VARIANCE. By resolution of the Board it was determined that (a) Strict application of the Ordinance (would) (would not) produce practical difficulties or unnecessary hardship because SEE REVERSE (b) The hardship created (is) (is not) unique and (would) (would not) be shared by all properties alike in the immediate vicinity of this property and in the same use district because SEE REVERSE (c) The variance (does) (does not) observe the spirit of the Ordinance and (would) (would not) change the character of the district because SEE REVERSE and therefore, it was further determined that the requested variance ( ) be granted ( ) be denied and that the previous decisions of the Building Inspector ( ) be confirmed ( ) be reversed. The Board is in agreement with the reasoning of the applicant who purchased the entire parcel in 1946 and has had a residence there since then. He is requesting that the northerly part be divided into two lots. This division would be in keeping with the lots on this side of Legion Avenue. The Board finds that strict application of the Ordinance will produce practical difficulties or unnecessary hardship; the hardship created is unique and would be shared by all properties alike in the immediate vicinity of this property and in the same use district; and the variance does observe the spirit of the Ordinance and will not change the character of the neighborhood. THIREPORE, IT WAS RESOLVED Adrianus and Jerina Van Ryswyk, legion Avenue, Pattituck, New York, be CK110TE17 permission to set off lot with less than 100 ft. frontage on property located south side of region Avenue , Aattituck, New York, with the following conditions: 1. STRICT APPLICATION OF THE ORDINANCE would produce practical difficulties or unneces- sary HARDSHIP because I purchased the entire parcel in 191+6 and have had my residence here since then.. The dwelling has been located on the southerly 50 f6ft of the lot together with the garage and shop accessory building. This lot is far in excess of the minimum required by the zoning ordir ance but not enough to make "two full size lots, I equesting the northerly part be divided into two Lots' one having 69m,5'rfeet on legion ave and the balance with frontage on both Leigor, love & Pacific St as shown on a map dated June 1970 by k. VanRyswtk' sacle 20ft = 1><t. This division would be in keeping with the lots on this side of Leigon kve. , most of which were fieveloped prior to the zoning ordinance, 2. The hardship created is UNIQUE and is not shared by all properties alike in the immediate vicinity of this property and in this use district because This is the largest unused lot in this neighborhood, and has frontage on two residential streets 3. The Variance would observe the spirit of the Ordinance and WOULD NOT CHANGE THE CHARACTER OF THE DISTRICT because ; I propose to keep my residence "as is" and the dwelling on the proposed 66.5 ft frontage will remain "as is"' the corner lot - frontage on two streets - would be sold. This lot etas: made larger to provide for setback from each of these streets. This lot suld be used for a one family dwelling similar to all others in this neighborhood.
