Upon review of the deed, the applicant has the right to perform work within the easement. The only limitation is that the applicant cannot impede the right of ingress and egress of the adjoining property owners. Starcic. Mr. Ghosio questioned whether the extension of water and electric through the 16-foot right of way was permissible and also requested that we provide an identification of trees to be planted. Attached herewith please find correspondence from Martin Fishman, dated December 8, 2011 to this office confirming that water and electric can be installed across the right of way. In addition, I enclose three copies of the survey which identifies the trees that Mr. and Mrs. Starcic propose to plant. I have also added a note indicating that the light to be installed at the dock would be dark skies compliant and would be controlled by timer. It is my understanding that Ms. Starcic has been requested to provide an explanation of the rights and obligations relating to a !6-foot right-of-way running fi*om Oaklawn Avenue through Lots 7. 9, and 11 to the premises known as Lot 10. The easement is described in a Deed dated July 14, 1989, between Mary E. Hammesfahr and Renato Starcic. Said Deed transfers Lot 9 "to an easement sixteen feet in width rulming across the northerly part of said premises rmming westerly from other lands of the Grantee herein and other lands of the Grantor herein to Oaklawn Avenue. This is the easement that runs across the property presently owned by Carla Starcic. The easement set forth in the Deed tbus allows "ingress" and "egress" by travel over the easement to adjoining property owners. Ms. Starcic is allowed to use said property including the easement for any and all purposes which do not defeat the use of the right-of-way as set forth above. Ms. Starcic seeks to install a water line and electric cable under the surface of the right-of-way to the dock of the back of hcr property. ']?his use does not alt'ect the right of ingress or egress by others. So long as Carla Starcic does not interfere with ingress or egress, she has the right to use the right-of-way in any fashion whatsoever. As the proposed installation of a xvater line and electric cable under the surface of the property to the dock does not affect the easement holders' right to use the right-of-way as set lbrth above, the existence of tbis easement does not, in any way, limit Carla Starcic's right or ability to install the ~vater line and electric cable as set forth above. If any further information is required concerning the above, please advise and 1 will attempt to provide fur clarification. The law of easement gives the easement beneficiaries no rights other than set forth in the language creating the easement. As these rights will not be affected by the installation proposed by Ms. Starcic, the existence of the 16-foot easement is irrelevant to Ms. Starcic's intentions as aforesaid. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is CONSISTENT with the LWRP. It is recommended that the Board require tree species native to New York State. The CAC recommends disapproval because the house and septic system would be within the 100' wetland buffer area and the leakage from the cesspool could be excessive with the buffer area. The CAC recommends disapproval of the ramp and dock because it extends 29' out into the channel, going half way across the channel and would result in hazardous navigation of the channel. That the State of New York shall in no case be liable for any damage or inlury to the structure or work herein authorized which may be caused by or result from future operations undertaken by the State for the conservation or improvement of navigation, or for other purposes, and no claim or right to compensation shall accrue from any such damage. Granting of this permit does not relieve the applicant of the responsi- bility of obtaining any other permission, consent or approval from the U.S, ,Army Corps of Engineers, U.S. Coast Guard, New York State Office of General Services or local government which may be required. SPECIAL CONDITIONS 1. A copy of this permit with supplementary conditions and approved plans must be available at the project site whenever authorized work is in progress. 2. The permit sign enclosed with the permit or a copy of letter of approval must be protected from the weather and posted in a conspicuous location at the work site until completion of authorized work. 3. At least 48 hours prior to commencement of the project, the permittee must complete and return the top portion of the enclosed receipt form certifying that he is fully aware of and understands all provisions and conditions of this permit. Within one week of completion of the permitted work, the bottom portion of that form must also be completed and returned. 4. If the permittee intends to undertake any project design modifications after permit issuance, the permittee must submit the appropriate plan changes for approval by the Regional Permit Administrator prior to undertaking any such modifications. The permittee is advised that substantial modification may require submission of a new application for permit. 5. Those portions of docks, catwalks and ramps which extend over vegetated tidal wetlands shall have a maximum surface width of 4 feet and shall be a minimum of 3 1/2 feet above grade, as measured from the ground surface to the bottom of the planking. Floating docks shall not rest on vegetated tidal wetlands at any tidal stage. Dock reconstruction or replacement or seasonal installation shall not involve expansion or substantial modification of existing structures or facilities. Installation of additional docks at marinas, boat basins, or other commercial facilities is not authorized by this permit. No dredging, excavating or other alteration of shoreline or underwater areas is authorized by this permit, nor shall issuance of this permit be construed to suggest that the Department will issue a permit for such activities in the future.
