SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23,and the Suffolk County Department of Planning issued its reply dated January 6, 2022 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIPTION: The subject property is a nonconforming 24, 951 sq. ft. lot located in an R- 40 Zoning District. The property has a road frontage that runs north along Arshamomaque Avenue for 75.47 feet, then runs east for 337.58 feet, the rear yard turns south for 77.39 feet before returning west 327.79 feet back to Arshamomaque Avenue. The property is improved with a one- and one-half story residence with a wood deck to the rear. There is also a shed in the rear yard and an open pergola in the front yard. All as shown on survey prepared by Kenneth M. Woychuk, L.S., dated April 19, 2021. BASIS OF APPLICATION: Request for a Variance from Article XXIII, Section 280-124; and the Building Inspector's November 12, 2021, Notice of Disapproval based on an application for a permit to legalize an existing wood deck with roof covering attached to a single-family dwelling,at; 1)located less than the code required minimum side yard setback of 15 feet; located at 405 Arshamomaque Avenue, Southold,NY. SCTM No. 1000-56-2-16. RELIEF REQUESTED: The applicant requests a variance to legalize an existing wood deck with a roof covering that is located 13.9 feet off the side property line where a minimum of 15 feet setback is required. ADDITIONAL INFORMATION: The existing residence has a certificate of occupancy dated January 21,2009, for a one-family dwelling with a rear deck and side entry deck. The existing front entry deck was re-built by a previous owner with slightly larger dimensions without a permit. As per the owner's testimony the rear shed that is located on the property line is to be moved to a conforming location. Page 2,May 19,2022 97617, Levi/Ceriello SCTM No. 1000-56-2-16 FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on May 5, 2002 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence, the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law§267-b(3)(b)(1). Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. A side entry deck has existed since the house was constructed. The new owners discovered that the previous owner rebuilt the deck with a covering and slightly enlarged it,thereby creating the current nonconformity. . Only a small portion of the covered deck actually violates the side yard setback as the house is sited on an angle to the property line and not parallel to it. The adjacent property is heavily wooded and the as built entry deck will have no visible impact on that property or on the street 2. Town Law X267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. Due to the fact that the covered deck is already existing, there is no feasibly option other than an area variance. 3. Town Law $267-b(3)(b)(3). The variance granted herein are not mathematically substantial, representing approximately 8 % relief from the code. However, a side entry deck has always existed on the house, so the enlarged deck with a covering is only a slight difference from the original conforming construction. Only a small portion of the deck violates the side yard setback as the house is angled and not parallel to the property line. 4. Town Law X267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code and conditions of this board. 5. Town Law §267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law §267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a covered side entry deck while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community, RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B,motion was offered by Member Weisman (Chairperson), seconded by Member Acampora, and duly carried, to GRANT the variance as applied for and shown on survey prepared by Kenneth Woychuk, Land Surveyor, dated April 19, 2021, and Architectural Plans prepared by David Turner, Architect, PC, dated September 10, 2021. SUBJECT TO THE FOLLOWING CONDITIONS• 1. The applicant must apply to the Building Department for a building permit for all "as built" improvements, including the 10.3 ft. by 13.3 ft. shed to be relocated in a code conforming location, and the pergola currently located in the front yard, within 90 days of the date of this decision and submit same to the Office of the Zoning Board of Appeals or submit a written request for an extension to the Board of Appeals setting forth the reason(s) why the applicant was unable to obtain a building permit in the time allotted. The applicant must obtain a Certificate of Occupancy from the Building Department for the "as built" improvement(s) including the 10.3 ft. by 13.3 ft. shed relocated in a code conforming location and the pergola currently located in the front yard and submit same to the Office of the Zoning Board of Appeals within 12 months of this decision or submit a written request for an extension to the Board of Appeals setting forth the reason(s) why the applicant was unable to obtain a Certificate of occupancy in the time allotted. 3. The "as built" covered deck shall remain open, unenclosed, and non-habitable. This approval shall not be deemed effective until the required conditions have been met.At the discretion of the Board of Appeals,failure to comply with the above conditions may render this decision null and void That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or a possible denial by the Building Department of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals. Any deviation from the variances) granted herein as shown on the architectural drawings, site plan and/or survey cited above, such as alterations, extensions, or demolitions, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. IMPORTANT TIME LIMITS ON THIS APPROVAL Pursuant to Chapter 230-146(B) of the Code of the Town of Southold any variance granted by the Board of Appeals shall become null and void where a Certificate of Occupancy has not been procured,and/or