Mason Drive, Cutchogue The Council recommends disapproval of the request to amend the Wetland Permit. The Council recommends the Trustees require a full Wetland Application for the this project. Roy Haje i329 North Sea Road Southampton NY 11968 Re: JOHANNA SMITH SCTM ~104-7-5 Dear Mr. Haje, The following action was taken by the Board of Town Trustees during its regular meeting held on January 26, 1995 regarding the above matter: WHEREAS, En-Consultants Inc., on behalf of JOHANNA SMITH applied to the Southold Town Trustees for a permit under the provisions of the Wetland Ordinance of the Town of Southold, application dated October 31, 1994 and, WHEREAS, said application was referred to the Southold Town Conservation Advisory Council for their findings and recommendations, and WHEREAS, a Public Hearing was heldby the Town Trustees with respect to said application on January 26, 1995, at which time all interested persons were given an opportunity to be heard, and, WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, WHEREAS, the structure complies with the standard set forth in Chapter 37-18 of the Southold Town Code, which will be listed on a separate page, and, WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, NOW THEREFORE BE IT, RESOLVED, that the Board of Trustees approves the application of JOHANNA SMITH to resheath (on landward side) 478+/- 1.f. of existing timber bulkhead. Remove 96+/- 1.f. of existing timber bulkhead and construct 30+/- 1.f. of new timber bulkhead to expand existing irregularly shaped boat basin. Maintenance dredge basin and 20' of its mouth to a max. depth of -4' ALW. Approx. 100 c.y. of resultant spoil will be deposited on owner's upland. Excavate upland area adjacent to existing basin (approx. 27' X 40') to expand boat basin. Approx. 150 c.y. of resultant soil and sand will be used as backfill, and a 20'Don-turf berm 1' above lawn buffer face. Located Mason Drive, between Haywaters & Broadwaters Drive, tel. pole $8, Cutchogue. Permit to construct project will expire two years from the date it is signed. Fees must be paid, if applicable, and permit issued within six months of the date of this notification. Box 1179 Southold, New York 11971 TO: Southold Town Board of Trustees FROM: Southold Town Conservation Advisory Council DATED: January 24, 1995 RE: Amendment of Recommendations The following recommendations to the Southold Town Trustees contain some amendments to the original recommendations. No. 1210 Moved by Allan Connell, seconded by Patricia Isaksen, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH PROVISIONS of the Wetland Application of RONALD MCGREEVY 99-3-~.5 to construct 155 +/- I.f. of timber bulkhead to be tied into adjacent bulkhead to east. Construct-'a 15 +/-' return at west 'end of bulkhead and backfill with 250 c.y. of bank run sand to be trucked in from approved upland source. Also, to construct a 4' x 14' section of fixed walk to tie into existing stairs down bluff; construct 4' wide steps to beach. The Council recommends approval provided the applicant follow the Trustees' policy for bulkheading along the Sound by' placing the bulkhead at the toe of the bluff to tie in with the neighbor's return and that the bulkhead is buried and maintained. The Council suggests the Trustees also require the applicant to address the runoff at the top of the bluff by constructing a berm or sloping the top away from the bluff. 250 LIoyds Lane, Mattituck Vote of Council: Ayes: Bruce Loucka, Robert Keith, Jack Hagerty, Patricia Isaksen, Betty Wells, and Allan Connell Nays: Stephen Angell Motion carried. Excavate upland area adjacent to existing basin (approximately 27' x tt0') to expand boat basin. Approximately 150 c.y. of resultant soil and sand to be used as backfill. The Council recommends approval provided the applicant maintains a 20~ buffer as stipulated in the Town Code. Also, the CAC recommends that the excess spoil be used to build a berm along the outside edge of the bulkhead to prevent runoff from entering the creek.
