SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was not required to be referred to the Suffolk County Department of Planning under the Suffolk County Administrative Code Sections A 14-14 to 23. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIPTION: The subject property is a conforming 133,778 square foot (3.071 acres) parcel located the Agricultural Conservation Zoning District(A-C). The northerly property line measures 422.32 feet, the easterly property line measures 314.66 feet and the southerly property line measures 428.75 feet and the westerly property line measures 315.00 feet and adjacent to Horton Lane. The parcel is improved with a 1 %story frame house and garage. There is a deck at the rear of the dwelling and an in-ground swimming pool located in the rear yard near the southern location of the property which is enclosed by a 4 ft. chain link fence. On the northern side of the property is a 24.2 ft. by 16.4 ft. barn. There is another single-car garage located in the rear northeast area of the property along with a 10.2 ft.by 8.4 ft. shed. In the far northeast coiner of the lot is a seasonal metal hoop and plastic green house and another small green house. The property is enclosed by 8 ft. deer fencing on all sides and a dense property line hedge row is in the front yard with no signs of deer damage as shown on the survey map prepared by Donald J. Metzger, LS, and dated October 27, 2021. BASIS OF APPLICATION: Request for Variance from Article XXII, Sections 280-1051)(4); and the Building Inspector's January 10, 2022 Notice of Disapproval based on an application for a permit to legalize and "as built" deer fence at; 1)deer fencing is prohibited in or along the front yard of any property; 4960 Horton Lane, Southold, NY. SCTM#1000-54-3-21.4. RELIEF REQUESTED: The applicant requests a variance to legalize an "as built" deer fence at 4960 Horton Lane, Southold,NY. SCTM#1000-54-3-22.4. The"as built"deer fence is not permitted pursuant to Article XXII Section 280-105D(4), which states "Deer fencing is prohibited in or along the front yard or primary front yard of any property. The as built deer fencing is located in the front yard. s Page 2, May 19,2022 #7625,Verveniotis SCTM No. 1000-54-3-21.2 ADDITIONAL INFORMATION: The applicant has 8 ft. deer fencing on all sides of his property and has also fenced the adjoining parcel to the north that is owned by the applicant's daughter and has no primary residence on the vacant lot. The applicant has fruit trees and vegetables/row crops planted on his property which produce he donates to members of his church. The applicant is not a designated bona fide agricultural operation and is not eligible for an agricultural exemption. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on May 5, 2022 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law&267-b(3)(b)(1). Grant of the variance will produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The subject property is a large lot with a single-family dwelling that is setback far from the road. Vegetables and other row crops are planted in the rear yard and already fenced. There is a small grove of fruit trees on the property and several accessory structure.Grant of the variance as applied for will produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. An 8 foot. high deer fence in the front yard is out of character for and not permitted in agricultural/residential zone districts unless the parcel is actively farmed as a bona fide agricultural operation. The subject property is not a farm operation,although the applicant is engaged in harvesting fruit and row crops which he donates to his church Some of the properties in the neighborhood are actively farmed and enclosed with deer fencing,those that are also developed with a dwelling on the property do not have deer fences in the front yards of their residences, including the farm directly across from the subject property. Although some other residences in the area have deer fencing on their properties,the fencing is located along code confirming side and rear yards. However,grant of alternative relief for deer fencing in the front yard will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties because the front yard setback for deer fencing approved herein will meet the code required minimum principal front yard setback for residences in the zone district; and will be screened from view of the street by the existing evergreen hedgerow. And will protect the small orchard of fruit trees and row crop planted on the property 2. Town Law&267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance because he cannot legally have deer fencing in his front yard as of right. However, the applicant can still protect the fruit bearing trees on his property through alternative relief that permits deer fencing in a front yard that is located at the code required principal front yard setback of 60 feet from the front property line. 3. Town Law§267-b(3)(b)(3). The variance request is mathematically substantial,representing 100%relief from the code. However, the alternative relief granted herein recognizes that, although the applicant is not a bona fide farm operation, he is engaged in the cultivation of fruit trees and vegetables on his property that he donates to others which benefit would be lost without some protection from deer damage. 4. Town Law §267-b(3)(b)(4). Granting a variance as applied for in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood as described above in Town Law One. However, the alternative relief granted herein will have minimal to no impact on adjacent properties or the street or the character of the neighborhood as described above, since a large dwelling could be built with a 60-foot front yard setback which would have a far greater visual and environmental impact than deer fencing. