SPECIAL EXCEPTION. By resolution of the ~oard it was determined that a special exception ( ) be granted ( ) be denied pursuant to Article ............... Section ................. Subsection .......... : ..... paragraph ............... of the Zoning Ordinance, and the decision of the ~Buildl~ Inspector ( ) be reversed ( ) be confirmed because 8:15 P.M. (.E.D.S.T.), Upon application of Laughing Water Property Owners Assoc., Southold, New-York, for a special exception in accordance with the Zoning Ordinance, Article III, Section 300, Subsection 5 (i), for permission for a marina for the d~cking, mooring or accommodation of not mode than six (6) non-commercial b~ ts. Location of property: north east side Minehaha Blvd., Southold, New Mork, ,t~ounded north by Drain Canal-Corey Cree~, east by Haggerty, south and west by Minehaha Blvd. v ~ 2. VARLgNCE. By resolution of the Board it was determined that (a) Strict a~plication of the Ordinance (wonid) (would not) produce practical difficni)~ies or.unnecessary hardship because SEE REVERSE (b) The hardship created (is) (is not) unique and (would) (would not) be shared ~by all properties alike in the immediate vicinity of this prsperty and in the same use district because SEE REVERSE (c) The variance (does) (does not) observe the spirit of the Ordinance and (would) (Mould not)' change the character of the district because SEE REVERSE and therefore, it was further determined that the requested variance ( ) be granted ( ) be denied and that the previous decisions of the Bnilding Inspector ( ) be confirmed ( ) be reversed. ZONING BOARD OP APPEALS Barbara C. Dittmann, Secretary After investigatinn and inspection the Board finds that the applicant ~equests ,permission to improve and enlarge an existing private marina. The Board finds this enlargement is necessary to accommodate all the people who own lots in the Laughing Water section that have deed rights to keep a boat at this marina. The Board finds that the improvements will consists of a new bulkhead, some floating docks to replace stakes that were used by the residents to moor their private boats. All boats using this facility are owned by the residents of the area and are members of the Laughing Water Property Owners Associatinn. The Board finds that the ,pqb~iq qo~e~ience and welfare and justice will Re served and the leq~%ly established or permitted use of neighborhood Property and adjoining use~ districts will not_be substantially injured,an~ the spirit of the 0rdinan~e will>be observed. ~ Therefore, it was RESOLVED that Laughing Water P~o~ert~ Owners Association, Soutk~d, ~ew York, be GRANTEDpermission to improve a private marina as applied for, on property located on the north east side ~inehahaBlvd., Southold, New York. This permission is subject to the following conditions: 1. This boat basin shall be limited in use to only the residents and property owners in the Laughing Water Property Owners Associa~. 2. There shall be no services for party boats. 3. No boats shall be rented or leased. 4. There shall be no sale of any commercial products. This condition is without predjudice to any future application to per- mit the sale of gasoline at the premises for the boa~s moored at this boat basin. 5.
