Location of property: north side of Ruth Road, Mattituck, New York, bounded north by Lots 189 & 190 of Capt. Kidd Estates, east by Basis, south by R*tth Road, west by J. Murphy. 2. VARIANCE. By resolution of the Board it was determined that (a) Strict application of the Ordinance (would) (would not) produce hardship because practical difficulties or unnecessary SEE REVERSE (b) The hardship created (is) (is not) unique and (would) (would not) be shared by all properties alike in the immediate vicinity of this property and in the same use district beeanse SEE REVERSE (c) The variance (does) (does not) observe the spirit of the Ordinance and (would) change the character of the district because (would not) SEE REVERSE and therefore, it was further determined that the requested variance ( ) be granted ( ) be denied and that the previous decisions of the Building Inspector ( ) be confirmed ( ) be reversed. FORM ZB4 SEE REVERSE ZONING BOARD OF APPEALS ecretary Southold Town BOard of Appeals After investigation and inspection the Board findSthat the applicant requests permission to build new one family dwelling with reduced front yard setback. He has inadvertently commenced a found- ation which should be 47' 9" from the street line, but is actually only 42' 8" from the street line. The Board f~nds that the applicant has a self-imposed hardship and is unable to grant relief. The Board finds that strict application of the Ordinance will not produce practical difficulties or unnecessary hardship; the hardship created is not unique and would be shared by all properties alike in the immediate vicinity of this property and in the same use district; and the variance would change the character of the neighborhood and would not observe the spirit of the Ordinance. THEREFORE, IT WAS RESOLVED Severius Lambros, 24 Etlington Drive, East Northport, New York, be DENIED permission to build new one family dwelling with reduced front yard setback as applied for on property located on north side of Ruth Road, Mattituck, New York.