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6.Town Law§267-b. Grant of the requested relief IS NOT the minimum action necessary and adequate to enable the applicant to enjoy the benefit of deer fencing in the front yard while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Weisman (Chairperson), seconded by Member Acampora, and duly carried,to DENY as applied for, and GRANT ALTERNATIVE RELIEF for eight (8) feet high deer fencing to be setback a minimum of 60 feet from the front property line. SUBJECT TO THE FOLLOWING CONDITIONS 1. To avoid damage to the existing evergreen hedge along the front property line,the applicant shall cut down the existing"as built" 8 feet high deer fence in the hedgerow to a conforming four feet in height. 2. The 8 feet high front yard deer fencing on the vacant adjacent lot to the west shall be removed entirely. 3. The existing hedgerow along Hortons Lane must be continuously maintained. This approval shall not be deemed effective until the required conditions have been met.At the discretion of the Board of Appeals,failure to comply with the above conditions may render this decision null and void That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. Before applying for a building permit the applicant or agent must submit to the Board of Appeals for approval and filing, two signed and sealed original final surveys conforming to the alternative relief granted herein. The ZBA will forward one set of approved, stamped drawings to the Building Department. Failure to follow this procedure may result in the delay or denial of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals. In the event that this is an approval subject to conditions, the approval shall not be deemed effective until such time that the foregoing conditions are met; and failure to comply therewith will render this approval null and void. The Board of Appeals may, upon written request prior to the date of expiration, grant an extension not to exceed three (3) consecutive one (1) year terms. The applicant maintains his home on the property but has planted over 50 fruit trees and various other ornamental shrubs. The owner also maintains a large vegetable garden with a secondary deer fence enclosure. These annual vegetables are protected from the deer, but the fruit trees can not be protected without a deer fence along the property line. The deer fence was installed several years ago, and the owner simultaneously planted an evergreen hedge which is over 8' feet in height. The evergreen hedge runs along the front property line. The fence has become imbedded in the evergreens and removal of the deer fence is likely to damage the evergreens. From the street the deer fence is not visible. The property, from the . street, appears to be heavily landscaped. The closest neighbor (north).is the applicant's daughter's vacant parcel which is used for agriculture and the property to the south was previously owned by the applicant's son but was sold after his son passed away. The neighbors also maintain a deer fence to protect their properties. There are mature evergreens along all the property lines and the deer fence is screened from view. The 3 acres are surrounded by mature vegetation, fruit trees, specimen shrubs, and agricultural row crops (vegetable garden). The applicant built his house in 1988 and has invested many hundreds of thousands of dollars over 34 years to plant on the property. An Agricultural use has been maintained on the property and protected from damage only due to the deer fence. (2) The benefit sought by the applicant CANNOT be achieved by some method feasible for the applicant to pursue, other than an area variance, because: The applicant maintains agricultural uses on the property r-- 1 which he wishes to protect from deer damage. The deer fence may be in a front yard and is exempt from code if the property is "engaged in bonafide agricultural production". The applicant has greenhouses and agricultural storage buildings for the agricultural uses on his three-acre parcel. In addition, he also uses the adjacent parcel owned by his dauthter for agriculture. The planning board created these oversized parcels (exceeding 2 acres) for the possible agricultural `14he II ,,''(,�� homeowners. "Bonafide Agricultural Production" is not a defined term in the Southold Zoning ordinance, it is a term used for agricultural tax exemption purposes. Because the property is improved with a residence the Assessors would not apply a tax exemption to this parcel, nevertheless the agricultural use is not dependent on the tax assessment. The applicant maintains in total 6 acres with agricultural production. (3) The amount of relief requested is not substantial because: the deer fence can not be seen. It is completely engulfed by the evergreens. When the owner consulted with a landscaper on removing the fence, he was advised that heavy equipment would need to be used to remove the deer fence with the evergreens. The evergreens would be permanently damaged and likely require removal with the deer fence. (4) The variance will NOT have an adverse effect or impact on the physical or environmental conditions in the neighborhood or district because: The land is zoned for agriculture and the surrounding properties are active agricultural uses. The deer which have become a nuisance to agriculture are prevented from entering the surrounding farms by their deer fence, and the deer would have unincumbered access to the applicant's property. The deer would destroy the owner's significant agricultural investment. (5) Has the alleged difficulty been self-created? (X)Yes, or ( )No. the deer fence was installed by the owner. Since the neighboring property(farm) has a deer fence,the owner similarly installed a deer fence to protect his property.
