STRICT APPLICATION OF THE ORDINANCE would produce practical difficulties or unneces- sary HARDSHIP because the land would become valueless and unusable. 2. The hardship created is UNIQUE and is not shared by all properties alike in the immediate vicinity of this property and in this use district because appellants retained this one parcel of land as shown on the survey hereto at the time that they disposed of the balance of the property which has been known as Takaposha Shores. This parcel is therefore in single and separate ownership, not a part of an unfiled subdivision map. 3. The Variance would observe the spirit of the Ordinance and WOULD NOT CHANGE THE CHARACTER OF THE DISTRICT because the dimensions are 140 feet on the private road and 125 feet in depth to Peconic Bay, being of sufficient area and comparable or greater than the area of neighboring parcels which are separately owned. The right of way on which this lot is located has been in existence for at least ten years. There are four other neighboring properties with dwellings located thereon using it.
