A 6' x 6' shed' will be built adjacent to the stairs for storage of an outboard motor, oars, life vests, etc. The ,CAC recommends approval provided the disturbed soil and fill behind seawall is revegetated and steps be 4' above slope. -Sound Drive, Greenport Vote of Council: Ayes: All Motion carried. No. 1126 Moved by Robert Keith, seconded by Patricia lsaksen, it was RESOLVED to recommend to the Southoid Town Board of Trustees APPROVAL WITH STIPULATIONS of the Wetland Application of RICHARD BURDEN 122-4-15, 16 to replace [within 18") 107 I.f. of existing timber bulkhead and add 15' return on west side and 20' return on east side. New bulkhead will be 18" higher than existing. Dredge up to 10' in front to maximum depth of 3' below MLW. Approximately 50 c.y. of spoil will be placed behind bulkhead as backfill. Construct a swimming pool and decks landward of bulkhead as shown on submitted site plan of Van Tuyl. An additional 75 +/- c.y. of fill will be trucked in from an upland source. WAIVER REQUESTED for all work landward of bulkhead. The CAC recommends approval provided the applicant allow a 10' buffer of natural vegetation and the pool is moved to the southeast sideyard. The permittee must submit a renewal application at least: a) 180 days before expiration of permits for State Pollutant Discharge Elimination System (SPDES), Hazardous Waste Management Facilities (HWMF), major Air Pollution Control (APC) and Solid Waste Management Facilities (SWMF); and b) 30 days before expiration of all other permit types. Bredemeyer: As per your request, I have reviewed the file and conducted , a site inspection of the above referenced construction project. The permit issued by your office specifically required compliance with all DEC permit conditions. A Notice of Violation was issued to the contractor , Mr . Scott Corwin, on November 30 , 1992 by the DEC for non-compliance with specific permit conditions. Before I can accurately report my findings the clarification of a recent storm event must be considered. On december 11 , 1992 a mayor storm effecting the entire East Coast produced very high tides and strong winds that created severe erosion problems throughout the Town. The location of this construction project was no exception. The rip-rap seawall constructed at the site has apparently weathered the storm, but the amount of erosion that occurred both in front of the wall and behind it was considerable . The notice of violation issued to Mr . Corwin listed several items which I will discuss individually as. follows: 1 . 150 ' of rip-rap seawall has been constructed. Only 100 ' was authorized. 2 . The violation of special condition # 2 - cannot be verified. The amount of storm erosion was too severe to confirm any excess excavations . The use of rocks from the upland portion of the beach could not be verified. 3 . Special condition # 8 required a minimum of 2 ton stone. The size of the stone used to construct the seawall varies greatly. The smaller large" stones appear to be marginal in size. The amount of smaller locking stone also appears to be excessive. . The permitted site or facility, including relevant records,'is subject to inspection at reasonable hours and intervals by an authorized representative of the Department of Environmental Conservation (the Department) to determine whether the permittee is complying with this permit and the ECL. Such representative may order the work suspended pursuant to ECL 71-0301 and SAPA 401(3). A copy of this permit, including all referenced maps, drawings and special conditions, must be available for inspection by the Department at all times at the project site. Failure to produce a copy of the permit upon request by a Department representative'is a violation of this permit. Permit Changes and Renewals 2.
