RE: Robert Smith, R.O.W. off Westphalia Ave., Mattituck, N.Y.
Dear Mr. Mackiewicz:
The following action was taken by the Board of Town Trustees
during their regular meeting held on November, 17, 1988 on the
above referenced property:
WHEREAS En-Consultants in behalf of Robert Smith applied to
the Town Trustees for a waiver to construct a pool and tennis
court on property located on R.O.W. off Westphalia Ave.,
Mattituck, N.Y. Property is identified on the Suffolk County Tax
Map as 1000-113-9-11
WHEREAS the Town Trustees have conducted an on site
inspection of the subject property, and
NOW THEREFORE BE IT
RESOLVED that the Southold Town Trustees approve the request
for WAIVER for Robert Smith to construct a pool and tennis court
on property located at above mentioned location.
Please be advised that this determination is not a
determination for any other agency or department which may have
-jurisdiction in this matter.

PROJECT ADDRESS: R.O.W. off Westphalia Avenue, Matti-
tuck, SCTM No. 1000-113-9-11. Letter of "no permit
necessary" is requested for construction of a tennis
court in excess of 75' from the landward edge of tidal

Attached please find a site plan of the project referenced
above.
As the construction is greater than 75' fram wetlands, I
assume the Trustees have no jurisdiction in this rotter.
Would you kindly verify this in writing.
If thiS is not the case and a permit is needed, please
notify us and an application will be promptly submitted.

DIRECTIONS
To find:
Dirt R.O.W. to site is on n/s of Westphalia Avenue.
LILCO pole %37 is on the west. LILCO pole 36 is
approximately 50' to east of R.O.W. At the drive-
way is a mailbox for "Linder and Berner." Smith
house is at extreme end of R.O.W. Red ribbons
have been placed at seaward end of proposed tennis
court.
