A detailed description and plans of the proposed work are inclosed to
assist in your review of the proposal.
The decision whether to issue a permi~ will b~ based on an evaluation
of the probable impact Of the proposed activity on the public interest.
That decision will reflect the national concern for both protection and
utilization of important resources. The benefit which reasonably may be
expected to accrue from the proposed work must be balanced against its
reasonably foreseeable detriments. All factors which may be relevant to
the proposed work will be considered; among those a~e conservation, eco-
nomics, aesthetics, general environmental concerns, historic values,
fish and wildlife values, flood damage prevention, land use, navigation,
recreation, water supply, water quality, energy needs, safety, food pro-
duction and, in general, the needs and welfare of the people.

A preliminary review of the application indicates that an Environmental
Impact Statement will not be prepared. A review of the latest publish-
ed version of the National Register of Historic Places and of the pre-
sence or absence of registered properties or properties listed in
the latest published version of the Register as being eligible for
inclusion, therein, has been made. Presently unknown archeological,
scientific, prehistorical or historical data may be lost or destroyed
by work to be accomplished under the required permit.
The evaluation of the impact of the activity on the public interest
will include application of the guidelines promulgated by the Adminis-
trator, U.S. Environmental Protection Agency, under authority of Sec-
tion 404(b) of the Federal Water Pollution Control A~t or of the
criteria established under authority of Section 102(a) of the Marine
Protection, Research and Sanctuaries Act of 1972, as appropriate.
Any person may request, in writing, within the comment period specified
in this notice, that a public hearing be held to consider this appli-
cation. Requests for public hearings shall state, with particularity,
the reasons for holding a public hearing.
The following government authorization(s) has(have) been obtained or
will be obtained prior to the issuance of a Department of the Army
permit:
A Permit and Water Quality Certificate from the New York
State Department of Environmental Conservation
Any cr;[icisms or protests regarding the proposed work should be
PREPARED IN WRITING AND MAILED TO REACH THIS OFFICE prior to
24 July 1982 otherwise it will be presumed that there are no ob-
jections.
It is requested that you communicate the foregoing information con-
cerning the proposed work to any persons known by you to be interested
and who did not receive a copy of this notice.

DESCRIPTION OF WORK
The applicant, Mr. Halsey Staples, proposes to ccx~struct a timber bulkhead
and dredge in Sterling Creek, Shelter Island Sound, Village of Greenport,
Suffolk County, New York.
As shown on the attached drawings, the proposed bulkhead would be
approximately 70 feet long, tie into an existing bulkhead on the north end
and include a 15 foot return cn the south end.
An area, 40 feet x 20 feet would be dredged once to a depth of 2 feet below
the plane of mean low water. Approximately 30 cubic yards of dredged
material, consisting of sand, would be used as backfill behind t/]e proposed
bulkhead.
The applicant states the proposed work is required to control erosion and
provide adequate oepth for safe navigation..
