By resolution of the BOard it was determined that (a) Strict application of the Ordinance (would) (would not) produce practical hardship because SEE REVERSE (b) The hardshi~ created (is) (is not) unique and (would) (would not) be shared by all properties alike in the immediate vicinity of this property and in the same use district because SEE REVERSE (c) The variance (does) (does not) observe the spirit of the Ordinance and (would) change the character of the district because (would not) SEE REVERSE and therefore, it was further determined that the requested variance ( ) be granted ( ) be denied and that the previous decisions of the Buildin~ Inspector ( ) be confirmed ( ) be reversed. ~et~t Nevillee Secret~ry After inve,st!g~tion .and inspection the Board finds that the.. applicant requests permission to use medical office for non-resident physicians in accordanceiwith' ~he Zoning Ordinance, Article 'III~ S:gction 300, Subsection 7. The Board finds that th~.~s property is in a residential area. The dwelling is a two family house,, the upstairs being occupied. This lot is undersized, and there is n, ot enough parking area. Proposed use would be by 2 non-resident physicians ~.h!q~ .is not permitted in the Ordinance. :.The Board is in sympathy with the need for more d0c%ors .in the Town. The Board finds that strict application of the Ordinance will not preduce practical difficulties or .unnecessary hardship; the hardship created is not unique and would not be shared by all properties in the immediate vicinity of this property and in the same use district; and the variance does not observe the spirit of the Ordinance and w.ill change the character .of the district. ( ) (x) ( ) REASON FOR APPEAL A Variance to Section 280A Subsection 3 A Variance to the Zoning Ordinance is requested for the reason that Subdivo 7 of Article III of the Zoning Ordinance requires that the occupational rooms be located in a dwelling which the practitioners (M. Do in Obstetrics & Gynecology)reside in, and applicant is not presently residing on the premises° (Continue on other side) REASON FOR APPEAL Continued 1. STRICT APPLICATION OF THE ORDINANCE would produce practical difficulties or unneces- sary HARDSHIP because applicant would be denied reasonable use of the structure on the premises for office purposes. Applicant is in receipt of a (2) two year lease at $190.00 per month which will have to be cancelled if a variance is not granted. Applicant has mot been able to rent premises at above rent which is necessary in order ~o produce sufficient return on his $30,000o00 investment° Premises are now used as a two-famil~:~ non-conforming. In the immediate area there is a church~ rectory, Doctor's office and three Attorney's offices. Also a High School and bus garage~ 2. The hardship created is UNIQUE and is not shared by all properties alike in the immediate vicinity of this property and in this use district because properly is wit:him 300~ of similar office space and within 500' of "B" Business District to the East. 3. The Variance would observe the spirit of the Ordinance and WOULD NOT CHANGE THE CHARACTER OF THE DISTRICT because the proposed use of the premises is one frequently carried on in a residential district and would not be one adversely affecting the health, safety, morals or general welfare of the area.
