TERMS .',nd CONDITIONS The Permit'tee residing at N.Y., as part of the consideration for the issuance of the Permit does understand and prescribe to the fol- lowing: 1. That the said Board of Trustees and the Town of Southold axe released from any and all damages, or claims for damage, of suits arising dil'~ctly or indirectly as a result of any oper- ation performed pursuant to this permit, and the said Permittee wiif, at his o~ her own expense, defend an), and all such .suits initiated by ttfird parties, and the s~id Permittee assumes full liability with respect thereto, ~o the complete exclusion of the Board of Trustees of the Town of c :'hold 2. That this Permit is valid for a period of mOs. which is considet~l to r~e the estimated time required to complete the work involved, but should drcumstances warrant, request for an extension may be made to the Board at a later date. 3. That this Permit should be retained indefinitely, or as long as the said Permittee ~es to maintain the structure or project involved, to provide evidence to anyone concerned that auth- nrization was originally obtained. 4. That the work involved will be subject to the inspection and approval of the Board or its agents, and non-compliance ~4th the provisions of the originating application, may be cause for re~ ,,cation of this Permit by resolution of the said Board. 5. That there will be no unreasonable interference with na,4g'ation as a result of the work herein authorized. 6. That there shall be no interference with the right of the public to pass and repass along the beach between high and Io~, water marks. 7. That ff future operations of the Town of Southold require the removal and,.'or alterations in thc location of the work herein authorized, or if, in the opinion of the Board of Trusxees, the work shall cause unreasonable obstrucuon to free navigation, the said Permittee will be tequired, upon due notice, to remove or alter this work or project herein stated without expeuses to the Town of Southold. 8. That the said Board will be notified by the Perminee or the completion of the ~,,,tk auth- or~ed. 9. That the Permittee will obtain all other permits and cousents *.hat may be required sup- plemental to this permit which may be subject to revoke upon failure to obtain same. Principal Civil Engineer Division of Waterways Suffolk County Dept. of Public Works Yaphank, N.Y. 11980 Dear Mr. Eisensctuneid: Please be advised that your applications for maintenance dredging for creeks in the Town of Southold were approved at a regular meeting of the Southold Town Trustees held on May 17, 1976. Enclosed herewith, please find a permit, together with a covering letter for each project. In the suggestions offered with the enclosed permits, we realize the difficulties involved in obtaining permits from all the various agencies. However, we feel if these changes can be made without undue delay or expense, it would be much more beneficial to the areas and we believe more acceptable to the residents of the various areas. Perhaps in future applications for dredging, if you could let us know before any surveying is undertaken on these mainten- ance projects with regard to disposal areas, we could be of assistance in determining a more lasting result by having the spoil placed in the most favorable location.
