After investigation .and inspection, the Board ·finds that the applicant
requests the approval c~ a 16 foot right of way. Said right of way:,.
runs approximatel~ 183 feet in ~ s°Utherl~ direction.~ 'The~ ~ight 'of
way is to obtain access to property which was granted division by
the Board of Appeals in 1959. The right of way will serve two lots.
"The right of way shall be suitable for the ingress and egress of all
emergency vehicles.
The Board finds that striction application of the Ordinance will
produce ,practical diXficulties or unnecessary l~ardship; the hard-
ship created is unique and would not be shared by all properties
alike in the immediate vicinity of this l)r~operty .and in the same
use district; and the variance does observe the spirit of the Ordin-
ance and will not change the character of the district.
THEREFORE~ IT WAS RESOLVBD that Charles M, Krull, King
Street~ Oreint, New York, be ~NTBD permission for recognition
of access as applied for on property located on a right of way

REASON FOR APPEAL
Continued
1. STRICT APPLICATION OF THE ORDINANCE would produce practical difficulties or unneces-
sary HARDSHIP because
This house lo~ which was previously approved in area and frontage,
would have no access ~o al publle s~ree~.
2. The hardship created is UNIQUE and is not shared by all properties alike in the immediate
vicinity of this property and in this use district bec,o:use '
This is the las~ house lc~ on ~he proper~y using this Righ~-of~Way.
O~her properties have approved access.
3. The Variance would observe the spirit of the Ordinance and WOULD NOT CHANGE THE
CHARACTER OF THE DISTRICT because
There is an existing 16 ft. Right.-of-Way serving 4 homes, and a
house lo~ North of ~his properSy. This variance would moating
extend ~his Righ$-of-Way.
