. Resolved the Southold Town Trustees refund and waiver fees from the $250.00 according to the following schedule: $100.00 - excess fee paid on the Town Wetland Permit application $115.00 - fee waived on the wetland application ($35.00 being retained by the Town Trustees for inspection fees in relation to our waters and wetlands) TRUSTEES John M. Distribution - Construction Suffolk County Water Authority 4050 Sunrise Highway Oakdale, New York 11769 RE: SCWA - Water Main Extension - Brushes Creek The following action was approved by the Southold Town Board of Trustees at their regular meeting of January 28, 1993: RESOLVED, that the Southold Town Board of Trustees authorize it's President to execute the aerial easement over Brushes Creek, prepared by Steven Angel, dated January 28, 1993. RESOLVED, that the Southold Town Board of Trustees grants a waiver of the requirements set fourth in 97-21 (G) and (J) of the Town Code. (Waiver of 2' contours). RESOLVED that the Southold Town Board of Trustees approves waiver of 97-21 (B): Wherein, the proposed action will not contravene or effect any of the items in Section 97-28 (standards of the Wetland Ordinance), provided: 1. Ail excess materials resulting from the excavation and installation of a water main along Peconic Bay Boulevard in the vicinity of Brushes Creek shall be removed from the construction site and deposited in a suitable upland location. 2. Upon completion of excavation, water main installation and road repair, the adjacent road shoulders shall be stabilized by low maintenance turf to prevent any long term erosion impacts to wetlands, bottom lands and surface waters. 3. Haybales and silt fence shall be installed in accordance with the plans prepared by Steven Burns, P.E. as submitted with the application for wetlands permit prior to construction activities and no excavated materials ~ncluding construction materials shall be permitted to enter wetlands and surface waters. Haybales and silt fences shall remain in place until turf becomes established in adjacent road shoulders. 4. The continuous liability insurance shall be maintained. If work is not completed by the April 1, 1993 expiration date, the policy will need to be extended in order for the work to continue. The new main will be installed in the asphalt traveled way of Great Peconic Bay Boulevard approximately 4 feet from the grass edge. The trench will be approximately 4'-0" wide and 4'-9" deep. All excavated material, sand and loam, will be placed on the asphalt traveled way. A hay bale and silt screen barrier will be installed as shown on the attached drawings prior to any construction. In the event groundwater is encountered, a trench pump with a capacity of no more than 30 gallons per minute will be used. The water will be pumped behind hay bale and silt screen barrier to eliminate infiltration of sediment into stream water. A Water Authority inspector will be present at all times to oversee the installation of the water main and that all speci- fications are adhered to. Also, if rain should occur, all work will cease. All trenches will be backfilled, stabilized and returned to their original condition. Excess fill will be removed from site and disposed of in a legal manner. t, . P~qOJECT I.D. The material of the water main which will be installed consists of ductile iron. Ductile iron has the strength properties of steel, and is a structurally superior water pipe, therefore, the chance of a break is minimal. However, in the event of a break, it is part of the Authority's operations to have a twenty-four hour emergency dispatcher on duty, and personnel in the field able to respond to emergencies. Personnel will be directed to shut off the main as soon as a call is made to the dispatcher. Water main shut off valves will be located on either side of the bridge to isolate a break in this area. After the main is shut down, an evaluation will determine what type of repair has to be made, and the proper repair crew will be called. The amount of time to make a final repair depends on many variables such as the day of the week, time of day, and the extent of the repair. However, all repairs are made as expeditiously as possible, and will be made in the same construction manner as the original installation of the main. Hopefully, this answers all your questions. A combination of hay bale and silt screen fence shall be installed as shown on previously submitted installation drawings. The trench excavation shall consist of a trench approximately 4'-0" wide and 4'-9" deep. All excavated material shall be placed in the paved road area. This excavated material shall be backfilled into the trench within hours of the water main installation, with all surplus material either being hauled away from the job site that same day, or temporarily stockpiled out of the limits of the wetlands. Also, the trench area shall be paved with temporary asphalt the same day as the original excavation. PROJECT DESCRIPTION The purpose of this project is to install water main in the Laurel area to provide domestic water and fire protection for public use. The new main will be installed in the asphalt traveled way of Great Peconic Bay Boulevard approximately 4 feet from the grass edge. The trench will be approximately 4'-0" wide and 4'-9" deep. All excavated material, sand and loam, will be placed on the asphalt traveled way. A hay bale and silt screen barrier will be installed as shown on the attached drawings prior to any construction. In the event groundwater is encountered, a trench pump with a capacity of no more than 30 gallons per minute will be used. The water will be pumped behind hay bale and silt screen barrier to eliminate infiltration of sediment into stream water. A Water Authority inspector will be present at all times to oversee the installation of the water main and that all speci- fications are adhered to. Also, if rain should occur, all work will cease. Your agency's response to these items will complete the wetland permit application process. As a proposed activity in the adjacent upland the Trustees may consider a waiver of the need for a Town Wetland Permit if they "find and determine that the activities comply with the standards of the Wetlands Ordinance". A waiver is automatically a Type II action pursuant to the Towns Environmental Quality Review Act so that the requirements of SEQRA shall be considered met if a waiver is granted. Property Obligations of the Trustees As the owners/managers of waters and lands under water we will need to negotiate and conclude an aerial easement over said properties which are subject to the rights of navigation. Our special counsel Mr. Stephen Angel, Esq. is best equipped to help in this regard and I would con~nend you to have your attorney(s) contact him directly, for direction on preparing papers for the Board of Trustees to execute. Protection of Surface Waters and Lands Underwater Related to both our wetland permit needs and our governmental obligations as Trustees is the need to confirm that in conducting the activities you propose you shall protect and hold us harmless against any acts or ommissions which might adversely affect our waters and lands underwater now and in future at this site. Kindly provide us with proof of insurance which would be satisfactory to our attorneys as well as provide us with a brief description of the response time and method(s) of handling a break in the water main should one ever occur adjacent to or over Brushes Creek. Ms. Jessup contacted SWCA and was informed that her home could be connected within a day once approval is received from the Southold Town Trustees. (2) A review of the EAF submitted by the applicant fails to recognize the necessity to obtain a wetlands permit from the Trustees. The EAF should be amended accordingly. (3) The remaining portions of the EAF provide adequate information for initial review. (4) The Trustees should request the submission of copies of all other permit applications. To my knowledge, no other "Involved Agency" has been designated "Lead Agency" in this matter and the required coordination has not apparently taken place. (5) A field inspection of the project area, revealed a potential impact to wetlands resulting from trenching and stockpiling of materials which may result in erosion and siltation to adjacent wetlands and bottomlands. While the applicant generally describes the use of haybales and/or silt fences, greater attention should be focussed on this potential impact and its mitigation.
