The Board finds that the applicant rejects advice of Town Counsellor that carport be moved back 20 ft. from property line, in front yard area; also refuses to attach carport to his house or to relocate carport in rear yard area. The Board finds that strict application of the Ordinance will not produce practical difficulties or unnecessary hardship. The hardship created is not unique and would be shared by all properties alike in the immediate vicinity of this property and in the same use district; and the variance would change the character of the neoghborhood and would not ~oserve the spirit of the Ordinance. Form (Continue on other side) REASON FOR APPEAL Continued 1, STRICT APPLICATION OF THE ORDINANCE would produce practical difficulties or unneces- san/ HARDSHIP because= ~ost of the lots in this immediate area were set off and build on prior to the zoning ordinance, the majority have less than 100 foot front width~ but do "fan out" to more width on the creek~ thus restricting the width of the lots.~at the building line. Zt is necessary to locate our proposed"open carport" between the ~ dwelling and the Town road as the house is located about in the center of the lot, not leaving enough side yard for an attached garage. The-rear of the lot slopes from the house tward the creek and has many good sized trees which would make it impractical if not entirely impossible to build anything.in this area. There are several large trees in each side yard area~ and quite a fe~ in the front yard area. We proposed to locate the open ~$$~ carport between the existing trees about a car length from the front property line so as to get better "sight line"for visabilitywhen entering the road. The fact that we are on the. outside ~r~ of a small curve in the road affords us an exdellent view of the traffic in either direction, There is very little traffic as we are not on a through street. All trafic is local t~. this immediate area. T~ hardshio created is U~QUE and is not shared by all prope~ies alike in the immediate vicinity of this proper~ and in this use district because: We have one of the lots with some of the largest t~ees in this area making it a most desirable feature to keep "AS IS" the legal rear yard is not suitable for accessory buildings 3. The Variance would observe the spirit of the Ordinance and WOULD NOT CHANGE THE CHARACTER oF THE DISTRICT because ~ The open sided carport wouldafford some protection for our automobile but would not obstruct visability for any of our neighbors~ would not detract from the wooded and shaded part of the let and would not be detrementalto the neighborhood~ nor would itbe an "eyesore" of anykind - having ~ legs and a roof - no side enclosure as a regular garage would have. There isanother similar carport a short distance to the nort~ Of us so there would Belno change or har~ to this residential area.
