WHEREAS, this proposal is to set off a 1.83-acre unimproved lot from a 44.219-acre parcel, north of Sound Avenue in Mattituck; and WHEREAS, the Southold Town Planning Board granted conditional sketch plan approval on the plat, dated April 10, 2001; and WHEREAS, the Planning Board, pursuant to the State Environmental Quality Review Act, (Article 8), Part 617, performed a review of this Unlisted Action, made a determination of non-significance and granted a Negative Declaration on August 18, 2001; and WHEREAS, the applicant has requested that the Planning Board relieve him of the suggested Covenant and Restriction for road maintenance of the right-of-way due to the fact that the right-of-way serves six lots in separate ownership and would create an extraordinary hardship; and WHEREAS, the Planning Board has agreed to relieve the applicant of the Road Maintenance Agreement; and Harbes - Paqe Two - 2/11/03 WHEREAS, the required Park and Playground Fee in the amount of $5,000.00 has been submitted; and WHEREAS, the applicant has received approval from the Suffolk County Department of Health, dated October 4, 2002; and WHEREAS, all conditions and requirements of the Subdivision Regulations of the Town of Southold have been met; be it therefore RESOLVED, that the Southold Town Planning Board grant final approval on the final plat, dated as revised August 28, 2002, and authorize the Chairman to endorse the maps. Harbes III and Monica J. Harbes, residing at 715 Hallock Lane, Mattituck, NY 11952, hereinafter referred to as the Declarant. Maintenance shall include filling pot holes and irregularities as needed; periodic scraping or resurfacing; plowing for snow removal; and such other routine maintenance and driveway repairs as are necessary to maintain the driveway, as constructed in accordance with applicable Town of Southold Planning Board specifications, in good condition. The maximum speed permitted for the driveway shall be 15 mph, or as otherwise agreed by the owners of Lots 1. The Harbes property shall not be required to share the cost of snow removal if the residence is not occupied during the period when snow removal is required. 3. These covenants and restrictions can be modified only at . . . the request of the then owner of either lot with the approval of a majority of the Planning Board of the Town of Southold after a public hearing. The property owner of the other lot in the subdivision shall be entitled to notice such public hearing but his consent to such modification shall not be required. DECLARATION OF COVENANTS AND RESTRICTIONS t, DECLARATION, made the day of ,2002, by EDWARD W. HARBES III and MONICA J. HARBES, residing at 715 Hallock Lane, Mattituck, New York, 11952, hereinafter referred to as the "Declarants" : WHEREAS, the Declarants are the owners of certain real property situate at Hallock Lane, Mattituck, Town of Southold, County of Suffolk and State of New York, known as SCTM #1000-1112-01-07; and WHEREAS, the Declarants have made application to the Planning Board of the Town of Southold for approval of a set off application as shown in a survey dated April 10, 2001, revised August 28, 2002, prepared by Stanley J. The proposed subdivision will result in the creation of a landlocked parcel; that is, a parcel that does not have frontage on an existing or proposed public road. The creation of such a lot is contrary to good subdivision layout principles and creates problems as far as access by emergency and service equipment is concerned. This lack of access could result in health, safety and welfare problems for the future residents of the landlocked lot, not to mention potential disputes over the use and maintenance of any right-of-way over an adjacent parcel that may be created for the purpose of access. Creation of a landlocked lot also places the Zoning Board of Appeals in the awkward position of having to grant a building permit for the lot under Section 280-a of the Town Law as the future owner(s) of the landlocked lot cannot be held responsible for the landlocked nature of their parcel. . The subdivision also creates an exceedingly long access driveway that can result in safety problems for the residents. For example, in the event of a storm emergency the access may be cut off, hence, residents may have difficulty reaching safety. In the event of a house fire or medical emergency, fire vehicles or ambulance vehicles may have difficulty in locating the house, thereby losing precious seconds. The northern setback should be 75' from the property line (rear yard). The western setback should be 35' from the property line (although a side yard, the house should be set back from the new nondescribed right-of-way). Or a longer, narrower building envelope could be achieved by switching the rear and side yard locations and changing the side setback to 20'. 2. The Planning Board has noticed that there is a wetland area on or near one comer of the property. Since it is not adjacent to the current activity, an exact survey will not be required. Instead, the surveyor should sketch a rough outline and label it "Wetlands area - to be surveyed if property further subdivided in future". 3.
