Mullen, Oaklawn Avenue, Southold, New York, for approval of access over private right-of-way in accordance with .the State of New York Town Law, Section 280A. Location of property: priVate right-of-way off west side of Oaklawn Avenue, Southold, New York, hounded north by land Of the applicant, east by Oaklawn Avenue, south by land 'of the applicant, west hy land of the applicant. 2. VARIANCE. By resolution of the Board it was determined that (a) Strict application of the Ordinance (would) (would not) produce practical hardship because SEE REVERSE difficulties olc unnecessary (b) The hardship created (is) /is not) unique and (would) (would not) be shared by all properties alike in the immediate vicinity of this property and in the same use district because SEE REVERSE (c) The variance (does) (does not) observe the spirit of the Ordinance and (would) change the character of the district because SEE REVERSE (would not) and therefore, it was further determined that the requested variance ( ) be granted ( ) be denied and that the previous decisions of the Building Inspector ) be confirmed ( ) be reversed. FORM ZB4 SEE REVERSE APP O'VED Chairman u,;arS~l ~pea~ ' ZONIi~G BO_;~,D OF APPEALS Betty ~ev~lle, Secretary Southold Town Board of Appeals After investigation and inspection the Board finds that the applicant requests permission for approval of access over priv ate right-of-way in accordance with the State of New ~ork Town Law, Section 280A. The applicant is the owner of a tract of land about 3½ to 4 acres which she proposes to subdivide sometime in the future. Approval of access must be secured, when required, before a subdivision application can be filed. This approval of access is granted for private righ~-of-way as set forth on survey dated April 29, 1970. Approval is granted subject to the approval ef the Building Inspector in regard to the actual construction and~ surfacing of the right-of-way. The Board finds that strict application of the Ordinance would produce practical difficulties or unnecessary hardship; t~e hardship created is unique and would not be shared by all properties alike in the immediate vicinity of this property and in the same use district; and the variance will not change the character of the neighborhood and will observe the spirit of the Ordinance. THEREFORE, IT WA~ RESOLVED Katheryn ~. Mullen, Oakla~n Avenue, Southold, New York, be GRANTED approval of access over private right,-of-way in, accordanc, e with the State of Ne~ York Town Law, Se cti, on 280A as applied for on private right-of-way located off west side of Oaklawn Avenue, Southold, ,New York subject to the following conditions: 1. This approval of access is granted for private right- of-way as set forth on survey dated April 29, 1970. 2. This approval of access is granted subject to the approval of the Building /-nspector in regard to the actual construction and surfacing of the right-of-way.
