(E.S.T.), Upon~ application of Peter Scholl, Inc., 43 West 10t]l Street, Huntington Station, New York, a/c Averette Service Station, Main Road, Southold, New York, for a special exception in accordance with the Zoning Ordinance, Article IV, Section 408, Subsection (a), for permission to retain a pole sign with insufficient setback from the property line. Location of property: south side Main Road, Southold~ Ne_w York, bounded north by Main Road, east by Youngs Avsnue, south by Mary Goubeaud, west by T. Frohnhoefer. 2. VA.P~IANCE. By resolution of the Board t was determined that (a) Strict application of the Ordinance (would) (wonid not) produce practical difficulttes or unnecessary hardship because SEE REVERSE (bi The hardship created (is) (is not) unique and (would) (would not) be shared by all properties ali~ke in the immediate vicinity of this property and in the same use district because SEE REVER~E (c) The variance (does/ (does not) observe the spirit of the Ordinance and (would) (~;ould not) chm14~e the character of the district because SEE REVERSE and therefore, it was further determined that the requested variance ( ) be granted ( ) be denied and that the previous decisions of the Building Inspector ( ) be confirmed ( ) be reversed. Dittmann, Secretary After investigation and inspection the Board finds that the applicant requests permission to retain a pole sign with insufficient setback from the property line. The Board finds that this pole sign overhangs the property line, is directly on a corner, and overhangs the sidewalk. This pole sign should be moved to a line in line with the gasoline pumps which would move the sign at least eight to ten feet from the property line. This sign, as it is at the present time, constitutes a traffic hazard. In any case, the sign must be moved at least six ~ feet f~om any property, line. , / . The BOard f~nds that the public, convenience and welfare and justice, will not,be, served and the legally established or permitted use of neighborhood property and adjoi~ng use districts will be permanently or substantially injured and the spirit, of the Ordinance will not be observed~ Therefore, it was RESOLVED that Peter Scholl, Inc., ~ West 10th Street, HuntingtOn Station, New York, a/c Averette Service Station, Main Road, Southold, New York, be denied permission to retain a pole sign with insufficient setback from the property line as applied for on property located on the south side Mah Road, Southold, New York. This sign shall be located at least six feet from any property line. The applicant shall comply with this provision within 60 days from the date of this action.
