SPECIAL EXCEPTION. By resolution of the Board it was determined that a special exception ( ) be granted ( ) be denied pursuant to Article .................... (E.S.T. ) , upon application of Helen V. Raynor, Main Road, Jamesport, New York, for a variance in accordance with the Zoning Ordinance, Article III, Section 304, for permission to erect new one family dwelling with reduced frontyard setback. Location of property; Private right-of-way off south side of Peconic Bay Boulevard, Laurel, New York, bounded north by Peconic Bay Boulevard, east by J. G. Moffat, south by Great Peconic Bay, west by V. Catrow. Fee paid $5.00. 2. VARIANCE. By resolution of the Board it was determined that (a) Strict application of the Ordinance (would) (would not) produce practical difficulties or unnecessary hardship because SEE REVERSE (b) The hardship created (is) (is not) unique and (would) (would not) be shared by all properties alike in the immediate vicinity of this property and in the same use district because SEE REVERSE (c) The variance (does) (does not) observe the spirit of the Ordinance and (would) (would not) change the character of the district because SEE REVERSE and therefore, it was further determined that the requested variance ( ) be granted ( ) be denied and that the previous decisions of the Building Inspector ( ) be confirmed ( ) be reversed. The Board finds that applicant' s property is a part of the Raynor estate and is bounded north and south by Phyllis Moore, a sister of Mr. Raynor. The applicant has a signed agreement showing that applicant has right-of-way. The Board finds that strict application of the Ordinance will produce practical difficulties or unnecessary hardship; the hardship created is unique and would be shared by all properties alike in the immediate vicinity of this property and in the same use district; and the variance does observe the spirit of the Ordinance and will not change the character of the district. THEREFORE, IT WAS RESOLVED Helen V, Raynor, Main Road, Jamesport, New York, be GRANTED permission to erect new one family dwelling with reduced frontyard setback located private right-of-way off south side of Peconic Bay Boulevard, Laurel, New York, subject to the following condition: That applicant produce satisfactory evidence of permission of approval of access over private right-of-way into this property to satisfy Building Inspector.
