SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23,and the Suffolk County Department of Planning issued its reply dated January 11,2022 stating that this application is considered a matter for local deternination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIPTION: The subject, non-conforming, rectangular-shaped, 11,250 square feet, (.258 acre) parcel in the R40 Zoning District measures 75.00 feet along Hobart Avenue then runs east 150.00 feet along a residentially developed lot to the south,then runs north 75.00 feet along two residentially developed lots to the east, then returns 150.00 along a fourth residential neighbor to north. The subject parcel is developed with a one- and one-half story frame house with four bedrooms,a roof over masonry entry porch,an enclosed rear porch,an accessory garage building, asphalt driveway, slate walkways and plastic fencing as shown on the survey prepared by Nathan Taft Corwin, III, Licensed Land Surveyor last revised October 26, 2021. BASIS OF APPLICATION: Request for Variances from Article 111, Section 280-15; Article XXIII, Section 280- 124; and Building Inspector's December 5, 2021, Amended December 29, 2021 Notice of Disapproval based on an application for a permit to demolish and construct an accessory garage and construct an accessory in-ground swimming pool at; 1) garage located less than the code required minimum side yard setback of 5 feet; 2) garage located less than the code required minimum rear yard setback of 5 feet; 3) more than the code permitted maximum lot coverage of 20%; located at 1255 Hobart Road, Southold, NY. SCTM No. 1000-64-2-9. RELIEF REQUESTED: The applicant requests a total of three variances. In order to demolish and build a new one- car garage measuring 20 feet deep by 17 feet wide(for a total of 340 square feet)with a finished height of 17.10 feet, the applicant seeks two variances: each variance requested is for a reduced side and rear yard setback of 3 feet where the code requires a minimum side or rear yard setback of 5 feet. Additionally,the applicant proposes the installation J Page 2, May 19,2022 #7623, Rothwell SCTM No. 1000-64-2-9 of an inground swimming pool measuring 16 feet by 26 feet for an additional 416 square feet of lot coverage,creating total lot coverage of 23.5% where the code limits lot coverage in the R40 Zoning District to 20%. All as shown on signed and stamped architectural plans and elevations for the accessory garage, labeled Drawing 1 of 1, prepared by Ray Doner, Registered Architect, dated October 25, 2021. ADDITIONAL INFORMATION: Despite not illustrating the septic location or dry-well for pool dewatering on the survey, the applicants stated they will install a compliant dry well should relief be granted. Furthermore, they indicated that the on-site wastewater system is located on the north side of the dwelling and the pool will be placed in excess of the required 25 feet distance from it. The applicant added that they will install shrubbery for additional privacy on the north side of the house along the lot line. No prior relief from the Zoning Board of Appeals has been granted or denied on this parcel. Multiple `form letters', in support of this application,were received from the applicant's friends and neighbors prior to the public hearing. No member of the public or immediate neighbor spoke in favor of or against this application. As part of the application, the applicant stated that they will remove the small shed from the rear of their property during the demolition of the present garage in order to accommodate the constriction of a larger, one-car garage which will allow interior storage of items presently maintained in the shed. While the new accessory garage will have electric for basic lighting, the applicant stated they are not proposing any plumbing, heating or cooling, or a half-bathroom. Improvements on the subject lot are covered by the following Certificate of Occupancy: Z-10743 dated October 29, 1991 covering a one family dwelling with accessory garage Z-42394 dated October 5, 2021 covering alterations and additions including a sunroom, covered entry and `as built' screened in porch and `as built' outdoor shower. The applicant provided Zoning Board of Appeals determinations in support of their application. Relative to the requested setback relief(from either a rear or side yard), variances include file #7564 for a 2.75 feet side yard setback; 47479 for a 4.4 feet side yard setback; #7112 for a 3.4 feet side yard setback. Relative to excessive lot coverage relief, variances include file#7608 for 25% lot coverage; #7547 for 23% lot coverage; #6935 for 27.3% lot coverage; #5888 for 22% lot coverage and#5101 for 23% lot coverage. The majority of the applicant's research in providing relief cannot be used in support of their application as the files cited are not specifically located in the immediate Founder's Landing area aiding in the determination of community character — a neighborhood in the hamlet of Southold well-known for high-density, older housing stock on non- conforming, smaller lots, where many properties have primary or accessory structures in potentially non-compliant locations or have potential excessive lot coverage.Almost all files cited are located in hamlets which do not meet the community character of the applicant's residence. Also, relative to `set back relief the files cited are for alteration to existing, non-conforming accessory structures, not new construction as the applicant proposes. Relative to excessive lot coverage,two files cited are actually for the same property and,in one case,file 97608 the determination is not in support of excessive lot coverage but rather a denial of it, upholding the code. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on May 5, 2022 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence, the Zoning Board finds the following facts to be true and relevant and makes the following findings: Page 3,May 19,2022 #7623, Rothwell SCTM No. 1000-64-2-9 1. Town Law X267-b(3)(b)(I). Grant of the two variances relative to reduced side and rear yard setback will produce and undesirable change in the character of the neighborhood or detriment to nearby properties. The applicant has stated that their present 1-car garage is over 50 years old and is beyond repair and will be demolished in order to make way for a new garage which will allow the added storage desired. While the current garage is located closer to the property line, at approximately Ifeet,than the proposed new garage at 3 feet, and there are other older existing accessory structures in the immediate area with non-conforming setbacks from property lines, the applicant has illustrated that despite the small size of the lot,a conforming garage can be built without the benefit of relief for both the side yard and rear yard setback of a minimum of 5 feet. Grant of the variance relative to the excessive lot coverage of 23.5% where a maximum of 20% is allowed, will not produce an undesirable change in the character of the neighborhood or detriment to nearby properties. The Founder's Landing neighborhood was developed at the start of the 20" century and offers a variety of housing styles and sizes on non-conforming, relatively small lots. As such, it is common to find residences with or without accessory structures that exceed maximum lot coverage of 20%. There are no known new accessory garages in the immediate area that do not conform to the present code. 2. Town Law 067-b(3)(N(2). The benefit sought by the applicant, relative to the construction of a new single-car garage can be achieved by some method feasible for applicant to pursue other than an area variance. The applicant can build a conforming garage in a compliant location, meeting the 5 feet rear and side yard setbacks. However,the applicant cannot install an inground swimming pool, measuring 16 feet by 26 feet, without the benefit of area variance. 