Tetrault and Kim M. Randall PROPERTY LOCATION: 4650 Horton Lane, Southold,NY. SCTM#1000-54-2-21.2 SEORA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type 11 category of the State's List of Actions, without further steps under SEQRA. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 thru A14-25, and the Suffolk County Department of Planning issued its reply dated January 19, 2022 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIPTION• The subject property is a 131,769 square foot(3.25 acres)conforming parcel located in the Agricultural Conservation(A-C)Zoning District.The northerly property line measures 428.75 feet and the easterly property line measures 303.21 feet and the southerly property line measures 448.32 feet and the westerly property line measures 143.76 feet and is adjacent to Horton Lane. The parcel is improved with a one- and one-half story frame residence with decking on the west and north sides of the residence. There is a rear yard small deck with stairs to a concrete patio.There is a two-car frame garage located in the northeast corner of the rear yard. The property is totally enclosed with 8 ft. high deer fencing with electric wood gates in the front of the property as shown on the survey map prepared by Donald J. Metzger, LS and dated October 27, 2021. BASIS OF APPLICATION: Request for Variance from Article XXII, Sections 280-1051)(4); and the Building Inspector's January 10,2022 Notice of Disapproval based on an application for a permit to legalize an"as-built"deer fence at; 1)deer fencing is prohibited in or along the front yard or primary front yard of any property; located at 4650 Horton Lane, Southold,NY. SCTM#1000-54-3-21.2. RELIEF REQUESTED: The applicant requests a variance to legalize and "as built deer fence" located at 4650 Horton Lane, Southold,NY. SCTM#1000-54-3-21.2. The"as built"deer fence is not permitted pursuant to Article XXII Section 280-1051)(4),which states: "Deer fencing is prohibited in or along the front yard or primary front yard of any property." The deer fencing is located in the front yard. Page 2,May 19,2022 #7625,Tetrault SCTM No. 1000-54-3-21.2 ADDITIONAL INFORMATION: The applicant's property is totally enclosed by 8 ft. deer fencing. The fencing on both sides and rear of the property conform to the Town Code. The 8 ft. fence located in the front yard does not conform to the Town Code. There is a dense natural row hedge planted in the front of the deer fence in the front yard. Although the parcel is located in an Agricultural Zoning District, with permitted uses of single-family dwellings and agricultural operations pursuant to Section 280-13A of the Town Code, the applicant is not using the parcel for farming. The applicant has stated that they enjoy gardening but are not farming the lot. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on May 5, 2022 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence, the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law $267-b(3)(b)(1). Grant of the variance will produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The subject property is planted with mature ornamental shrubs and perennial flowers primarily in the front yard. An 8 foot. high deer fence in the front yard is out of character for and not permitted in agricultural/residential zone districts unless the parcel is actively fanned.Although some of the area farms that are developed with a dwelling have deer fencing, they do not have deer fences in the front yards of their residences, including the farm directly across from the subject property. Although some other residences in the area have deer fencing on their properties, the fencing is located along code conforming side and rear yards. 2. Town Law &267-b(3)(b)(2). The benefit sought by the applicant can be achieved by some method, feasible for the applicant to pursue, other than an area variance. The dense, high hedge row in front of the deer fence along Horton Lane is healthy and has not been damaged by deer. The two relatively low existing wooden entry gates can remain, thereby blocking cars and deer from entering the property and protecting the privacy and security of the owner/applicant. The existing deer fencing in the front yard located along the front property line and the southerly side yard can be moved without disruption to the hedgerow to a conforming location that will protect the rear yard behind the existing house where fruit producing trees and row crops can be planted and maintained in conformance with the code. The portion of the deer fencing located in the applicant's front yard along the northerly side yard is on the adjacent neighbor's property which is planted with fruit trees and row crops and is being farmed. 3. _Town Law X267-b(3)(b)(3). The variance request is mathematically substantial representing 100% relief from the code.. Though deer fencing is characteristic in the subject neighborhood because there are existing farms, eight- foot-high deer fencing is prohibited from the Town Code in the front yards unless the subject property is in agricultural production and the fencing is required to protect cash crops 4. _Town Law 4267-b(3)(b)(4). Approving this variance on a residential lot that is not in agricultural production will have an adverse impact on the physical or environmental conditions in the neighborhood. Granting this variance to protect landscaping from deer damage in a front yard would represent a major contradiction with the spirit and intent of the code and simply displace the deer population to other nearby properties. 5. Town Law &267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law§267-b. Grant of the requested relief IS NOT the minimum action necessary and adequate enable the applicant to enjoy the benefit of an "as built" deer fence while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community.
