SPECIAL EXCEPTION'. By resolution of the Board it was determined that a special exception ( ) be granted ( ) be denied pursuant to Article ............... Section ................ Subsection ................ paragraph .............. of the Zoning Ordinance, and the decision of the ~uilding Inspector ( ) be r~versed ( ) be confirmed because 8:10. P.I%I. (E.S..T.) · Upon application, of William Beebe, New Suffolk Lane, Cutchogue, New..Mork, for =ecognition. of access in accordance with the State of New York Town Law, Section 280A. Location of property: south side WilsonLanding and Wilson Road, Cutchogue, Ne~ York, .bounded north by. Wilson Landing, .east by land of applicant, south by land of Moeller, west by Eugenes Creek. 2. VARIANCE. By resolution of the Board it was ,determined that , (a) Stri,c~ application of the Ordinance (would) (wQuld not) ~)reduce practical difficulties or unnecessary hardshit) because SEE REVERSE (b) The hard~hip created (is) (is not) unique and (would) (would not) be shared by all properties alike in the immediate vicinity of this property and in the same use district because SEE REVERSE (c) The variance (does) (does not) observe the spirit of the Ordinance and (would) (~Nould not) change the character of the district because SEE REVERSE and therefore, it was further detelTnined that the requested varial~ee ( ) be granted ( ) he denied and that the previous decisions of the Building Inspector ( ) be confirmed ( ) be reversed, POP2~ ZB4 ZONING BOAP~D OP APPEALS Barbara C. Dittmann, Secretary After investigation and inspection the Board finds that the appellant requests permission to construct a right of way to serve two interior lots. The Board finds that this right of way will be built to the Town Highway specifications and there will be a 100 foot turnaround at the end of the right of way. The Board is in agreement with the reasoning of the application. The Board finds that strict application, of the Ordinance will produce practical difficulties or unnecessary hardship; the hardsh~ created is unique and would not be shared by all ,properties alike in the immediate vicinity of this property and in the same use district; and the variance does observe the spirit of the Ordinance and will not change the character of the district. Therefore, it was RESOLVED William Beebe, New Suffolk Lane, Cutchogue, New York, be granted xecognition of access on property located on the south side of Wilson Landing and Wilson Road, Cutchogue, New York, as shown on the survey map submitted with the application. This permission is granted subject to the following conditions: 1. This right of way shall be constructed in accordance with the Town of Southold Highway Specifications and subject to the final approval of the Southold Town Building Inspector.