3. Town Law &267-b(3)(b)(3). The variances requested herein are mathematically substantial, representing 40% relief from the code relative to reduced rear and side yard setbacks and 17%relief from the code relative to excessive lot coverage. It is not common in the Founder's Landing neighborhood, to find new accessory garages in other than compliant locations. However, excessive lot coverage is common among improved properties in the immediate area either as a result of alterations to an existing residence or accessory structure or,as in this application,the installation of an inground swimming pool,which is becoming a common residential amenity throughout the Town of Southold. 4. Town Law §267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law &267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law §267-b. Grant of the requested relief relative to the demolition and new construction of an accessory garage measuring 17 feet by 20 feet with a total height of 17.10 feet is not the minimum action necessary and adequate to enable the applicant to enjoy the benefit of an accessory one-car garage while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. Grant of the requested relief relative to the installation of an inground swimming pool measuring 16 feet by 26 feet, creating total lot coverage of 23.5% where a maximum of 20% lot coverage is allowed, is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of an inground swimming pool while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B,motion was offered by Member Planamento,seconded by Member Weisman(Chairperson), and duly carried, to DENY the two variances as applied for relative to the reduced side and rear yard setback at three (3) feet for the constriction of a new accessory garage, and Page 4,May 19,2022 #7623, Rothwell SCTM No. 1000-64-2-9 GRANT the variance as applied for relative to excessive lot coverage of 23.5% for the installation of an inground swimming pool and the architectural plans and elevations for the accessory garage, labeled Drawing 1 of 1,prepared by Ray Doner, Registered Architect, dated October 25, 2021. SUBJECT TO THE FOLLOWING CONDITIONS• 1. Evergreen screening shall be planted and continuously maintained along the northern lot line from the mid- point east to the rear-yard lot line. The present Leyland cypress trees along the eastern lot line are to be continuously maintained. 2. The Applicant shall submit a revised survey depicting the proposed new accessory garage in a code conforming location, as well as illustrating the installation location of the sanitary system and proposed dry-well prior to the issuance of a building permit for both the accessory pool and accessory garage. 3. The accessory garage six(6) inch eave (not foundation) is not to be located closer than 5 feet from the lot line. 4. Pool pump equipment/mechanicals must be located a minimum of 20 feet from any property line or be contained within the proposed accessory garage with a lot line set back that is in conformance with the bulk schedule for accessory structures. 5. Drywell for pool de-watering shall be installed. 6. The accessory shed is to be removed from the site prior to issuance of the Certificate of Occupancy for both the garage and the inground swimming pool. This approval shall not be deemed effective until the required conditions have been met.At the discretion of the Board of Appeals,failure to comply with the above conditions may render this decision null and void That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or apossible denial by the Building Department of a buildingpermit, and may require a new application and public hearing before the Zoning Board of Appeals. Any deviation from the variance(s)granted herein as shown on the architectural drawings, site plan and/or survey cited above, such as alterations, extensions, or demolitions, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or fixture use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. IMPORTANT TIME LIMITS ON THIS APPROVAL Pursuant to Chapter 280-146(B) of the Code of the Town of Southold any variance granted by the Board of Appeals shall become null and void where a Certificate of Occupancy has not been procured, and/or a subdivision map has not been filed with the Suffolk County Clerk, within three (3)years from the date such variance was granted. The Board of Appeals may, upon written request prior to the date of expiration, grant an extension not to exceed three (3) consecutive one Page 5, May 19,2022 #7623, Rothwell SCTM No. 1000-64-2-9 (1) year terms. IT IS THE PROPERTY OWNER'S RESPONSIBILITY TO ENSURE COMPLIANCE WITH THE CODE REQUIRED TIME FRAME DESCRIBED HEREIN. For those who wish to attend the meeting virtually, for health and safety reasons, we will continue via Zoom Webinar, as well. Therefore, the May 5, 2022 Zoning Board of Appeals Regular Meeting will be held BOTH in person in the Town Hall Meeting Room at 53095 Main Road, Southold AND via video conferencing (Zoom Webinar), and a transcript will be provided at a later date. The public will have an opportunity to see and hear the meeting live, and make comments. Below, please see instructions required to prepare for the ZBA public hearing which includes: PLEASE READ CAREFULLY. 1. Yellow sign to post on your property a minimum of seven(7) days prior to your hearing, to be placed not more than 10 feet from the front property line (within your property) bordering the street. If you border more than one street or roadway, an extra sign is supplied for posting on both street frontages. Posting should be done no later than April 27,2022.To avoid weather damage to your sign please affix it to a sturdy surface such as plywood. If your sign is damaged please call the office and we will provide you with another one. Prior to your public hearing, members of the Board of Appeals will each conduct a personal inspection of your property.
