By resolution of the Board it was determir~ed that (a) Strict ap~olication of the Ordinance (would) (would not) ,produce practical difficulties or unnecessary hardship because SEE REVERSE (b) The hardship created (is) (is not) unique and (would) (would not) be shared :by all properties alike in the immediate vicinity of this property and in the same use district because SEE REVERSE (c) The variance (does) (does not) observe the spirit of the Ordinance and (would) (,would not) change the character of the district because SEE REVERSE and therefore, it was further determined that the requested variance ( ) be granted ( ) be denied and that the prev/ous decisions of the Building Inspector ( ) be confirmed ( ) be reversed. PO~VI ZB4 After investigation and inspection the Board finds that the applicant request permission to use a parcel of land with insufficient frontage, however, there is ample area. This property was handed down by will. A condition of granting this variance is that no side yard variances will be granted in the event the buyer wishes to build a house on it. In general, the Board is in agreement with the reasoning of the applicant. The Board finds that strict application of the Ordinance will produce practical difficulties or unnecessary hardship; the hardship created is unique and would not be shared by all properties alike in the immediate ~icinity of this property and in-the same use district and 'the ~ri~n6e does observe the 'spirit of the 6rdinance and will not change the 'character Yf t~e district. FOR APPEAL A Variance to Section 280A Subsection 3 ~, Variance to the Zoning Ordinance is requested forthe reasonthat the subject parcel of land which is described on the contract copy attached hereto was conveyed by %he Will of VCorinne B. STRICT APPLICATION OF THE ORDINANCE would produce practical difficulties or unneces- sary HARDSHIP because the land would not qualify for any use unless a variance is granted. 2. The hardshipcreatedis UNIQUE andisnotshared by alt properties alike in the immediate vicinity ofthis property and in this use district beca:use the easterly and westerly lines are fixed by other prior conveyances which were made in both cases in compliance with the requirements of the Zoning Ordinance. The subject parcel consists of all of the property lying between the land granted in the prior conveyances. 3. The Variance would observe the spirit of the Ordinance and WOULD NOT CHANGE THE CHARACTER OF THE DI.STRICT because the nearest properties just to the east of this parcel, located at Kimogenor Point, are also constructed on small lots. In view of this situation, any contemplated construc- tion on the subject property would be consistent with the existing use of the district.
