By resolution of the Board it was determined that (a) Strict application of the Ordinance (would) (would not) produce practical difficu, lties or unnecessary hardshtp because SEE REVERSE (b) The hard~hip cre~ted (is)' (is not) unique and (would) (would not) be shared by all properties alike in the immediate vicinity of this property and in the same use district because SEE REVERSE (c) The ~ariance (does) (does not) observe the sph~t of the Ordinance and (would) (~vould not) change the character of the district because SEE REVERSE and therefore, it was further determined that the requssted variance ( ) be granted ( ) be denied and that the previous decisions of the Building Inspector ( ) be confirmed ( ) be reversed. ZONI~O BO 'A~D O~ APPEAL~ Barbara C. Dittmann, Secre~ry After investigation and inspectiDn the Board finds that the applicant requests permission to retain a roof sign and a side wall sign. The Board grants permission forthe tavern sign providing the applicant removes the roof sign which was to be removed several years ago. The Board finds that the applicant was not the owner of the property at the time the pizza sign was granted. The Board points out that financial hardship is not an unusual or unique hardship. As to the roof sign the Board finds~that the public convenience and welfare and justice will not be served and the legally,established or-permitted,use of neighborhood property and adjoining use districts will be permanently ~ ,or substantially inured and the spirit of the Ordinance will not be observed. ,, As to the side~ll sign the Board finds that the public convenience and welfare and justice will be served and the legally established or permitted use of neighborhood property and adjoining use districts will not be permanently or substantially injured and the spirit of the Ordinance will be observed. Therefore, it was RESOLVED that Verna LaColla, Main Rodd, Southold, New York, be granted permission to retain a side wall sign on property located on the north side of Main Road, Southold, New York, providing the roof sign at the same premises is removed within 60 days. This permission is granted subject to the following conditions: 1. The sign shall be granted for one year only, renewable annually upon written application to the Board of Appeals. 2. The sign shall be subject to all subsequent changes in the SoutholdTown Zoning Ordinance as it applies to signs.