a subdivision map has not been filed with the Suffolk County Clerk,within three(3)years from the date such variance was granted. The Board of Appeals may, upon written request prior to the date of expiration, grant an extension not to exceed three (3) consecutive one(1) year terms. IREED I DEC 2 0 .2021 ZONING BOARD OF APP6FALe RECENE® Name of Owner: Paul Levi / and Raffaella Ceriello ZBA File # DEC 2 0 2021 ZONING BOARD OF APPEALS REASONS FOR APPEAL (additional sheets may be used with preparer=s si nature): AREA VARIANCE REASONS: (1) An undesirable change will not be produced in the CHARACTER of the neighborhood or a detriment to nearby properties if granted, because: The existing house was constructed in 2009 with a side entry and covered deck 15.3 feet from the side yard. The prior owner (Richard Brent) retained the services of Steve Kaplan to repair the deck. A building permit was filed 11/13/18 (BP#43212) for the deck and roof. During construction the prior owner (Richard Brent) modified the covered stoop, making it squarer. The original covered stoop was 10' x 5' and the new stoop is 11'7" x 611". Neither the builder nor the prior owner realized that the setback to the property line would be impacted by the revised shape of the stoop. Because the house is at an angle the change to the shape of the stoop resulted in a reduced side yard setback. While the work was being done, the owner Mark Brent passed away suddenly. His wife, Jeanne Priola had not been involved in any of the construction process or consulted on the design of the stoop. She believed that the permit had been closed out by her husband. She was not aware of the "open building permit" until the estate went to contract to sell the house and the municipal searches found an open building permit. The contractor was contacted to close out the building permit and the architect was asked to prepare the "as built" plans. While the house was under contract, the buyer obtained an updated survey, and it was discovered that the new stoop was 13.9' from the side yard. The Estate obtained "Amended plans", the amendment was filed, and a variance is required for the "as built" covered porch 13.9' from the property line. The house is a two-story cape on a half-acre parcel. The house is set back 104 feet from the road and the front of the house faces the side yard. The stoop encroaches 1.9 feet into the side yard. The side yard remains open, and the house is unchanged at 17.1' from the side yard. The stoop does not change the character of the neighborhood and REOEWED I DEC 2 ® 2021 neighboring properties. ZONING BOARD OFAPPEALc�z (2) The benefit sought by the applicant CANNOT be achieved by some method feasible for the applicant to pursue, other than an area variance, because: To make the stoop conforming, the framing of the structure including the roof would need to be deconstructed. The footings and structural elements would have to be changed and redone. The porch would have to be entirely re-constructed if the variance is denied. In addition, the design of the stoop provides greater clearance to open the door and protection from the weather. The redesign of the stoop significantly improves the house and is much more functional as an entrance to the house. The buyer/owner prefers the look and function of the "as built" stoop which is a minimal encroachment into the side yard (requires 15' and the actual is 13.9' which is a variance of P 3"). An escrow is being held if the Variance is denied. The wife and children are paying for this variance application in addition to the escrow. The deceased husband made the mistake, and the wife and children are cleaning up the mess. The buyers purchased a house with a new porch. The porch is safe and well-constructed. The existing porch is an improvement on the property. The property on the south is vacant and has a wood fence which blocks the neighbor's view of the home and stoop. The southerly neighbor appears to have functionally merged the contiguous parcel, the adjacent lot is wooded, and the only improvement is the driveway/parking pad of the neighbor's house. (3) The amount of relief requested is not substantial because: The variance request is for 1 foot 3 inches. The house is 104 feet from the street, the house and property line are on an angle and there is no visual change to the house from the street. The property card shows the street view of the house and the original covered entrance. The platform of the entrance was squared off and steps centered on the stoop. (4) The variance will NOT have an adverse effect or impact on the physical or environmental conditions in the neighborhood or district because: The appearance of the house was improved by the replacement of the covered porch. The structure was made structurally sound and safer. The general character of the surrounding community, known as Beixidon Estates, is a heavily developed community with undersized lots. The attached map with yellow highlighter identifies the numerous variances granted in this community. The subject parcel is one of 6 lots at the entrance to the Beixidon subdivision. The subject lot is larger (longer) than the smaller developed lots in Beixidon, nevertheless, the lot is nonconforming; the lot is less than one acre and only 75' in width. The entrance of the house faces the side yard. When the entrance stoop was reconstructed, the small change to the structure resulted in a nonconforming setback to the side property line. The change to the setback was not noticed by the family because the two-story Cape is placed at an angle. The angled house, together with the side lot lines, which are also at an angle, all result in a nonconforming side yard setback of 13.9 feet. No other change was made to the existing house. This is the MINIMUM that is necessary and adequate, and at the same time preserve and protect the character of the neighborhood and the health, safety, and welfare of the community.
